Disagree with the prosecutor not necessarily being a bad guy or lady. In this day and age ideology seems to be paramount to many attorneys rather than justice.

They shouldn't. I posted a link about "felony murder" and similar laws to PROVE that a self defender is NOT responsible for whomever gets hurt by his weapon when he is forced to defend himself. Most of it is Fear Mongering, not based off evidence at all and only following an extremely tiny minority of cases. (edit: sorry, I didn't watch this video, so I just wanted to mention that this comment is not specific to this video).

Ya it's a fallacy that you're innocent until proven guilty in this country. In regards to this, you are absolutely guilty until proven innocent. And these corrupt DAs are so immoral and just WRONG. It's so wrong what they do.

For me the takeaway of this was the fact that law abiding citizens are not necessarily law abiding when they take action.

Jupiter1000x ice, It’s all politics. If you look closely at the statistics the criminals tend to be those who historically identify as democrats, socialists, communists and the law abiding citizens tend to identify as republicans, conservatives, Christians.

@@WranglerRubicon76 The FBI states that 93% of criminals report to be democrats. (I believe I verified this myself, but can't promise, so take it for what it's worth unless you wanna verify it personally). This is a game- and mindset-changing video. Wow Massive thanks to Andrew and Mick for this smart, educational, and poignant clip. Well worth a watch for anyone carrying or considering it. I immediately went to Andrew's site and ordered up 3 copies of his book (free for one copy, $11 for 3 copies--an unreal deal considering the education to be found therein and how crucial this information is). Even the POM Industries (pepper spray) "ad" after the vid was inspirational; ordered some for a first line of defense.

Great speech. Refreshed my memory when I studied for my concealed carry exams here in South Africa. Our firearms control act has the same laws in effect. Great to explain why it’s not worth getting involved with other peoples fights. If yourself or your family is not the immediate threat then it’s definitely not worth it.

I love Branca. I found him while watching the entire Rittenhouse trial on Nick Rekieta's stream. He tells it like it is, whether it's what you want to hear or not. Rittenhouse is the most documented, clear cut case of self defense that has ever existed, whether you agree with him being there or not; yet he was on trial to spend the rest of his life in prison and his defense cost was well north of a half million dollars plus he lost a year of his life, jail time, insane stress etc. You can do everything right, and still be railroaded by the system.

Clear cut huh? Yall some hypocrites. Yes Rittenhouse should have been prosecuted and imo convicted. By this guy's on admittance he violated Innocence. Taking a AR was a direct threat "I have a gun and will shoot you!" He violated avoidance by not immediately leaving a dangerous situation, in fact he intentionally went there. And he violated Imminent, as he was in no immediate danger in Antioch, Illinois and went to Wisconsin, crossing a whole state line looking for a fight.

There needs to be laws that state a break in of your home is cause to defend yourself using deadly force. And if anyone is shooting a gun in a public place anyone has a right to defend themselves with deadly force. Prosecutors need to be reigned by law in when someone defends himself from deadly threat by someone with gun or other deadly weapon.

Very informative and eye opening. However, regardless of which side of the aisle you’re on there is one thing I disagree with Mr. Branca on. According to the 5 elements of self-defense presented George Zimmerman violated at least three: innocence, imminence, and avoidance. Therefore he should have been prosecuted. Otherwise the presentation was informative on how to protect yourself and mitigate legal jeopardy.

These are all reasons why I believe that training should be required even In constitutional carry states. Many owners of firearms are knowledge deficient but think they know everything mostly because they think macho they own a firearm, they shot a firearm but most can’t even recite the 4 basic safety rules or know basics on how you properly grip a firearm or have proper stance or trigger control or sight. alignment & sight picture.

Important info in this presentation, especially with the spate of almost unbelievable shootings, like through the door at an innocent black kid who accidently went to pick up someone but knocked on the front door at the wrong address. Or the passenger in a car of four girls who was shot dead by a home dweller firing from the porch. The crime? Using the home's driveway to turn around and go back the other direction. There is the famous Botha Jean case, where a former police oficer now resides in prison. She entered not her own but his apartment, one floor higher than hers, by some strange mistake. She saw a black man inside what she instantly thought was her own apartment, assumed the worst, then shot and killed a fine young man just sitting on his own couch eating ice cream. The stories are legion - from shots fired during road rage incidents to shots fired blind through the homeowner's own front door, shots fired over hill and dale that ended up striking someone hundreds of yards away, and even killings by police that sent them to prison. In the US most people have every right to own and even carry them. But shooting a human, or even just brandishing a firearm, is fraught with danger for the person with the gun.

Huge Thanks to Mick, For this Free Video Class , OUTSTANDING, POWERFUL ! A year ago I took the class and got the CCW, I just wanted to enjoy the hobby of target practicing , Im not willing to loose everything I have over carrying a gun or the thought of having to use it in self defense ,. Even if you're right ! You could be in jail and never get out , it would be the same as dying anyway . It's not worth it ! All these guys talking crap are willing to rot in jail , go for it ! There could be the "split second" that you might save your life ,you could still be shot in the fight ! Are you going to ware a Vest everyday you strap on that pistol Too. Your first reaction should be to get the hell out of there ..Wyatt Earp. There way to much hero complex going around in the gun community , it's like small man's disease with a gun. If where you live is that dangerous, find another place to start living ! I am pro 2A, but the lawyer is right , it's a CRIMINAL Justice System , it's not about if you're Right, it's about what you can prove.

A guy came up to my van at a stoplight, opened the door and opened fire on my son in the back seat. He fired 26 rounds into my vehicle, shot my friend in the mouth and I got grazed. I also shot him 4 times in the heart and undoubtedly saved our lives. I didn’t go out looking for a fight but I stopped it. Turns out that he was a 3 time winner for felony carjacking and kidnapping and was out on parole. My son was shot twice in the testicles and he was glad that I didn’t just let him get shot some more. It wasn’t Wyatt Earp. I was fighting for our lives in a split second after stopping at a red light. Maybe your philosophy will work out for you and maybe not but regardless I hope you don’t have to go through what I did.

They have more leeway to shoot a fleeing felon when you and I have to stop when the threat stops being a danger to us. They have to think about the general public’s interest in stopping them and that is not our job description. The question is still not “Can I shoot them?” as much as it is “Must I shoot them ?”. It’s better to be in court because you had to shoot and not because you legally could. (For example if someone broke into your house while you are inside you CAN but the argument against you is if you HAD to. Same thing with a vehicle in many states but check the laws in your area.)

Yes, but in slightly different flavors. Non-LEO can never be the initial physical aggressor, for example, doing so would be unlawful. But police are often required to be the initial physical aggressor--compelling compliance with physical arrest, for example--and in that context the use of force is lawful. If officer uses excessive force, THEN can be unlawful.

Why is it that you can choose to do something that has an element of risk to it. Like skydiving, skiing, snow boarding or surfing, mountain climbing, ect. And you have to except that risk. But if you're committing a felony which is admittedly risky behavior. Why is it the victim's responsibility? That gives the criminal an unfair liability advantage.
