I’m so happy I came across your channel. I have so many questions. If your company is not up and running but it needs to be in order to get the name trademark, what happens if I put money into making a website, logo, business cards, get my name out there.......and for some reason I can’t use my name, what do I do? Now I’m out of money and have to change everything and disburse more money? Do I get a refund if I can’t use the name I tried to trademark? I don’t feel like that is right? I have had my name for a while and I want to pay someone for a logo but I’m scared I’m wasting my time and money if I can’t use it. It will suck if I get my name out there and people know me by that and now I have to change it.

I have a trademark dilemma, i need to submit a extension of time within a month or abandoned my trademark, a business attorney wants to charme 825 to send the paperwork for the extension, which I think is kind of expensive, especially, because he mention it not guarantee they are going to approve the extension for another 6 months. I'm thinking about abandoned it until I open my business to the public but I don't know the risks besides someone else taking it. Your thoughts?

gh xgkv if it’s an identical trademark in the same class, I believe the only way to get that registered would be to have the written permission of the other owner.

I have a trademark I want to abandon because my serial number has 666 at the end and it freaks me out. I was going to abandon it and reapply to get a different serial number. Do you think this is a good idea? Would I risk losing my business name if I do an expressed abandonment

Do I think it's a *good* idea? No. I think it's a waste of money. What are you going to do if you file again and the new serial number still ends in 666? If it helps, once the trademark is registered, you'll get a new registration number that will replace the application serial number. You could also try emailing/calling the examining attorney to see if they can assign a new serial number to it. I have NO IDEA if that's actually possible, but it won't hurt to ask.
