People in Eastern Europe risked death for democracy, so we really have no excuses for complacently letting our middle class get gutted and reduced to living like students over the last 40 years. Inefficiency is often through federal cuts which cause restructuring. Then, corporations point out the issues to push privatization. Unionized Employees’ Rights 1. Collective Agreement: • Unionized employees are protected by their collective agreement, which outlines layoff procedures, notice requirements, severance entitlements, and recall rights. • Employers must follow the terms of the agreement when making layoff decisions. 2. Mass Termination Rules: • Under the Ontario Employment Standards Act (ESA), a layoff involving 50 or more employees at a single location within a 4-week period is considered a mass termination. • Employers must: • Provide written notice to employees (or pay in lieu of notice). • Notify the Ministry of Labour in advance. • Provide affected employees with severance pay if eligible (e.g., worked 5+ years for the company and the employer’s payroll is $2.5M+). 3. Notice Period: • The minimum notice period depends on the number of employees affected: • 50-199 employees: 8 weeks. • 200-499 employees: 12 weeks. • 500+ employees: 16 weeks. 4. Union Rights: • The union must be consulted before layoffs. • Workers can file a grievance if they believe the employer is violating the collective agreement or acting in bad faith. Layoff vs. Termination: • A layoff (temporary or indefinite) may be allowed if specified in the collective agreement. • If layoffs exceed the ESA’s maximum allowable period (13 weeks in most cases), they are considered terminations, triggering severance obligations. Exceptions: • If the layoffs result from bankruptcy, unforeseeable circumstances, or force majeure, some obligations (like notice) may be altered, though employers are still expected to act reasonably and lawfully. Recourse for Employees: • Grievances: Workers can dispute layoffs through their union. • Filing Complaints: Employees may file a complaint with the Ministry of Labour if ESA rights are violated. • Human Rights: Layoffs must not be discriminatory (e.g., based on age, race, gender). • Collective Action: Unions may challenge mass layoffs through labor boards or the courts. Given the scale of 50,000 workers, the action would likely attract significant scrutiny, both legally and politically, and could trigger public inquiries or legislative responses. Union and employee representatives would likely take immediate steps to protect workers’ rights.
