Dear @Legalista Diaries, I don't agree with your analysis that Litigation cannot be practiced in the UAE by foreign-qualified lawyers based on the following contentions: 1) Foreign Qualified Lawyers can be granted a right of audience before the DIFC Courts. 2) Foreign Qualified Lawyers can represent clients in DIAC Arbitration and ADGM Arbitration with a power of attorney. 3) Also being a foreign foreign-qualified lawyer myself, I draft memorandums which are translated into Arabic and submitted to the Court Systems. Unlike in India, hearings are fixed and decisions made by the UAE Courts are quick which makes it extremely worthwhile to do litigation. 4) I've drafted memorandums to Court empaneled experts as well. Yes, we might not have the right to practice Court Craft, but every other element of litigation can be practiced. One benefit of being a litigation legal consultant is that you can control what you earn, rather than a fixed corporate salary. I recommend that we do a video sometime so that your viewers can get the right information about the reality of Corporate and Litigation practice in the UAE. Thank you for your input Ashwin. My reference was for the local courts and obviously, foreign lawyers can practice in DIFC, ADGM, and DIAC provided they qualify to have the right of audience and get registered (especially for DIFC as registration is mandatory). I totally agree that by moulding the procedure a bit, you can file memos before the local courts as well, however, not without an Emirati lawyer (if the client requests for lawyers' representation before the courts). Anyways, the purpose of the video was to share my optimistic thoughts and experience about the possibilities and widen the scope for indian lawyers. As a lawyer coming from India, I believe that there is a myth regarding our limitations, however, as I have mentioned previously on my channel, globalisation of law is a reality in today's world. Lastly, we may have different opinions as lawyers coming from different backgrounds but my videos are solely based on my experience as a CORPORATE lawyer that I am proud of despite the limitation on my salary in comparison to your earnings a litigation lawyer. Thank you for taking out time for a detailed reply and I really appreciate it.

Mam please reply me. Someone told me that u should first complete law in India and then come to UAE. And he mentioned about them that they are Certified UAE Lawyer. So what does it mean, do we have to go UAE and do some course or degree something??

If you want in the corporate sector, you will generally require a bachelors degree in law (minimum requirement). Lawyers can get certified under various authorities based on the specialisation, however, only Emirati lawyers can appear before the courts on behalf of their clients.

There are some courses from which you can learn the basics or techniques or drafting. These days, a lot of these courses are being offered online as well. The level would actually depend on your current knowledge and skills. In my personal experience, drafting can be learnt through courses but can only be mastered with practice.

Yes, you can look for jobs in the UAE, however, there are less opportunities if you are not an Arabic speaker. If you apply for litigation assistance jobs, I recommend including drafting skills in your resume to highlight your proficiency for the job.

You want to pursue in India or abroad? You can get your License from the BCI. Even if you choose to adopt a different career option, you may have to surrender the license. So, getting the license is no harm.
