Hi Sir, Can a controller set for hearing, without a request from either parties? In both cases of Patent and design? After the transfer of petition, and counter statement, what will happen if no party raise a request for hearing within stipulated time?

As per the patents act - the controller schedules the hearing (applicant can also request). In designs act - the controller provides hearing upon request from the applicant (but, in reality, the controller on its own can also schedule hearing.) In case of cancellation petition, here as well, the controller on its own can propose hearing, if not, the controller can decide the case based on the documents submitted.
