The Huangyan Island (Scarborough) and Nansha Islands (Spratly) are completely to the west of 118 degrees east longitude. They are not the Philippines' territory.

It is not the Treat of Washington that gave the Philippines more territory. It only confirmed in a legal document the territory of the Philippines during the Spanish regime, which territory was ceded to the US, and later on to the Philippines Republic. Unfortunately, as far as I can recall, our 1987 Constitution does not 'expressly mention' the Treat of Washington, only the Treaty of Paris. However, the Constitution does mention all territory that becomes part of the Philippine Islands. Being an archipelago, and a signatory to UNCLOS, we actually gained territory. Not only are the islands of Scarborough part of Philippine territory, but the West Philippine Sea as well. Meaning, the waters in between are not only part of the EZZ( exclusive economic zone), but are also considered internal waters. In a way, the arbitral award in 2016 ' diminished the recognition of the internal waters of the Philippines by declaring that it has 'sovereign rights' over the EZZ but not expressly stating that the Philippines has sovereignty over the West Philippines Sea.

@@benzengap6804 i watched the full interview of Justice Carpio, on this same network, Justice Carpio said the complete narrative of the Philippines should be both "Treaty Of Paris" and "Treaty Of Washington" because it is the second treaty, the "Treaty Of Washington" that affirms the inclusion of contested islands in the West Philippine Sea, which specifically stated that even the Scarborough Shoal is part of the Philippines. during the interview, one of the host, i think named "Patrick" asked which one of the Treaty gave Philippines more territory, this host of one ph named patrick said was it the "Treaty Of Paris" then Ronald Llmas who is also one of the host in that interview corrected Patrick that it is rather the "Treaty Of Washington" and Justice Carpio replied yes, it's rather the "TREATY OF WASHINGTON" so it should be both. pls comment on this Justice CARPIO: The Philippines should assert and enforce the SCS Tribunal's Arbitral Award. But how? Incidentally, our government (Executive and Congress), has yet to define what is "ATIN". To expound further: 1) Since the promulgation of the Arbitral Award in 12 July 2016, did our government publish an official map indicating therein the geographical coordinates (Latitutde & Longitude) of our maritime zones (i.e., e.g. EEZ, CZ, CS)? 2) In a published official map, it should indicate and enumerate the Awards that declared the HTE (rock-territories) and the LTE. The rock-territories should have their respective 12NM territorial seas (TS). Why is this important? Bcoz the law enforcement regime inside the TS of these rocks are different from those in the EEZ. In the EEZ, one can only enforce two laws: fisheries law (if it conforms with UNCLOS, incidentally our fishery laws does not conform) and environmental law. In the TS, one can enforce all the domestic laws. However, have we enumerated our claimed rocks in an official map? Nada. Why? Bcoz the origin of our official claim of the KIG stemmed from PD 1596 s. 1978. Incidentally, the said Marcos Sr. law is just a 2-pager law and did not enumerate these "claimed islands" inside the polygon box. The law only states that this is the polygon box in the SCS and inside the box is our territory and internal waters, period. Fast forward; the advent of RA 9522 of 2009, and as sustained by the SC as constitutional in 2011, has practically removed the PD 1596 polygon box, again, without enumerating therein our claimed "islands". The SCS Tribunal has also exacerbated this inadvertence by declaring that the PHL can NOT also claim the whole KIG as a territory, like CHN's "9 dash line" (see para 573 and 574 of the Award) Now, Filipinos are made to believe by the media (using the pseudo international law and maritime security experts' jingoism) that these maritime areas belong to the PHL, without specifically explaining the big difference, technically and legally. They just speak their usual rhetoric of rousing the emotional patriotism of gullible Filipinos. Incidentally, Vietnam and Malaysia do not recognize the Award. That makes the issue more complicated. They are just watching on the sidelines while PHL and CHN are scratching each other. They are the winners in this conflict, bcoz at the end of the day, their territorial claim exists, at the same time, they solidify their economy with CHN's help. We lost. Why? Bcoz in international law, the territorial claim is superior than just a mere maritime claim based on UNCLOS. Ask any int'l law expert and they will confirm this. UNCLOS is not the venue to determine territoriality or ownership. It's the ICJ. What complicates the matter is, our co-claimants, 5 of them, claim the said SCS area as their "territory", while the PHL is claiming the said area as hers, invoking UNCLOS and the Arbitral Award, meaning, a mere "sovereign rights claim", not territorial, appearing inferior to the territorial claims of other claimant states. This so because UNCLOS, and the Award in particular, has not provided the PHL with territorial ownership of our claim, only sovereign rights to fish and extract hydrocarbon deposit in our EEZ and Continental Shelf, respectively. How can we solve this dilemma? Either we partially accept the Award or abrogate the same. Incidentally, in int'l law, there is no such thing as partial acceptance. Since the PHL was the one who initiated the Award, lock stock and barrel, we have to accept it, or abrogate the same. Meanwhile, how will our law enforcers determine our claimed territories (sovereignty) when we don't have a published map to reckon with? How will our enforcers determine the extent of our claimed maritime zones to assert our sovereign rights? Right now, they are sent to this disputed area and are ordered to defend what is ours without even intelligently knowing the location and extent of what is ours! Lawfare is comparable to warfare. We have to arm them with enough legal ammunition to fight for our rights, as we are being watched by the international community in this maritime theater of legal and territorial conflict. We cannot invoke the "rule of law" and international law, unless we ourselves have complied with them to the letter and spirit. We should have strong moral and legal grounds to assert them, otherwise, we are just mirroring what we have been accusing CHN as a bully and as violators of the law. Note: the maritime zones do not give rise to territorial claims, hence, PHL should not look at it as if we claim these as territories. In fact, the surface of the EEZ is considered the High Seas (art 58 and 87, UNCLOS), and any ships of foreign countries can navigate or even loiter (except to conduct MSR, fishing, build Artificial Islands). This is what the US is invoking in Freedom of Navigation: whether you stop sailing in the sea surface for as long as ur engine is operating, and even you can freely conduct military exercises therein, and many more FREE. Yes, we have to FIGHT what is ours to the teeth, even sacrificing our lives for the sake of our dear motherland. But first things first, where is the published map? Without this, PHL will just be exploited by external forces using our naivete. The silence of our ASEAN neighbors, specially our co-claimants, do not translate that they recognize our claims. One should understand that the area the PHL claim is a DISPUTED area, not just by the PHL vs CHN, but by five (5) other countries (Vietnam, Malaysia, Indonesia, Brunei, and Taiwan) as well; it is not just PHL vs CHN. This is now the essence of asserting that we MUST enforce the hard earned Arbitral Award of 12 July 2016, by way of: 1) Revisiting the 505 pages of the Award, studying and evaluating them correctly, and determining what we have gained or lost; 2) Legislate what is necessary to conform the Award with our domestic laws; 3) If items no. 1 & 2 are satisfied, let's publish the map of our PHL claimed jurisdiction (all territories, maritime zones, including SABAH), and submit the same to the Sec. Gen., UN and the International Hydrographic Office (IHO), for official publication, and for the world to see, whether they recognize the same or not. After all, this is a requirement under international law; 4) Meanwhile use diplomacy; 5) And many more measures which I can not discuss here for lack of time and space.

Around 2017, I had the honor of driving Justice Carpio as part of my duties for our lawyer's group. I was assigned to chauffeur him from the airport to the hotel, where he was scheduled to speak at our MCLE seminar. The drive took about an hour, during which I was deeply impressed by his vast legal knowledge. Despite his stature, he was incredibly friendly and open to my personal questions. It was a pleasure getting to know him. A man like him should be the one to be voted upon by Filipinos to the highest position of the land.

My 6th grader studied the content of Treaty of Paris and Treaty of Washington in his Phil. History class. Mas alam pa ng anak ko ang legal claims ng Pilipinas based on the said treaties than majority of pinoys.
