I don't get it. Normally you lose the house, and it gets sold for back taxes in a tax sale. I've put in tenders on those tax sale homes before. The only punishment to the tenant should be getting evicted due to the tax sale.

It is a commercial property. In case you haven't noticed, commercial property values are plunging in most cities. CRA can collect from the tenant who can sue/withhold lease payments to the the owner. A lien on a depreciating asset may not be realized for many years as it affects the owners ability to sell. Maintaining a lien also entails legal costs.

If you knew anything about commercial leases you would know the tenant almost ALWAYS pays the taxes. Most are triple net leases. You have no clue what you are talking about. With that being said your reasons for not registering a lien make no sense either. Registering a lien is cheap to do and the CRA has no problem waiting. They just add interest and penalties which they are more then happy to do.

Tax has nothing to do with fairness. It's entirely designed to squeeze as much out of the population as they can before we revolt. The government is hoping to collect as much as possible before the next election.

All countries do this. I am Canadian living in Winnipeg and I have a rental house in Florida. I am supposed to tell the guest I rent to to withhold tax and pay the taxes to the US government. Good luck with that and no one does this. I would get zero rentals if I told the guest they were supposed to pay the taxes themselves. It would be a total nightmare. These Canadian laws have to be changed. Why can't CRA get the taxes from the Landlord ? Canada has tax treaties with a lot of countries and what they should do is prevent these landlords from renting places to anyone in Canada without some payment enforced or Canada has the right to request the other country to recover the taxes from the individual. They do this in Canada. The US can come after people in Canada that owe taxes in the US. They can get the CRA to recover the tax money from Canadians and this is part of the tax treaty with the US.

They don’t go after owners outside the country because it is difficult and expensive. It is much easier to go after those who are in the country. Plus the law is explicit on going after the person or corporation that paid the gross revenue to withhold for foreign transactions. This is a staple of how withholdings work. You all just don’t know about it. It’s been here for a very long time.

@@gh4534 I knew about it because I have a rental property in the US and they have the same thing there. I just rent to vacationers and they are supposed to remit some tax and fill out a form and a bunch of stuff but no one does this. It would be a mass of paperwork. If I started asking the renters to do this , they would rent with someone else. The landlord remits all taxes and a couple of years ago VRBO started remitting the Florida sales tax directly. They have made the system far too complicated with ridiculous rules. Yes you say the Canadian laws are specific but the laws need to be changed, because no one can know all this stuff. You need to be a specialist. My tax return in 1972 was 2 pages long. In 2018 it was one inch thick and took me about a month to do. An accountant would charge me about$1500 in 2010 to do this , so I never got one and just did it myself. I also pay for a US accountant to file US taxes. I never had a accountant before and the big firm US accountant was making all kinds of mistakes and I guess they thought I wouldn't go through the purchase and HUD and read books on US tax. They didn't even know that you could deduct the interest paid on borrowed money to purchase furniture for a rental unit. In Canada you can but I thought the US must be different. Until I talked to a guy at the IRS about another matter , then just asked about the interest expense to double check. And yes the accountant was wrong. Then another owner from Winnipeg also told me his US accountant was awful and making mistakes. This means that all accountants are probably pretty bad and just don't care. Most people don't understand their taxes. They just pay H&R to do them and don't question anything. Also no one can do any year to year planning unless you understand what all the deductions are about. When is a good time to sell RRSP's ? You have a choice of 2 different years to claim medical expenses and a bunch of other options and if you don't understand your taxes then you will lose money. I told my ex wife who will have a very low income this year to cash in a bunch of RRSP's and not pay any tax. Most people just don't know how to pay the least tax.

I'm guessing that the landlord is unreachable so when the police take control of the home after the lien is unpaid CRA thinks that the landlord will sue because he was never notified of the lien and therefore never had the chance to pay it off. The CRA doesn't want to deal with potential litigation and has passed the burden onto the tenant instead (and he'll be responsible in collecting from the landlord.) Still a dick move from the CRA.

I remember a neighbor in my town bought a used car from..another neighbor. The second neighbor ran a small used car lot/mechanic shop. He'd pack his car, go for a trip, and a few of the guys in the car would be driving back some of the cars he bought for the lot. The car in this case was reported stolen, the used car salesman said he had no idea, the police took the car, and at least for a while it was 'outta luck' for the neighbor who bought it from the used car guy. I don't know where it all landed.

There’s two things that could have prevented the shortage of rental homes, one was more public owned housing, something that never would be supported by Conservatives ever. The second was provincial governments encouraging municipalities to densify instead of zoning for more sprawling suburbs. Suburbs are very expensive to build and maintain because of the rising costs of roads, schools that need children bussed in because families have fewer children, people have to drive further for shopping, services, and work. There’s plenty of blame to go around but it’s mostly the governments closest to people and that’s municipal and provincial governments.

This has nothing to do with Trudeau or any other PM in the past or future. This is how CRA operates and these are the rules anr actions they take. You just don’t hear about them because most people don’t follow what CRA does, have done and will continue to do independent of who is PM. Just because you don’t like Trudeau does not automatically make him the sole architect of this tax audit position. The next PM will have no effect on what CRA will do.

I never said he or any other PM has no accountability. All PMs will enjoy a honeymoon period and then it fucks up. They will all sell a message to enough people that they can creat a better world but none of them can. The massive system is not repairable and immutable. No one person can change things for the better so that it pleases everyone. And don’t assuming you know what I think about Trudeau. Cause you don’t. The next PM will not be able to change the system for the better (assuming one can define that better means). That train has left the station.

It’s a slippery slope. Tenants are constantly voicing that they get their share of the home they rent - even so far as to think they should get some of the value when the owner sells. You can’t want and receive part ownership for only the good, and not the bad. Either you choose to own it all, or stay a tenant. We have to be careful what we wish for here

What kind of tenants are you talking to? With normal people we know if we don’t own it we don’t get anything at all from it but living in it and not paying for the new furnace if needed. You must be talking with kid tenants. The biggest problem with all of this is the number of young people who don't have the ability to grow the value of their assets. If you can do the work yourself, you're fine. I bought a $200,000 house in 2019, my wife and I were 25 at the time. Over the last five years, I've put in hundreds of hours and probably $100,000 in material into the house. With inflation and renovations, my home is now worth more than double what I paid.

This can easily be challenged in a higher court because the CRA has a long history of misinterpreting Canadian tax law ! My angle is this: The relationship between a landlord and a tenant puts the onus on the landlord to portray him or herself as the legitimate owner of the property, or person assigned the responsibility from the owner to rent the property. It is never the onus of a prospective renter to research if a landlord is legitimate. If the landlord does not declare the income nor is able to pay the taxes, then the property should be seized. Whoever ruled in this kangaroo court should not be on the bench as a judge because now they have opened a huge can of worms that affects everyone in the country who rents. But maybe that is by design for unscrupulous reasons. Anyone who believes any of our govt. Institutions are independent of this Liberal govt. are extremely naive !

Well if all the tenant needs to do is to withhold these money from rent, this doesn't sound like the worst case for the tenant. They can collect their money within a month by withholding rent. It is inconvenient for the tenant, but I wouldn't say outragiously unfair

Ok, but does the renter now own the house? If you are covering the landlords debt, something tells me you should now be the rightful owner of the house. The house is not in YOUR name, it is in the landlords name. This is like grabbing a random customer at a bank and telling them to cover all the banks expenses because they just happened to be at the bank.

How is this the tenant's responsibility? He's just renting the property. He doesn't own the property. Property taxes are collected by CRA from the owner. So if the CRA can't get the taxes from the owner, they sell the property, not make a tenant pay taxes on something they don't own. Upon application for a rental agreement or a lease, all landlords should require Federal Employees to declare which division of the government they work for. The contract should stare that lies or untruths will result in immediate eviction and forfeiture of the damage and security deposits. Landlords have a right and are expected to to keep drug dealers, prostitutes and undesirables off their property, CRA employees are equally unscrupulous and undesirable.

This is quite funny that tenants can demand ownership and citizenship on the landlords lol……. Long time coming that landlords must now show proof rather then tenants begging…. At this point any tenant with some thinking will demand to see these things….. a tenants can always keep looking a landlord is stuck with what comes.

This person rents their home. They're not likely rich. They don't likely make hundreds of dollars an hour, to pay someone else that much. From other comments, they've spent thousands on a lawyer, and who knows if it'll help.
