one HUGE thing being glossed over, they wanted blood from the VICTIM of this event, NOT the guy they were chasing, but the innocent VICTIM of that police chase who is unconscious and badly burned all over his body... they wanted his blood hoping to find something they can use against him when he sues the crap out of the police department, this is an example of police victimizing the victims so they can find something to excuse any police mistakes...

Yeah, interesting. I was wondering why the police were pushing so hard to get a tox screen on a victim of a car chase. As a ICU RN if we get a trauma unable to speak for himself and we're unable to reach next of kin/proxy we sometimes have to draw emergent labs/tox screens for treatment. I believe the authorities do not have access to the results without a signed consent and or warrant.

@winstonthurston34237 жыл бұрын
No...she was arrested because she 1.) refused to cooperate with a lawful order (or so the police officer believed, which gives him every right to arrest her), and 2.) she resisted arrest, (which allows him/them to use "reasonable" force to take her into custody. Police officers aren't judges. They are law enforcement. They are empowered to act when they BELIEVE someone is breaking the law. Judges determine guilt or innocence. Police officers are never going to be 100% perfect executing in their duties. Citizens and guests of the United States are REQUIRED to submit to lawful orders, allow themselves to be taken into custody, and let the legal system sort out the details. When I see cases on the TV news where a police officer shot someone, it's almost always because that person resisted arrest. Guilty! Don't resist! GO PEACEFULLY! Then sue them if it was an unlawful arrest!

Winston Thurston Well he thought it was a lawful order and was wrong. Maybe she thought she was not resisting arrest. He should have checked if he needed a court order or subpoena. If that patient would have died because his drip was stopped or vent turned off because his nurse was in the back of a police car, what would his blood be worth then? HIPAA clearly states what law enforcement can and can not do without patient permission.

This has ALL the smell of them trying to blame the truck driver for causing a wreck that THEY IN FACT CAUSED! This investigator has the "I'm God" complex, other officers stood around and did nothing while he attempted to violate the truck drivers constitutional rights and violated the nurse's rights. @Ravynwulf17 жыл бұрын
+Steven Tripup. As a nurse, I can say that it definitely puts patients at risk. Nurses know their patients, not other nurses patients. Every patient is different and even simple treatments can have harmful consequences if the treatment isn't right for the patient. When we hand off our patients to other nurses, it takes anywhere from 10-15 minutes per patient to look up allergies, medications, lab tests, imaging, procedures, health history, diagnoses, plans of care, vital sign trends, etc. That's not to mention assessing our patients, which takes approximately 5-15 minutes per patient depending on your experience and acuity of the patient. If suddenly a patient were to crash, it would leave those responding to the emergency no idea what led up to the emergency, leaving them to look up and test for everything possible, and delay care long enough to potentially save a life.

So, the truck driver (patient who's blood the police wanted drawn) was innocently driving down the road, and hit by a car driven by someone running from the police. Those cops need to be stripped of their badges, let go from the PD without any severance pay, and go directly to jail. Exactly what that one cop was going to do to her. He deserves the same treatment, no worse! Because they had to be aware of this law for the last 12/14 years when HIPPA first came into effect. Every agency, hospital, Dr. Day care center, etc, etc, must abide by this law or be terminated or worse depending on the person(s) and/or agency that perpetrated this illegal act. They should be treated no differently for breaking the law, oh i should say, trying to get someone else to break the law for them by, strong arm tactics, gas lighting, abduction, oh gosh the list is long. That cop was nothing short of a being a woman beater and prob would have shown even worse procedures if the camera were not rolling. Husbands go to jail for doing what he did! I can't help but wonder if he is married or maybe i should say still married (I really don't know) but, if he is, I wonder just what he is like with her. They literally anally probed the guy, 8 different times in one night. They had to pay out 1.5 million for that case. Seriously though, if the compensation settlements was coming out of the cops pay and pensions packages instead of the local municipality's general funds their behavior would dramatically improve overnight.

The truck driver and the subject of the blood draw was the VICTIM of a high-speed police pursuit when a suspect being chased by the police crashed into him. Why did the police want a blood sample from the truck driver? So they could place the blame on the victim who had no control over get in the accident and not themselves for starting the chase. Local and State police never take responsibility for their actions. We need civilian review boards reviewing every police interaction. I'm thankful the body cam footage wasn't "lost." Nigel Thornberry it wasn't like it was a minor accident, the victim was severely burned in his car and was an innocent bystander, and then the police further hurt themselves by illegally trying to obtain a tox screen from a non compliant patient and pulled a nurse from her medical duty which consisted of treating patients on no legal grounds. That's why they should be sued.

the police are never going to realize the law is the law, they think the cops are the law, and their police department rarely punishes a cop because then it's an admission, and makes the department less money besides looking bad. They instead come up with a clever excuse, or way around it, or alibi. Instead the department fights to make themselves look like they were right and just doing their job. sounds negative, but it's mostly true. This case is different because it got caught on video, to a nurse, in a hospital, and the law was more clear. Also most nurses would have caved under the pressure, I'm glad she stuck to the law. Had it been another civilian in the middle of nowhere, no video cameras, the cops would do whatever they please, and lie to cover it up.. if they had a vested interest in whatever it was they wanted. and the old, 'but some cops are good' bs is a waste of breath as that's obvious..

It's not easy or quick to replace a nurse taken off-shift; it usually means the other nurses in that ward have to take over her patients. It's not necessarily a critical situation, but yes - does impact the quality of the patients' care.
@rethguals7 жыл бұрын
While the legal system often does have a tendency to look after its own (for better or for worse), I wouldn't be too optimistic about this officer's future in the police. Unlike those dodgy cases of officers getting off after using deadly force on suspects who probably didn't warrant it, there's no shaky legal precedent protecting them (ie, self-defense), no huge counter-protest defending the officer's actions, etc. Had the nurse complied, she would have broken the law and put her registration at risk (clearly the officer had a poor appreciation for how much accountability and regulation nurses are under). This case is making pretty huge waves in the nursing community all over the world; us being a profession that traditionally has a fairly close-knit relationship with the police. It's not an event SLCPD can defend (the nurse was shortly released without being charged), and they know that it'll take more than an apology from the police chief to fix.

Ken Smith: the law of habeas corpus states a person can't be arrested for no reason unless it's during war or treason. This lady was violated under her constitutional rights and anybody else who is arrested like this also was. She is liable to sue the officers who arrested her, the police department, possible the town and/or state, depending on what else happened

Lemme get this clear, a trucker was driving on the highway, cops was chasing a suspect on the on-coming lane, the suspect hits the truck right on and the suspects car explodes and the truck burns, the suspect die instantly and the truck driver suffered burns and is uncousoius and taken to the hospital. So the question is why the fook does the cop need a blood sample from the unconscious trucker?

Police or not , by FEDERAL LAW those police officers had kidnapped her.
@Doublezzranch7 жыл бұрын
dave days : No he didn't. In the hospital the nurse is under the hippa law of not relasing medical info. If in a police station they can take blood for info. BIG DIFFERENCE. The police broke the law blatantly on two accounts. Look it up. Not for a argument, but that is how the law is written.
@ichigomursalin7 жыл бұрын
Ja Z hippa laws r for patients, I don't really see an issue with giving blood for a test especially if ur an athlete like her, seems a bit suspicious but the cop did not have the right to pick her up like tht. Arrests could have been made to her but taking her like tht was unfair. I also don't buy that she doesn't press charges against the cop and this is the media, sometimes the whole story isn't given.

Nurses are very intelligent professionals they save the doctors from making huge mistakes if they find their patients crashing. They are knowledgeable about hospital policies and most especially documentation and consent. I don't know all the details but sounds like she showed written proof and documentation of everything that disallowed taking of blood. Nurses are well-trained in this. The detective sounded ticked off when he couldn't get his way and used brute force sounded like this is his usual modus operandi on a medical profession. I have a lot of respect for the law they try to do their job protecting us I have an equal amount of respect for medical professional they do their best to protect patients when there is no one around no family the professionals always have to act in their best interest but it must be accordance with the law if they will be held accountable even if they might not agree with it. The nurse showed utmost professionalism and represented her profession well. I don't know her but I'm so proud of her and how sincere she was in protecting her patient being his advocate most nurses are unsung dedicated silent heroes. Likely, nothing will happen to the detective since law agents are so hard to come by. It's unlikely he will get dismissed unless it was an egregious mistake resulting in gross error or death. Most likely he will get an internal review be secretly scolded in private by his superior and put on an administrative leave and probably sent on a corrective course to amend his actions and familiarize himself with the law. The nurse will either press charges of assault which will be settled in her favor or she will let it go but ensure the police force has quality assurance that they understand the laws in place. I feel for the nurse she was just doing her job. The detective felt he was doing his job but he was clearly ignoring the law. There are very rarely unprofessional nurses I know this well. This is typical behavior of nurses standing their ground going above and beyond to protect their patients. Their jobs are not easy this is an extreme example.

Alicia Irene they are so scary to be honest. Like he's here more focused on trying to falsely accuse both the victim of a traumatic accident and an RN who is doing her job to align with the policies and HIPPA laws than he is actually trying to find a real person in an unlawful situations. Like how many drug deals and assaults or robberies could have been going at the time? Or maybe further looking into an unresolved case that would actually matter rather than frightening all these people. Police make me sick I hate interacting with them and I've never broken the law or done anything unlawful, they almost just are trained to scan people in inhumane ways and falsely accuse or over react in hopes to charge someone and collect the fee or to assert dominance.

The nurse was following the Law. Here we have an officer that is SUPPOSED To know the law. I am a retired Police officer I was on the force for 32 years. What I seen is disgusting behavior shown by these officers. Not one officer but a few were on hand as this happened and NOT ONE Knows the Law?? And if they did Not one stepped forward to stop this?. To top it off they put her in a squad Car for 20 minutes and what were they doing? I feel that not just one officer but all that were on hand should be suspended without pay. And before they are allowed to go back into public service they should have to brush up on the Laws that they are supposed to enforce. And be tested before they can put that shield back on. Its crap like this that makes officers that are doing a good job become targets of violence. And people wonder why officers are targets, It crap like this that is turning the tide on Law enforcement.

I don't understand how people can continue to defend these polices. This police is not protect the law. He was violating the law -- in multiple occasions. The person on phone even told him (1:10) that he cannot threaten the nurse. Next thing he did? He arrested her. He didn't arrest her because she broke the law. If in the doubt, this officers could have called his supervisor to verify the situation. But no. He arrested her because he didn't want a "no" as an answer.

The arresting officer was fired on October 10, and his supervisor was demoted two ranks from Lieutenant to Officer. On October 31, 2017, Wubbels and her attorney announced that Salt Lake City and the University of Utah had agreed to settle the incident for $500,000.
