You're too young to have ever seen it but up until about 1990 it was VERY COMMON here in TX to see a shotgun or rifle on a rack mounted to the rear window of a pickup truck

For sure. We had those gun racks, with guns in them, in many of the pickups in the parking lot of my high school. This was in the '80s. No one thought to either steal or abuse them in any way.

My uncle had a gun rack in his truck in the 80's. We drove everywhere like that and never thought about it once. He would leave the windows down and the truck unlocked with a Winchester rifle (30-30) on the rack, and nobody ever messed with it. We lived in a small town in Texas. Now when we "went into town" we would lock it up and roll the windows up 😂.

Glock with a plus one - must be an law enforcement officer - yep, you are! Haha. Love it. That's the way to carry. I got pulled over recently by a Texas State Trooper for going 5 over (don't get me started on that - this was the only time in 23 years and I always drive that speed on Interstate or Highway) with minimal traffic on an Interstate. I exited, found a parking lot, pulled over in it, put my Driver's License and CHL ID with insurance and registration on the dash above the steering wheel, placed both hands up top in that area after rolling the window all the way down, was respectful, showed him all those things, and we were all good. He didn't ask whether I had a gun, where it was, etc. Even let me off with a warning.

Very true! My hs school had pickup trucks with rifles or shotguns in the pickup trucks. No mass shootings, no threats to blow up the school, and no one brought guns inside the classroom. Kids did fight but mainly with fists. That was all.

In the infamous 1986 Miami shootout between multiple FBI Special Agents and a couple of vicious serial bank robbers, ONE of the Special Agents had removed his sidearm from his holster, and set it on his car seat, in order to "have it ready." But when the Felony Stop suddenly ensued, the sudden deceleration of his FBI vehicle caused his sidearm to fly off of the car seat, and onto the floor, where it was super-awkward to retrieve, especially while under fire. Yikes.

Something that always comes to mind when listening to these videos? I drove OTR for about ten years, specialized transportation, oversize or over height! Had to have permits for all 48 states, what route you had to take, where you could drive and what times you could could travel. And of course 48 sets of rules and regulations, same as gun laws! BUT, the last paragraph on every permit stated: "At the opinion of the arresting officer" Unfortunately they don't list that on gun permits, but it's there!🤔 I'm glad to see you mentioned it👌 A great presentation, very informative! Good video - I recall when I first learned that handguns had to be carried in a holster (on the hip, shoulder, or pocket). Right before that, I had bought an AR-15 pistol thinking it would be a great truck gun to keep in the seat beside me. - Man was I disappointed when I learned about the holster requirement, even in the car (kind of large to strap on my hip.) - Since then, I think they changed the law requiring it to be holstered in the auto, and it just has to be out of view, which means you could have it in a backpack next to you. (Not a lawyer or suggesting folks to do this, especially since I am not positive about that change) I am doing a Form 1 to convert to an SBR so that I don't have to worry about the issue any longer. (no big restrictions about rifles, other than illegal locations) Since I never travel out of state, I don't have to worry about the drawback to an SBR, which requires you to get advance permission from the ATF to transport it across state lines. If you do travel out of state, then definitely keeping one as a pistol is easier, since the laws pertaining to the transportation of any other type of handgun applies to it. Also - good on you about carrying a round chambered. I have a good friend that is a fireman with a large city in Texas, and he will not carry one loaded (chambered). He says he has been to too many calls when someone was shot negligently. I told him I get that, but in reality, if you have ever carried a revolver (which he has) then you are carrying it with one in the chamber. (unless he has it short-stoked, so the 1st trigger pull falls on an empty cylinder, which is silly because it limits your capacity by 20% in a snubby.) - If you are okay with one gun chambered, why not with the other? - I guess to each their own though. Personally, I ALWAYS have an LCP in my pocket with 2 spare mags in the other pocket. (regardless of any other guns I have on me) In addition, I will often carry a primary gun (9mm or larger .380) on my strong side hip, with a spare mag on the other side. Lastly, I will carry a S&W .38 in a horizontal holster at the 12 o'clock position. (belt buckle moved off center to about the 2 o'clock position) This means I often have two handguns on my person (60% of the time), and sometimes 3 on me (10% of the time). - I have been asked by my close friends if I was paranoid or something - I always say "Not Anymore") 🤣

The scary thing is every police officer sees or interprets situations differently so one officer might remain calm if informed about the presence of a weapon and the next officer could freak out and start shooting out of fear without any threatening motion.

It's not overriding law. It's that some laws are vague. Some laws say stuff like "reasonably". What is reasonable to you is not reasonable to someone else. I hope other people chime in on this too. Maybe 99.99% of people will have the same interpretation. But probably not all. Read this. This is pulled straight from the code exactly as it is written: TPC 46.02 "(a-1) A person commits an offense if the person intentionally, knowingly, or recklessly carries on or about his or her person a handgun in a motor vehicle or watercraft that is owned by the person or under the person's control at any time in which: (1) the handgun is in plain view, unless the person is 21 years of age or older or is licensed to carry a handgun under Subchapter H, Chapter 411, Government Code, and the handgun is carried in a holster;" What does "in their control" mean? If your 18 year old was a passenger in his friend's car and your son was carrying a gun, is the car in your son's control? Or should I the officer interpret that as, "he is in the car with his friend, his friend is in control, but his friend gives all authority over his car over to his friend, it's not a violation of the code" and not hassle your 18 year old? What is "carried"? What is a "holster"? What is out of plain sight? -Julian

Handguns As of 2021, people who qualify under the law can carry a handgun in a public place in Texas without a license to carry (LTC). Texans can still apply for an LTC since it may carry additional benefits. See our License to Carry page for more info. Requirements Sections 46.02 and 46.04 of the Texas Penal Code describe unlawful carry and possession of a firearm. Generally, to carry a handgun in public in Texas without an LTC, a person must not: be restricted from possessing a firearm under federal law as described in 18 United States Code Section 922 have a prior felony conviction as described in Texas Penal Code Section 46.04 have a recent conviction for certain types of misdemeanors as described in Sections 46.02 and 46.04 be subject to an unexpired protective order as described in Section 46.04(c) be intoxicated, except in certain situations as described in Section 46.02(a-6) Age Restrictions Texas law sets the age requirement to carry a gun at 21 years of age. A 2022 federal court case, Firearms Policy Coalition, Inc. et. al., v. Steven McCraw, et. al., challenged the constitutionality of this restriction. The court ruled that 18-to-20-year-olds may not be prosecuted under this restriction based solely on their age. As a result of this case, DPS stated that they would no longer deny applications for LTCs solely on the basis that the applicants are 18-to-20 years old.

One thing I have a prob with is before going into the Doctor office, I will shtuff my firearm under the seat. When I return, it's often I forget and can't reach it while driving and it will slide into foot area if hard braking. I'm getting old and maybe just stay home & fert out my soup all day.

Your weapon should be on your person. Leaving a weapon in the open or open carry is a bad idea. For example if you get into a small altercation with someone that doesn’t require you to pull your weapon the other person can lie and say you did. I don’t think displaying your weapon is worth all the legal hassles.

I agree. In the cold months I carry my daily on my person in a concealed way. In the warm months I carry in a canvas over the shoulder bag. I will never let anyone know that I am carrying. It baffles me when I see some dude openly carrying in public places. They are asking for trouble and opening themselves up to a bunch of BS just so they can look cool. Firearms are tools - not jewelry.

Bad advice to carry a round in the chamber and point it at your ding a ling. So many stories of misfires when pulling from a holster. I even worked with a cop that shot his own foot at the range. Shooting off your own junk during a conflict is never good to do.

All good info. I would just add that the biggest reason to always carry your handgun in a holster is to COVER THE TRIGGER!!!! Especially for handguns that don't have an external safety. I'll also add that at 2:48 in your video you can see your holster is hitting the mag release. Kydex is easy to cut and mold. A slight clearance there would be an easy fix. No need in worrying about the mag coming "unseated" when you tried to get a good grip before pulling it!!!

It’s so easy as an officer to violate someone’s second amendment. Our departments don’t do a very good job addressing the carry diversity in Texas. Good video, sorry about some of the iDiocracy in the comment section. The way I read the law when it was passed and my interpretation of it us just like yours. I keep my SIG in the door console when I'm in the vehicle. When the vehicle is parked I put it under the seat so potential thieves don't see it. Regardless I have a defense lawyer on retainer because all cops don't know the law, & sometimes they're having a bad day(s), or just not good at the job like every profession has good, bad, & ugly.

Years ago I had a Thompson Center Contender. I bought a nylon shoulder/cross body holster for it. I still have the holster and oddly enough my AR pistol fits in it perfectly. Yes officer it is in a holster laying there on the seat.

6:30 As soon as a cop unlawfully breaks the plane of your window or opens your door with no RAS. They have violated your 4th amendment. The great thing about Texas is that all you have to do is display your license & insurance up against the window. So, keep your window up and doors locked.

I’m Ltc instructor tx license to carry holder can carry in holster in car on your person . If not in holster on you it needs to be in counsel , glove or gun case for transport but now that constutional carry is legal everyone can carry in holster on person. Gun is not secure unless it’s on you in holster.

For your pistol brace firearms look for the cordura nylon shotgun scabbards with Molle attachments on the back made for 18" barrel shotguns . They can be modified to allow for a magazine and since they have the Molle attachments they can theoretically be able to attach to a belt like a holster . Same principle like the holster made for the paratroopers in WW2 for the 30 cal carbine with folding stock that attached to their web belt .

Is there a limit to how many firearms you can carry? And can mulitple guns be loaded ready to go?

I'm also down here literally on the Gulf our backyard is boat slips. It's wicked humid. People said it would be hot but the humidity is the worst part😢 my Glock seems to be rust proof luckily. My mp shield is another story. I started carrying when I found out I was going to be a dad almost 3 years ago now. Never been lacking a day since❤

I'm not sure if I did addressed that or not in this vid. The short answer is, you are not required to. It's a personal choice. If you have a license to carry there is a requirement but there isn't a punishment for not telling them. The video is great but sad that u Said that all cops don’t know the law . Now that is the crazy part . Like you said if you run in to a cop he can take you in just because and can take your weapons and you have to prove your innocence. Crazy .

In technicalities, cases are dismissed in arraignment. For most offenses, there are clearly established elements that need to be met. Sometimes officers get those wrong and do not open up a current law book to make sure. But the judge usually catches it Unfortunately there are so many laws and it's impossible to know them all. A lot of cops focus little on gun laws. Like I have no interest in traffic law. I know some. But not nearly as much as others.

Yes there are a lot of medications out there but he researches the meds he gonna give you. If he doesn’t he can lose his license. The main thing is you can lose time and money 💰 if your arrested because a cop thinks your being unlawful ? Got to wait and see a judge . Still got to pay for your innocence. That’s my quarrel .

I understand that brother. Consider this, you go to a general family Dr. Dr says, " man, I don't know what's going on I'm referring you to a specialist". 99% of what cops deal with has nothing to do with guns. Literally. I mean they should know and I do my best to teach them. You have your general officer then your specialist. Traffic, narcotics, family violence, training, homicide and so on. I wish every cop knew everything, but I do not think that will ever be the case. Unfortunately.

Can you go over exemptions? Is a public servant IE a mailman or a city bus operator allowed to carry concealed on vehicle used for the manner as to serve the public? Or does the constitution carry only go for regular Patrons or regular civilians ?

I can. I will look into making a video on exemptions. It may take me a while though as there are several codes with exemptions. Right off the top of my head, exemptions are specific. If it states a particular exemption it will be specific as to who it applies to. It will not be general. I'll get more info on it as soon as I can.

I would think that would be up to the organization you work for. If they would allow it. I'm a security supervisor (unarmed) and both the client and my company will NOT even allow me to have my gun in my personal vehicle outside a gun restricted area. However if a visitor comes in we provide lock boxes to keep their guns in.

Excuse me but I don't need to be told when, where, and how I can carry a gun, according to the Second Amendment! I don't care what the laws are, if they're restrictive in any way to law-abiding Citizens, those restrictive laws are "unconstitutional". PERIOD! I don't care what the laws are, as I've been carrying a firearm on and off since I was 17 years old, I'm 73 and nobody's ever told me, when, where, and how I had to carry my firearm! We live in a totally false sense of security perpetrated by the "give up your rights for safety and security" propagandists and power-greedy tyrants! We are actually less safe and secure now than we have ever been in the USA! We need more people to stand up against the anti-gun owner tyranny and say, enough is enough!

You talked briefly about the magnet mount. If you have your pistol on that magnet is that considered a holster? If not, with the visibility of it being in question, would it be best to cover the pistol with a rag while it’s on the magnet? That should,by all accounts, make it concealed.

So the common definition is the safest thing to go by: holster noun hol·ster ˈhōl-stər : a leather or fabric case for carrying a firearm on the person (as on the hip or chest), on a saddle, or in a vehicle broadly : a case for carrying a usually small item on the person Merriam-Webster Dictionary

I exclusively OC (OpenCarry) everywhere I go be it in TX (where I am now for 2 more years) or the other 2 states I visit/have lived in (NM & CO). I only CC (ConcealCarry) if for some reason I HAVE to (like going in a store that doesn't allow OC, for example (like Walmarts in West TX). So when I get in my vehicle it just stays in its (OWB) holster as per usual -- don't need to place the gun anywhere -- and it's instantly available as always. Simple. For me, Simple is Better. -- BR

People don't like to watch them. They will get a few hundred views. This one is getting over 1k views an hour every 24 hours. I'm learning how to reach people. This is what has been working for me. If anyone asks, I'll give them the statute citation and explain the code.

You do not need a license to carry whether concealer not. Though to open carry like ya said you do need to have it in a holster. Though even though I do not have a license I would still advise folks to get one it just makes ya look better and ya get the training to get it. And I would advise to get a holster if ya want to open carry as for a more controlled circumstance. But tellin folks they can't open carry without a holster is a violation of the 2nd. That rule is a infringement of the 2md cuase it prevents a person from bearing arms in open carry. So I live out my freedoms and do not grant over control of my life to anyone.

When I go to the Post Office though, I remove my firearm from my secured holster on my body and hide the handgun. I don’t like to, but the penalty for carrying in a federal facility, if caught, is not pretty.

There are some people fighting this is court last I heard. Post Office isn't really a govt agency but a legal allowed monopoly. Also the argument is being made that most post offices are on rented property not govt. property so they are subject to state law the same as any other entity.

Depends on your body type and gun. i keep it appendix, but I know it's not comfortable for everyone. I adjust my shirt after I put my seatbelt on to make sure my gun is accessible. How do you normally carry?

What is said was "displaying a firearm in a manner calculated to cause alarm". Although it sounds similar to what you stated, it is not what I said. You also misunderstand what that means. TPC 42.01 Disorderly Conduct (a)(8) displays a firearm or other deadly weapon in a public place in a manner calculated to alarm; That means, in an abnormal way of carrying the firearm. A rifle hanging from your body is a normal way of carrying. So it is not included in "manner calculated to cause alarm". Carrying an AR in a low ready, high ready, or pointing it at people would be a manner calculated to cause alarm.

Not that I can think of. Just think, if it would freak you out, it might freak an officer out. Anyone can react differently to the same stimulus. I try and keep it out of view. So my gun has never been a problem when pulled over. Moving around trying to hide it after they hit you with the lights might cause them to be more cautious.

As a former LEO, as long as you let the officer know that there is a firearm in the vehicle and where it is, that will usually be enough. They may have a few follow up questions but don't take offense, they are just being cautious. 👍
