How did she think she was going to get paid if she couldn't put into words how much she was supposed to get paid? An absolute basic question would be 'How much should you have got?' followed by 'how much did you actually get?' What else did she think she was going to get asked?

She explained really badly. As I understood it she was earning $500 or so on average, so like 30 hours at 10.5 an hour. But it was shiftwork and split between multiple caregivers so it was never the same every week, just like any pt shift work. The Walmart will pay you part time 500 one week and 800 the next. That's how you get to 1k a week or whatever for twice the time while we're on the boat.

Exactly, she probably could have won easily if she were able to finish a sentence. Then again, Judge Judy was more concerned about average weekly pay than what she actually worked. Judge Judy never worked in an hourly paying job and doesn’t understand the concept of working extra hours and getting paid for it.

Not at all. As a caregiver my hours and days vary. It’s never the same every week. I dont know why that’s so hard to understand. My pay varies every week as well.

Caring for someone who is wheelchair bound is demanding and exhausting. The paralyzed person starts to see the caregiver's body as theirs.

I think the plaintiff was starting to say that she got paid more for the cruise because she was the sole caregiver, however, she was still not paid according to their agreement, but JJ stopped her.

She worked twice the hours because there wasn't a second person like there would have been at home, so she should have gotten twice the pay. It's only a FREE vacation if you get to bugger off and have fun. Having to be nearby and on call all the time is not a vacation. Changing a poopy diaper is just as disgusting no matter where you do it.

She would have spent most of the cruise enjoying romantic private time with her new husband; it wasn't a regular old week of the plaintiff playing cards and watching The Price is Right with her in between trips to the toilet. The client would not have encouraged her to bring a friend along for company if she was going to be actively working for her the majority of the time.

The defendant was on vacation.. The plaintiff was working, around the clock at this quite difficult job. Strictly business for the plaintiff. Her friend was on vacation, but this did not cost the defendant extra, one cabin.

My sister is the caregiver of my mother and a few other people. A few years ago my sister, my mother and one of my sister‘s clients went to Hawaii together. It was no vacation for my sister. She still had to care for two women in their 80s. One was mobile but the other wasn’t. One was bossy and they both acted like children. My sister had to leave the room sometime.😆

The man that she married must have a motive ,like waiting for her to die so he can get her money. I can bet you he asked that the caregiver get fied so he can care for the woman and get everything signed over to him. Yeah, I don’t trust him either. There are many inter-able relationships, but the fact that he married her, but is unwilling or unable to provide care, which is literally the basis of vows in sickness, and in health something is strange, because what is he here for? So desperate for carer to come that they were willing to also pay for the friend? Pull you weight sir if you are committing to be in the defendant’s life. Male Anna Nicole smith.

Plaintiff was too unprepared for this case. It does 100% matter if she worked twice as many hours during this “vacation” (the defendant was on vacation not the plaintiff) as she normally worked. Plus, the plaintiff was not the only caregiver during routine care for the defendant as she stated sometimes she took other shifts. This means there was at least one other aide helping the woman. The plaintiff obviously didn’t have a standard 40 hr/week job so pay varied. While on this vacation she worked 7 days a week as there was no one else. Judge Judy really missed the ball here since as an hourly worker JJ didn’t allow the plaintiff to discuss the number of hours she actually worked.

I think it may also be because of things they wrote to the show since Judge Judy does say the plaintiff had a friend on the cruise so she didn't work all the time. And the defendant was also about to touch on how the plaintiff didn't work as much as agreed upon. In addition, it's confusing cause when the Judge asked how much it was supposed to be around 0.43 she said $942.50 which would make the $3000 she got understandable, as well as almost twice her usual pay of around $500-600.

Yeah I was confused about why she wouldn't hear that either. I agree the plaintiff needs to come more prepared. But I've seen JJ get into hourly rate disputes several times. If she's an hourly employee and she absolutely did show that, then why would JJ ignore the hours she worked or was supose to work or whatever the case may be. That seems to be the discrepancy here is the amount of hours. Plaintiff says she wasn't paid for her hours and defendant said she didn't work those hours. That's what should have been discussed. I'm usually for JJ and how she does things but I agree with you that she missed it this time.

No, general maintenance is cooking, cleaning laundry, and errands. The higher pay is for more intimate assistance. Bathing , wiping, emptying catheters.... ect. It is a hell life to live being in a wheelchair

I don't think the original comment was trying to be obtuse about it, I think they were pointing out one of the reasons why the plaintiff was so inept at expressing specifics. With THAT topic, I can see room to congratulate her for being imprecise, whereas for the other stuff, like how much she was normally paid and how much she was supposedly ripped off could have been articulated with a lot more directness and precision.

Yeah, something is off here maybe also saving face for the defendant’s husband too. I think she was maintaining discretion and dignity for the defendant. It’s weird because the defendant says it was a business trip, but the plaintiff says it was her honeymoon

What she made the year before has nothing to do with that a cruise when 😂you go with someone as their caregiver is completely different and entails a lot more hours. It’s a lot more intense it’s in a tremendous amount of work. It has nothing to do with what you made three months ago.

Plaintiff does so much dancing around her answers because she knows she got paid adequately considering she had a friend with her and was also getting some enjoyment from the vacation. Not as much as if she would have if she wasn’t also working, but she didn’t have to pay any of the cruise expenses. So it was fair and she knew it.

I don't know how much you know about caring for disabled people but this lady normally had 3 carers and this girl had to do everything by herself for those 3 weeks 24/7. This was not any kind of vacation for her, she had to work triple her normal hours, would you call that a vacation just because the weather was nice outside?!! Yes she got to have some company but you have to be with the client all the time or within calling distance. She facilitated everything the defendant wanted to do, which means you aren't doing things you want to do. The friend was the lucky one because she got a free cruise with no expectation of work! So I do believe she had a case for more money but she didn't bother to prepare properly so that's on her.

Not only that, but it was also the defendant's honeymoon. So it stands to reason that the plaintiff wasn't expected to be at the defendant's beck-and-call 24/7; she was there for occasional odds and ends on a contingency basis while her client mostly spent private time with her new husband. (Hence the defendant letting her bring a friend along for company, since caregiver and client were not really going to be together much.) I also have a strong suspicion that the plaintiff's inclusion on the cruise was less about the defendant needing her services and inexplicably firing her at the end, and more about a "thanks for everything; have a good life" gesture at the planned and advance-communicated end of a business relationship when the defendant's new husband obviated the need for a domestic employee to help tie her shoes and get her on/off the toilet.

@@k.robertrichardson6779 in most disabled/able bodied relationships the partner does not become the carer, because they feel it ruins the romance, not only that if you are not trained you could end up badly hurting your partner. She would not have been there for occasional odds and ends what a ridiculous thing to state. You think the defendant went from needing help 24/7 to just the occasional little bit of help? Nope that doesn't happen. There is the medical side to deal with too, which has to be done by somebody who knows what they are doing. I'm disabled although I can largely take care of myself at the moment, but I live next door to somebody who is very disabled who has carers in and out during the day, his Mum comes to stay but she does not suddenly do the carers jobs because she doesn't know how to. She concentrates on doing the housework (his carers run the vacuum round and help with laundry and washing up but not dusting or mopping floors) and tending to his garden. From the sounds of it the defendant sacked her carer because she didn't feel she had done enough work whilst on the cruise. It would have been more sensible to have taken 2 carers, not a carer and her friend.

2:47 This woman seems to a sieve in her brainpan when it comes to giving a straight answer about wages. If you enter some kind of agreement for a thing like a cruise, there should be an arrangement before you leave as to how much should be paid, and for what. The woman has the same needs no matter where she is. She is getting a free cruise, (with a friend). The woman employed her for two years, then took her on a cruise. Obviously the cruise went to the care givers head, and she failed miserably in her duties in the process. Why else would she have been fired after two years? Some people are beyond ridiculous in these claims.

I feel kinda bad for the plaintiff. She was too nervous to make her case. I'm guessing there's a discrepancy in the amount of hours worked. Also, JJ has clearly never cared for a disabled person. Caring for them is never a vacation even if it is on a cruise.

Ok. I've calculated it down based on the numbers given. I'm confident that JJ got this one wrong. Defendant says they agreed to 252 hours over three weeks (84 hours a week - explains the double amount). Hourly rates of $ 18,5 for hands on work, $ 14,5 for general times of availability. Assuming 4 hours daily of hands on work and multiplied by 21 will get you to 82 hours at that higher rate, the remaining 170 at the lower rate will get you to a total of $ 3982. 3000 of which she already received, 900 is the remaining balance.

If we take as given the 2700 the defendant admitted to giving her and the 3612 given in the chiron as agreed upon number. It would come out to 2,25hrs of hands on work daily and a good 9hrs of general availability at the above stated rates. So that math would work too for the $900 ask attributed by JJ to the plaintiff.

I think she was trying to describe things like taking care of things around the house. Or helping her change clothes and things like that. She just chose the worst possible phrase. Makes it sound like she’s taking about an object, rather than a person.

I think the higher pay was for bathing, chainring diapers, emptying colostomy bags, etc. The lower pay was when she was just sitting there in her wheelchair I suppose.

Wow. Obviously none of y’all have been a caregiver. First of all always our days and pay vary week to week and day today as does Workload. So she has a friend on the cruise? That’s nice BUT It’s still work to take care of someone that is handicapped. As a caregiver I have traveled many times it doesn’t mean I shouldnt get paid because I go with someone on THEIR vacation and work for THEM She may be hard to work for. Did any of y’all hear how many hours she worked in the three weeks - over 200 hours. Caregivers start at 20- 25 an hr. Multiply that times over 200 hours.! Judy was ignorant. This was not her vacation.

Plaintiff really dragged the defendant, (who looks as if she’s one fatal mishap from the grave because of her disability ) to court over nothing? Plaintiff just exposed herself and I hope never gets a job caregiving again, the nerve of her! Sometimes it’s better just to walk away, feel bad that defendant had to go through this.

Obviously she was not expected to be actively serving the defendant the majority of the time. If that had been the case, the defendant would not have encouraged her to bring a friend along for company.

@@jaydogg0026 I’m talking about this person comment. About her suing because she went on the cruise. And normally for going away you get paid more regardless of where you’re going. @@BusyBodyVisa If it's the disabled person's honeymoon (new husband performed more "general maintenance" on the defendant than the plaintiff did over those three weeks), and the disabled person pays for you to bring a friend along for company (i.e., there will be plenty of free time not spent helping her go to the bathroom), it is. Especially if you're still getting paid $1,000.00 a week.

She usually worked part time for her and it was split between multiple workers. If she took on additional shifts to make up for a missing person, she made more. On the cruise, she was the only one putting in 24/7 care. She was just too nervous to explain herself properly.

I also thing JJ isn’t considering the different rates based on overnight vs daytime, etc. all I know is my grandpa’s at home caregivers were paid a combined total of $9,000/month. That was for 24 hour care and that is cheap compared to if we had placed him in a facility.

The defendant paid for a vacation for the medical attendant (plaintiff) and her friend under the condition she does her job while she was on the cruise and apparently she spent most of the time playing around with her friend instead of doing her job so the defendant gave her partial payment and fired her and the plaintiff wants more money, arguing that she didn't break the contract.

Someone in that condition doesnt just fire a caregiver. Its very personal to just have a new one. In most cases i think you can suggest that something really happened on that cruise and the plaintiff was paid out of the good will of the defendant, who then got dragged to court (no pun intended) for 10% of the last payout. ow my. women...

She was WORKING on the cruise. She was too nervous and JJ was not patient with her at all. JJ upset me with this one.

Being away from home for 3 weeks is a business trip. She is not on a trip with her family or friends, she’s not home in her own bed each night. Plus she was the only carer for those 3 weeks. The defendant even called it a business trip. So, yes, the fees are double or more. And if they had an agreed rate, why didn’t JJ enforce it or at least ask for proof of that rate?

I'll bet the defendant communicated well in advance that their business relationship would be ending with the wedding (since a former single with a new husband has much less need for domestic employees to take care of her), and the plaintiff's inclusion on the cruise was more of a bon-voyage than a work assignment. Hence being encouraged to bring a friend along for company - after all, it was the defendant's honeymoon, so surely it will be mostly private time with her groom, not ordinary days spent with her caregiver. Then when they landed and reality set in for the plaintiff, she suddenly wished she had more of a job-hunt cushion. Strictly my theory, of course, but it makes more sense than the inexplicable situation the plaintiff is trying to depict.

Plaintiff lost because she was totally unprepared. Normal care shifts are 3x/day, which means she probably worked the shifts of 2 other people in addition to herself during those 3 weeks. Maybe double -- plus the burden of being away from her normal life/family for the duration. She probably was owed more, but JJ clearly had no patience for her rambling.

OK, I've put the case on pause at the 2:30 mark to make a comment: I cannot get over how much of a hassle the plaintiff is giving Judge Judy over the simplest questions! If I were the plaintiff, I would have had a list of everything I was paid by the defendant for many weeks prior if not the complete employment period. Paystubs, banking printouts, whatever. OK, let's see if this annoyance persists.

Have you never had a job? She didn't get paid to go on a cruise, she got paid to change poopy diapers on a cruise ship. Her pay doubled because she worked double the time without another person to relieve her, as would have been the case at home. Should the cleaners on a ship work for free because they're on vacation? It's only a vacation if you can go on some shore trips and have fun, have a few drinks perhaps, get a massage. She was expected to be on call the entire time. She got to see people on vacation, but she was not, herself, on vacation.

@@sunnyd6931 I had one of those "vacation" jobs. It was the same work as always, but a little harder due to the new environment not being as well organized as the usual location. Also, she worked double the hours, why shouldn't she get double the pay? I suspect she kept that job for a couple years because she finds it satisfying to help others and her employer thought she did a good job. Doing the same job on a cruise ship doesn't suddenly turn it into no job. I think her catfish of a new husband wanted the gal fired so he could line his pockets a little thicker. (She sure looks happy). As to her doing her own thing, for all we know, she sat by the pool once and wasn't quite fast enough when Madame wanted attention. There was no testimony as to how she spent her time except one, unsubstantiated comment by the employer. It's not a treat to have a friend continually asking when you will be done working. And will you be able to join them for the swim with dolphins or the dance that night, and having to always say no. You've obviously been very blessed that you would suggest someone just quit a job they've done well for a couple years. And if you don't understand there is a big difference between being continually available, and being off the clock and free to do as you please, I feel very sorry for anyone who might ever have the misfortune of working for you.
