Qualified immunity - Root cause of a lot of Police Misconduct The U.S. Supreme Court first introduced the qualified immunity doctrine in Pierson v. Ray (1967), a case litigated during the height of the civil rights movement. It is stated to have been originally introduced with the rationale of protecting law enforcement officials from frivolous lawsuits and financial liability in cases where they acted in good faith in unclear legal situations. Starting around 2005, courts increasingly applied the doctrine to cases involving the use of excessive or deadly force by police, leading to widespread criticism that it "has become a nearly fail safe tool to let police brutality go unpunished and deny victims their constitutional rights" (as summarized in a 2020 Reuters report). This doctrine, invented by the Court out of whole cloth, immunizes public officials even when they commit legal misconduct unless they violated 'clearly established law'. That standard is incredibly difficult for civil rights plaintiffs to overcome because the courts have required not just a clear legal rule, but a prior case on the books with functionally identical facts. Only 3 years. If a civilian done that, they would get life. A police officer is just as culpable as any one else and should face a harsher sentence than the citizens. Upon reading portions of the autopsy report that was released, him high on cocaine and drunk, along with cardiopulmonary arrest- from fighting the police and resisting arrest- probably shows that he actually was the bad guy. What he did here was awfully similar to what lead to the arrest that landed him in prison for 22-24 years. Yeah, he wasn’t the bad guy. I’d love to know how the police should have facilitated this arrest!

If you are referring to him saying “I can’t breathe” as him being “clearly in physical distress,” you need to watch about a thousand more videos of criminals being arrested and yelling “I can’t breathe.” It happens so often that it is kind like that ol kids story- Chicken Little! So, again I ask, how should the officers have behaved once he was under arrest and began resisting? Also, I simply mentioned his past to show he had the same response to the officers who arrested him back then- fight.

However, imo, these cops were trying to arrest him for something he did, he resisted, and the physical toll was too much on his heart due to the cocaine. There is a report that they should've called for EMT sooner, but judging by how quickly the symptoms of cardiac arrest set in, I doubt they would've been there in time either way as he was already slowing in speech, which means imminent death.

Law Enforcement in addition to the mental and moral standards we need a strict No Pass No Play PT test and an even stricter Fire Arms certification. If You don’t Pass you don’t get to stay a police officer. I’d recommend 2 certifications a year with civilians instructors( NO Police ). Their raises and promotions should require one also.
