Can you please offer CFR or other regulatory guidance that supports the below statement made in the video? “VA’s duty to assist means it must consider all diagnostic codes that could apply and use the codes that result in the most benefits. VA must also must identify any “inferred” claims that the evidence supports but you left out. In other words, if the VA can see from your evidence that you would be able to win a claim that you did not make, they must identify and grant an award for it anyway”.

What do you mean by the adverb "substantially?" Doesn't duty to assist extend logically to VA representating the veteran against the real "adversary" the DOD Secretary at the time of the service connected event? With a burden of proof for such things "presumption of soundness" and denial of service connection (all those sick call doctors could decide at a sick call visit yes/no to service connection and should be kept available as "substantial" witness for the veteran-claimant.)

I had a CandP exam for hearing loss and tonightis and now va sent me a letter that they are doing an ACE exam, what's up with that?I had hearing loss when I got out of the army in 1979.

I just received a duty to assist error m the VA and I called you guys and you denied handling my case, and the VA just made a decision on said case nchanged the effective date on it. Where can I access the VA's rules, laws, policy , and codes to become more verse on yhis subject?

They changed the effective date from Nov 30, 2010 to June of 2023 can they do that??????

When you say they should grant a claim that I did not claim but evidence supports. Would that mean if I claim headaches as a primary instead is secondary, should they automatically grant headaches as a secondary if applicable? (If it’s denied as a primary)

I have a problem with the VA. I'm diagnosed with Menieres Disease and put a claim in. It's been over 6 years. My case has been in the decision phase since January 2024. My problem is my VA doctor. I saw her last October and she asked me how many attacks I had during a specific time period. I told her let me look in my phone because I document each attack on my calendar. Her reply was so you don't know . A couple of years ago I told her I have 6-10 attacks per month. She put in my record that I said 6-10 per day. She's playing games like the rest of the VA doctors. What can I do.
