None of the schools I ever went to had handbooks. We were just supposed to know all the rules through osmosis. It was good preparation for the rest of life, because that's also how laws work!

Once got my phone taken away during school, dad had to get it afterwards. They told him that next time they would be holding it for the semester, he laughed and said "You can fucking try, I paid for that phone and you wont be keeping it."

​@allasar I'm currently a senior in high school and I have all important phone numbers memorized. That includes my mother, father, mother's work phone, step-father, Marine Corps recruiter, recruiting substation commander, aunt, and grandmother. Not all of those area codes are the same, but I took the time to memorize them in case I didn't have my phone with me.

Once in my school , the principal had an announcement and said "all students must give their cellphones to the teacher , students will be getting them back by the end of the school day" everyone gave their mobile phones , later she had an another announcement said Cellphones are now banned and students will have to give 2000Rs to get their phones back , this caused a riot and everyone rushed to principal office , student broke glass windows and door , in the end principal had to give everyone phone back without any fee 🤣

In highschool we had a substitute teacher in our civics class for about a month or so, and he was a very chill dude. Didn’t have a problem with people using their phones as long as it wasn’t distracting. One girl was constantly on her phone with notifications going off, and after repeated warnings he took her phone and promised to give it back at the end of class. We were all so focused on our work that we didn’t notice until he handed her phone back - he put a layer of paper around the phone, and then wrapped it with multiple layers of duct tape 😂 it took her a good while to unroll it all, and we all had a good laugh about it. The girl was amused by it as well and not upset at all.

Was it a modern smart phone? If it was an older model where you can easily remove the battery, I would have separated the battery from the phone and wrapped it so that the back, battery, and phone were all in separate layers and taped to hell and back with packaging tape. She'd have probably gotten home before she could successfully unwrap it.

My school can take it for up to like a week I think but they aren’t very strict on them, as long as you’re not in first year, you can have it in your pocket and go in it as long as the lesson is not happening (e.g the teacher hasn’t come in yet)

@@Doogalebot12 I’m an adult and a veteran, I’ll whoop a teachers ass up and down a hallway if they touch a hair on my child’s head or their property for any reason and then the police can haul us BOTH off to jail for breaking the law. You can call that Naive but I call it standing up for your principles. I’d love to know how you legally assault a child to take their phone (which are worth enough to count as grand theft in some states) from their pocket, purse, or hand. You also have to figure out how to stop their Father from curb stomping you the same day when he specifically instructed his child to never give their phone to any “authority figure” that doesn’t have a warrant for it and then you attacked them to take it.

You can lick the state indoctrination camp boot all you want but the truth is local policy doesn’t trump state and federal laws. Commit grand theft and assault on my child using a school or group policy as an excuse and not only do you go to jail but you also get your ass bear first. Children don’t own property, the phone is mine for all legal purposes and it won’t be surrendered to anyone that doesn’t have a warrant and several armed officers there to enforce it.

Fun fact: there was a lawsuit regarding this exact issue stating that keeping the child's phone overnight left the child vulnerable and unable to contact anyone when an emergency occurred. Or something along those lines.

It’s worse than that. Even if there weren’t an emergency communication aspect, there are limitations to the guardian pro tem thing AND last I checked school is required so there is a coercive aspect to the signatures. Another AND, there are plenty of kids who are 18 senior year. Fun story, back in the 90s after I turned 18 senior year, I made a suggestive hat and wore it to school. An assistant principal took it and wanted one of my parents to collect it. I threatened him and he sent a cop to my house later that day. The cop noped out of there as soon as he found out I was 18, the assistant principal gave him everything needed for a theft arrest, and I started insisting I wanted a report and the assistant principal arrested for theft. Basically, “yes, officer, I did threaten him over the theft. He needs to be arrested, my property returned, and I dare you to arrest me. I’m sure we’ll have a splendid time in court.”

Your teacher warns you what the school phone policy is, and the consequences. If you had your phone out clearly you weren’t thinking about any consequences then, but nooowww. “Ohh nooo. Something unfortunate happened to me.. who could I blame… Aha! The teacher that warned me there is consequences to my actions” listen dummy if you’re ever locked out of your house go to your neighbor, don’t sit outside in the dark like a sped. Go to a neighbor you might trust and stick around for a little bit until your guardian gets home. You don’t need to let anything happen to you just to prove a point.

If its for emegency reasons he/she needs a medical slip/form that dictates everything that is needed for their wellbeing (all schools have this form as it is legally required). If not then maybe try reading the contract you may or may not have signed before enrollling your child in said school.

It's very unlikely that they need consent to take your phone, even by prying it out of your hands. The courts have frequently upheld teachers using reasonable force to keep a classroom in order, and taking a phone forcefully from you is within that Goldilocks zone of reason.

I am a teacher, we can take the phone. Now I would never take it by force. If you do not hand it over willingly, you leave my classroom, and we see where we go from there. Never had it escalate to be honest, I teach and give respect. The rare occasion that a student is caught on his/her phone they hand them over. Rules are rules, and if you do not agree with them, there are other schools.

It's a crime, legally speaking, for one I was not there to sign the school policy or witness it, but assuming I am a minor it won't matter much there, however. Legally speaking, all you can do is request my device and I can tell you no, you can then remove me from the class and have me either sent home or to the office, the same dance will happen with the school admin, you have no legal right, I will say no. Policy of the school does not go over the law, same applies to HOA 'laws' which are more just regulations, police enforce laws, not regulations, take my device and I report it as stolen.

there's a number of teachers who actively tell children that whatever they bring to school becomes "school property" and that they can simply take things away indefinitely. I've been to several schools, and this has happened to me several times. Although never permanent, the idea that teachers can just say something like this with such ease should be considered abuse, and should get them fired.

As a Norwegian I'm always astonished at how everything seems to be okay legally in the US so long as there is a contract. In Europe there are a loot of things that contracts can't legally regulate. For example, even if the contract made it sound like you theoretically sold your phone to the school so it's their property, if it's de facto your property (as in, in practice everyone recognizes it as your property) it IS your property. Contract or not

We do have these contracts in Germany too, but they aren‘t binding because a minor simply isn‘t able to sign legally binding contracts. At most these contracts are binding for the parents but most schools don’t even have proper contracts. They also likely won‘t be valid in the US (not only that, school law both in Germany and the US is state‘s law, not federal law). However, school law usually has regulations put in place to allow for confiscating items under special occasions.

My aunt was my Middle School Principal for 2 years and she was my High School Principal for the other four. She still works at the High School and visits the Middle School. But if anyone did attempt to take things from me or something, she would always know how I felt. She saw it in my eyes and I love her so much for it. My mom passed, so shes like my new mom.

My school wouldn't give me mine until my mother came. She was forced to walk after a total hip replacement even after explaining the situation. I had it taken while doing a 120fps slow mo of me and my friends running during lunch. I was so proud of my 10mp camera. The tech was crazy back then to me and my friends back then I wasn't in class

Someone tried explaining the situation to the administrators/teachers, because thats what the comment says. If a 10mp camera was something to be proud of, then that phone probably costed a lot of money

I went to the restroom, and when i came back he took all of my pokemon cards from my backpack (its how i made friends) and gave them to another student and told me i didn't deserve them. actually in court of law t was ruled taking someones phone was an infringement upon the constitutional right of freedom of speech and was ruled by federal judge that they can infact not take someones phone. Due to preventing the child from having nay contact with legal guardian, police, or lawyers. It was ruled unlawful and dangerous, as the student often does not sign and is peerpressured into signing a contract they have no clue about. Which was used to show the problem. a teacher by law can not take your phone no matter what the contract says. Because by federal law if a school system does this, and t is reported that school will ultimately face fines of and up 50 k or millions

Back when I was in school over a decade ago I saw a interaction of a teacher confiscating a students phone and refusing to return it at the end of the day. The student rightly pissed off was immediately scared and offered to stop arguing the point and behave should the teacher give the phone back after class. The deal was not taken. So the student admitted they don't need to play with the phone at school but they sure as hell need it to get home safely, because the threat of filming or calling the police was on the few things keeping her safe on the way home. Teacher flat out said not my problem and kept the phone. Later heard the student was followed and harassed all the way home without any way to call for help. Keep your phone close and don't give anyone a reason, excuse or opportunity to take it from you. It is a tool that can save your life first, a device to make life more convenient second and a toy last. Be grateful if you have one at all, because a lot of people before you didn't when the world was even less safe than it is now.

When I was in school over a decade ago, they somewhat went by a "rest of class, then next time rest of day, then next time rest of week, then next time rest of semester, then next time rest of the school year." It was only enforced by the teachers' bias in how much they liked the kid or not. Some would walk by a kid's open backpack, see a phone sitting in it, and count it as the next step. Some would catch social butterflies on their phone in the middle of a lecture a couple dozen times through the semester and only get it taken away until the end of the lecture.@@iamsiley

There's too many personal documetns on your phone on average that its counted as beyond grand theft, as its potentially the family estate's financial information for hackers. A punch would be considered valid defense against an unarmed thief.

@@iamsiley yes PARENTS sign the contract so its the parents that agree to the rules or whatever they sign for the child. the child legally can not sign the contract until they become 18 so legally anything signed "for the child" or "on the child's behalf" is not actually legally binding as the child can not sign for it.

@@Cursed2.0 look man I recognize that new iPhone models are copy and paste, that’s why I use an iPhone 7, it’s simple, rustic, easy to navigate, and is beautifully cooked with excellent flavor, iPhone has done phones right so much so that they don’t know what else to do. Androids generally are cheaper and easier to break especially in my experience as I used to own androids on 3 separate occasions, but they broke every damn time. Keep an iPhone 2 as a backup for your android idgaf.

I'm a Millennial so we didn't have smart phones in school. Considering how many people needed to call for a ride home they should never allow phone confiscation. If you're caught screwing around on your phone, it goes in a basket on the teacher's desk that you're allowed to take it back from at the end of the class. If adults are allowed to use their phones on their 15 minute breaks at their jobs, it's not right to forbid a kid from using their phone between classes or lunchtime, which is what confiscation until the end of the day or longer would be. If I had a child in the school system, regardless if the child or us his/her parents paid for it, I would tell my kid that they do NOT have to hand over their phone to anyone, put that phone in your pocket so they'd have to risk a groping based lawsuit. I would NOT sign any policy BS that allowed my kid to get their phone confiscated. If they wanted me to PAY to get my kid's phone back? HELL NO! That's extortion. Give me that phone or I'm calling the cops for robbery.

We snitched on a theif/drug dealer to our college dorm warden and got him kicked out. That snitch called cops on us and reported that we sent death threats to him, college authority was reported by the cops so they confiscated our phones overnight to investigate. i mean yea, if the police how probable cause for such a thing and completely let you off after finding this report was false, id say thats fine, plus he got in a ton of trouble for that (which the police prob didint tell you but yea thats a felony for making such a claim)

He bashed a metal plate on another guys head once as well, this drug dealer used to get high on H and do heinous things to everyone. I hate snitches but in this case I potentially saved someone’s life.

The policy about devices only makes you sign "I've read and understand" so you dont have to agree and give permission, by signing the Halton District School Board form you just confirm that you read it and you understand their basic English.

A teacher taking a student’s phone is arguably an act of child endangerment especially if they need the phone to have access to 911 as well as communicating with parents to arrange for transportation.

I just refused to hand it over and all they can do at that point is give detention, give you ISS, or send you home. Mostly because this was back when phones didn't really have lock patterns, fingerprint ID, or face recognition. So teachers or a principal could just look through your phone if they wanted. You probably don't have anything bad on your phone maybe some texts between friends. Yet do you really want some teacher or the principal to go through your phone invading your privacy?

I once had a teacher who got into an argument over a phone in first period. The teacher took the phone and said he’d give it back at the end of the day. He proceeded to input 0000 as the passcode, effectively locking the phone. He kept a close eye on the phone and continued to lock it out until the end of the school day. The student got their phone back at the end of the school day, but couldn’t use it for the rest of the day thereafter due to the lockout timer.

One day my best friend was on her phone trying to call her mom because she was eng feeling well and the teacher came up and took her phone for the whole week. When it was time for her to get her phone back apparently they lost her phone and didn’t want to even look for it. So now it’s been 1 year and they still didn’t find it. Crazy

Because schools are public bodies what is the ability to judicially review administrative policies in the US for being unreasonably restrictive toward protected rights for example unreasonable search and seizure? What court in the US has jurisdiction to hear judicial review against public bodies?

Legally speaking, no, just at least that’s the case where I live and the reason why it’s because lots of kids depend on their phone to not only contact her parents in the case of emergency of you know what they are a child, but they also use their phones for medical purposes And a child can end up dead so instead of going through that legal mass teachers simply cannot take your phone overnight. I think there’s even rules saying that teachers cannot take your phone during class anymore.
