Fun fact, most cops don't know the law. They are often guessing and they will arrest you first and then quickly start texting a supervisor to see what crime you can be charged with after the fact or if you even commited a crime. It's also difficult to win a false arrest lawsuit as the standard a cop needs to arrest you is comically low.

The police get there and you become uncooperative as you don't want to give up your name and address. Then you ask if your being detained. The cop gets angry and says yes I'm investigating a situation your not free to go. Demands your drivers license. Go's in his patrol car. Comes out after 10 minutes hands you a ticket. Or you could be cooperative and give up your name and address. Be polite and respectful. Cop says it's all good your just climbing some trees. Have a good day son. And on he goes..... My point is the law can be interpreted/justified in any which way. Depending on your lawyer, the judge, the cop.

Don't talk to the cop, tell him that he is not a lawyer, isn't a gaming commission regulator, and unless he is going to arrest the people who have illegally detained you, or at least take down a complaint, that he is violating his duty. And ask him directly if he is now detaining you. Make him legally responsible for it from that point on.

At my casino we have signs posted that say “we ID every cash out over $500” and we also have in our IC’s that we have the right to ID anyone at cashout and can refuse to pay you if you refuse to show ID which is no illegal. However I do know that if we ask for your ID at the table then you can deny giving it up but then in turn we can deny letting you gamble or cash out (if you have already been gambling)

(Some legal advice from a lawyer who knows nothing about these issues, but I want to make some general points). First understand the police do not know the law--they are notoriously bad at understanding complex legal issues. Second, understand that you as card counters likely do not know the law either unless you have had on point legal advice in the relevant jurisdiction. If you think you know the law then you should be able to cite the relevant statute, regulations, or case law and not speak generally. A lot of "rules" were given in this video so you should go back and cite the relevant legal authority before you assume you are correct. Not doing this makes you no better than that moronic cop. Never assume your well meaning and "knowledgeable" friends know the law either. Third, even most lawyers do not know the relevant law off the top of their heads. Legal research is complicated and quite nuanced. Finally, and most importantly you need to understand that the law varies widely from jurisdiction to jurisdiction as these questions primarily are not Federal issues. So never assume you know the law of a particular jurisdiction unless you know the law of that particular jurisdiction. Past experiences, statutes, and cases in different states are only a guide and have little legal authority. Finally, I want to point out that many questions of law are not entirely clear. Never assume that hard questions are black and white. Many times lawyers debate on how to apply the law to a complicated factual situation. In fact this is what appellate courts do. Good luck guys.

Well as someone who works in a casino I can tell you that these card counting laws are really just policy violations against the casino that could result in you being trespassed. Now when it comes to actually breaking a law card counting that is false because it’s not a direct violation of the criminal procedure law. Now with this incident detaining and holding him against his will where no crime was committed can result in a lawsuit if I was him I would seek a lawyer and say you were kidnap held against your will cause you were accused of committing a crime

@@toowiseforyou This "expert" on YT (I can't remember his name...starts with a "C") said to count 2-8. Another YTer says to count 9s and 10s. Seems easier to count cards with the value of 10 and 9. I think being observant is the most reliable source to winning. This may sound crazy but my overall BJ winnings are in the +. I can give better advice than the card counters. #1) observe the players at the table. If they make terrible decisions, don't sit down! #2) do not play at a low stakes table. $25.00 amd up is where you should play because these players are more serious about winning. But always follow #1.

@@TUMARK2 First part: They might know how much you purchased in some situations, but it's guess work at best. People are continually adding chips at table games and there's no way to keep an accurate count. Plus some players take chips home with them and return with them on another day (I do this all the time). If you play slots AND USE YOUR PLAYER'S CARD, then they do know how much you put in the machines and how much you cashed out for. Second part: W2Gs are issued based on IRS regulations, and they differ depending on the game. $1200 or more for slots (that's why they hand pay, and that's for one wager, not a combination of wagers), $1500 or more for Keno, $5000 or more from a poker tournament. I never heard of a W2G being issued for a table game. Cashing out chips will not generate a W2G. The casino will legitimately need your ID to complete a Currency Transaction Report (CTR) if you're involved in a transaction involving $10,000 or more in CASH. That's for money laundering purposes only and has nothing to do with whether you won or lost. If you buy in for $20,000 cash that will generate a report, and if you later cash out for $15,000 that will generate a second report (although if they both happened on the same day it might generate only one report). You won't get a copy of that report. Some casinos ID you for $5000 or more in case you cash out more than once in a day and the total meets the $10,000 threshold, to prevent structuring.
