This reminds me a story I was told by a notary friend. In defiance of the terms of a will, an heir decided to botch the sharing agreement signed by other members of the family by drawing a cross on the last page. The notary took back the document, circled the "X" and lifted a legalese formula from a XVIIth century document he happened to have had framed and was hanging on his wall (the formula was something like "I, ___, notary, certify the present mark to have been drawn in front of me by ____ etc. etc."). The bitter heir thus left egg-faced.

In Japan and probably China too you can get personalized stamps that you use instead of writing your name. That was even a thing in Europe where you had your signature made into a stamp that you used if you were in a position where you had to sign a lot of document every day.

Björn-Erik Borg, in Russia doctors, and veterinarians too, and probably lots of other people, have their personal stamps and stamp everything they issue. Of course, they also sign important documents with a pen. At least you can read on the stamp who the person who signed or issued a document is (and ask about them later) for doctors' writing is horrible, as always.

I have cerebral palsy and come from the days when us gimps were segregated from the normals in "special schools" so no one caught Disability... I remember our teachers spending quite a lot of time making sure we could all sign our first names when at all possible (including taping a pen to pupils' hands, etc - really impractical means sometimes!). It wasn't because an X wasn't valid (we were often reassured that it was), but rather because it's easier to forge an X than it is to forge a highly-illegible, obviously-gimpy, but fairly consistent version of "Andrew," "Mary," etc. I was one of the luckier students, in that I could write, and write legibly, but I remain grateful that my generation of disabled people, at least in *that* school, all went into adulthood with the ability to sign our first names... even the folks who literally can't write anything else. As Simon points out, it's becoming an obsolete skill *now*, but in the early/mid-80s, we had no way to know that would happen... it was nice that the staff cared enough to spend time on it. I'm also grateful that my parents fought like hell to get me into a regular mainstream (aka with-ablebodied-students) school fairly early on, but that's another matter.

The last checking account I opened I asked if they needed me to fill out a signature card and was very surprised that no one had any idea what I was talking about. They ended up asking one of the loan officers about it, I guess because of my complete confusion, and luckily she knew exactly what it was and explained that the bank no longer used them. One instance where a matching signature is very important is for absentee voting ballots...at least in Florida but probably other US jurisdictions as well. For those that don't know, a voter can request an absentee ballot to vote, which is mailed to their registered address. You vote and then put the ballot inside an envelope and then have to sign across the seem. When it reaches the supervisor of elections office, all absentee ballots are processed by a canvassing board with the signature compared to the signature on file (when you registered to vote, or updated your signature). If it doesn't match, the envelope won't be opened and so the ballot won't be counted in the election.

If someone gets you cornered in whatever manner, you can create a method for later litigation purposes, with a "TDC" after your name, indicating that you signed it under _Threat, Duress, and Coercion._ Signing in Liquid Blue Ink is also helpful in establishing that the signature is not a photocopy.

The amusing thing is that there are now issues with the electronic pens used for signatures. One thing that has been semi-common among people who start having issues with their hands/wrists that would make a clear signature impossible is to take a copy of theirs from when they could and have a stamp of it made. That no longer works with several of the things and creates a mess...

To answer that question from the standpoint of a non common law legal system - yes you can, the Croatian civil obligations act calls it a "handsign" (litteral translation). It's only supposed to be used by people who can't read or write, and any contract signed in such a way needs to be verified by a notary public. You can also create a last will by signing a premade text that has been read to you with a big fat X, however the last will needs to be signed by two more witnesses.

In times past some wealthy men used signet rings to "mark their mark" on legal documents. A man would press the ring into something like an ink pad and then press the ring on the document to make a particular mark that he identified with. Others would mark a document with the first letter of their name instead of an "X".

But for such legislation, under the plain language of the UCC section cited an email signature would *not* be a valid signature. In this case he was a director of the company and was being pushed out. I don't know the details but it was a pretty tense meeting. I've heard of similar stories with just regular employees being forced to sign non disclosure/non compete forms or not be allowed leave. They were kept for many hours until they broke down. I just always remember when this happened because if I was in the same situation I'd try the same thing. Or, until I saw this video, I'd have signed something like "Mickey Mouse"

That's sort of what I'm wondering after having watched the video. If anything you write (even a false name) counts as you accepting the terms and the only way out of it would be to prove you were coerced, is there something that you can write to turn the tables on them? I know that he was told beforehand by a lawyer to write this if something fishy came up. I guess in the end it would come down to fighting it out with lawyers and possibly court which is always big bucks. In most countries in Europe the signature has to be placed by hand, so it can be an X or your initials, but not a stamp. An electronic signature is allowed with the "something you have, something you know" principle. PIN/TAN for example.

what I find annoying about the signature on the back of cards is the material you have to write on. For some reason, you can never find a pen that can write on it decently. Usually your signature is something that you write quickly and you cannot apply much force so you can hardly see it. But if you do it slowly and with more force, it's legible but looks less like your actual signature because you have to write it slower... but in most cases those things aren't very writable with an ordinary pen...

Lots of questions about what happens if you sign, "I do not consent." You are making a counter offer. Therefore, the other party need not fulfill their part. For example, let's say you have to sign for a package and you write, "I do not consent" or "under duress." In my job I research 1800s era documents. I regularly find deeds that were recorded with the signature noted "her X mark" indicating that someone could not read and write. 99% of the time it is the wife or some female heir of a wealthy land owner. But it is notarized and there are usually notes that the person notarizing examined the person to verify they understood what they were signing.

Well in law school they taught me, consent can be given in various ways a simple yes answer or a handshake is already considered consent, making a contract legally binding. The problem occurs when the contract needs to be proven or enforced, this is why things are written down. This however does not mean verbal contracts aren't enforceable, evidence such as witness testimony and circumstancial evidence can be used to prove the contracts existence.

The question is one of authentication. If the purported signer denies the authenticity of the signature, it is better as a matter of proof if it is possible for an adverse party to prove the authenticity of the mark, and better still if it can also be shown that the mark was willfully and freely made without misrepresentation or undue influence by the person seeking to enforce the signature, or his agents.

My dad always signs notes to us as “Me” I caught him signing a school note like that. Had to convince him to change it so they wouldn’t accuse me of just signing “me”

Is it legal in the United States for medical staff to have a patient sign any kind of form after they've just had a medical procedure and are still waking up from anesthesia in the recovery room?

Melissa0774 No, they make you sign anything before, then if your not totally aware they have family member or whatever give an ok, and if no one is available, medical professional does what they feel is best for patient.

There are huge differences between "illegal" and unwise. In general, the practice you described is extremely unwise and medically highly flawed. But I agree that it still happens. Fortunately patients are also provided with written instructions and hopefully other responsible people are present to hear instructions.

I have personally seen it happen in outpatient facilities like endoscopy centers. Those were post-procedure instructions.

Lol in Croatia they would call the security guard, and the cops instantly. I had a problem in a bank because i didn't sign the contract with the same signature as on my ID card.

With those electronic signing things that they have everywhere, at first I tried to sign my regular signature, but now I just put an X. I still write out my signature on real contracts and things that are important, tho, like checks and large purchases. Do most people sign out their names on those digital things?

I wonder if two very obviously wrong signatures and one of those were wrongly dated by myself on my own dnr. I was under some kind of drug or something, not sure. Could I possibly prove my family member was trying to kill me? All the initals were forged. I eventually found out about it and had it removed. Several years later after no contact I was on life support, she found out. Payed 2500. to get conservatorship on me. I was told in writing to pull the plug on me. I lived after being taken off the vent and she didnt get the chance. I was also able to get her conservatorship off me eventually. I would like to press charges but Im not having luck with it. Any suggestions? I have all the documents. People have a very hard time believing a mother would do such things. Thank you
