@@DarkStar9650 but, wasn’t there an actual robbery that happened? I wouldn’t think the employee would’ve been the one to blame, I’d imagine that the robbery was caught on camera, and the man looked similar to the person in this video... I know there are a lot of race related arrests and shit like that in America, but this particular case seems like it could be a genuine misunderstanding...

@@nejx8711 And how is this man should take it when the cops violated his civil rights? FAUX PAS...MULLIGEN..NOTHING TO SEE HERE??? That's why I made reference to Title 42, 1983, that's a torte claim for a CIVIL RIGHTS violation! You going to ARREST someone and DEPRIVE him or her of their FREEDOM, you should have more than SUFFICIENT EVIDENCE to arrest them, these cops didn't!

Agreed. Whenever I am dispatched to a shoplifting call I go over all of the information. This includes video surveillance, pictures, eye witnesses, etc. I make sure I have the right person before I arrest them, assuming that there is enough evidence to make an arrest. If there’s not enough evidence then I do not arrest anyone. If the suspect cannot be found, I do not have anyone to arrest. I get many calls where the store failed to have proper video surveillance in place and/or they failed to make a note of the suspects description. I “think” they stole something is meaningless. Whomever handled this case did so improperly.

a tip for the guy falsely accused: you need to make sure those stupid cops expunged your arrest report. they will tell you that verbally, but do not pull that stuff out of there system and it will come back to haunt you. This happened to me and my record was not taken out of the system; I had a difficult time gaining employment.

I had the same name as a guy that got himself in serious trouble and went to prison for a few years. Even though he was ten years younger than me every time I got stopped for a traffic violation they would try to arrest me thinking I was the other guy. There is no way to make them stop until you file a lawsuit against them however then they will retaliate every time they see you.

Happened to my brother too...he was shopping and ate something while still inside the store and paid for it as he was checking out...security only saw the eating part but didn't confront him right there so he could clear it up with the cashier...so cops showed up(or called and asked him to come in, small town)...just a misunderstanding but technically he was arrested. Years later after this was long forgotten he was applying for a federal job which required a security clearance and almost got a felony for lying about whether he had ever been arrested.

@@dickmartn +... Cop Logic: If there is "Smoke, then there must be fire...somewhere. So, if we keep the records on file, forever! sooner or later he wil do something we can arrest him for - then use those records to add proof of prior arrests - to extend and enhance the charges. That is the basis for "Stop 'N Firsk", interventions. Seldom will you find any black citizen, in the USA, who hasn't got a police record; for something, somewhere at some time. If not for an actual crime - then, there is a possible record of some friend, relative, former school mate, former fellow employee - they can link him to. Ever notice? ... when the police release information on a "Black" suspect - it usually contains some information?", about a prior arrest no matter how trivial: in kindergarten, elementary school, or possible "gang-affiliation" based ??? - living in the neighborhood, city, county - no matter how long ago or tenuous the contact. So, you are well advised to avoid contact with police - even if it something like being a Jr. police, ride-along cadet or 'Pop' Warner- baseball summer camp participant... Joe "black' Guy took candy out of the local corner grocery store at age 4 years old, added and abetted by his parent - who claimed they paid for it. So, its obvious - he was an habitual criminal long before he was arrested, for shop-lifting, 35 years latter! So, police were justified - when shooting, the supposed "un-armed" man in his own yard at 9 am. Police were "In fear for their lives" - they could not know what he was capable. It was split second decision! Yes, he did claim to be the home owner, who called police - but you just can't take his word for it...ina high crime area. PSPD (Palms Springs Police Dept) spokes person explanation.

Here is a tip of advice. Next time you are in there drop a little bit of fish oil on your shoe bottoms then walk on the carpet in a couple spots inside that store. The fish oil will eventually spoil and the place will start to smell horrible. The result will be expensive carpet removal and identifying the source is nearly impossible as no one checks the bottom of their shoes before going in a store.

An integral part of this story is that the cops needed to arrest "someone" for the store theft. Cops are rewarded in their departments and on their evaluations for the "number of arrests" they make even if the arrests are of wrong person or the supposed crime is completely fraudulent and fabricated. It's the "number of arrests" that is important to the cop's evaluation, not the truth or legitimacy surrounding the arrest.
