-------------------------------------
The basic gist of adverse possession is that it allows a person to acquire ownership of a piece of land or property through continuous, open, notorious, hostile, and exclusive possession. Each of these terms carries its own meaning.
The main point of this legal principle is that if a person occupies and uses a piece of land or property belonging to someone else as if they own it, and the true owner does not object or attempt to eject them, the occupier may be able to claim ownership of the land or property after a certain period of time.
There are some variations in the requirements for this type of claim in different states, but generally, a person must show that they have been in possession of the land or property for a certain number of years, that his or her possession was open and notorious, that it was hostile to the true owner's claim of ownership, and that it was continuous and exclusive.
The typical required time period that the non-owner must remain in possession in order to benefit from adverse possession is 10 years.

What do you think? Should "adverse possession" be allowed at all? Also, if you want to learn how to properly protect your real estate investments while using an LLC, check out this video: kzbin.info/www/bejne/e3ykn3Sae8mkb9E

It's still theft. It doesn't matter how it's packaged.

I'm against huge corporations buying up houses to sit on as future investments. So anything that discourages that is good in my opinion.

I wonder what should you do if there no owner of the or you don’t know who the owner because you never met him or her and their has been abandoned for long periods of time like years? And someone moves in and takes care of it, does that mean the property belongs to them? Or another what if the owner(s) of the property has passed away does and someone on is living their former property, does that also means the new resident owns it

It all depends on exactly what requirements the local and state law have.

4:00: It's weird to me, that in order to PREVENT someone from adversely possessing your property, you have to ALLOW them to use it.

Agreed! This is a very peculiar legal concept that is counter intuitive in the way you just highlighted. But, it still persists in many states across the country. The main underlying value judgment behind why it is still allowed is the thing that I mentioned in the video: the goal of discouraging land to go unutilized and unproductive.

5:54 If the adverse possessor intimidates (or if a reasonable person would conclude that the rightful owner was intimidated by the adverse possessor) how is this legal? What prevents the element of possession by the adverse possessor to met by just intimidating the rightful owner??

That would be a factor in favor of the real owner in any lawsuit over ownership. The real owner would need to prove that the adverse possessor used intimidation tactics and that is why the owner didn’t try to assert his or her lawful rights to ownership sooner.

Im doing it but it is land that is considered usless because of an evasive weed so it has been abandoned.. I wouldn't steal a good piece of land/property from anyone. That is low!Furthermore Why claim itjust use it I dont want to pay the taxes.
