I just wanted to say thank you and all the other Law Firms, and groups for all this free information you all share. It's truly invaluable to those like me who will listen and use it to get an increase in our disability claim. I just went from 20% for a few years, to 80% a month ago by listening to all the information you and various groups put out on KZbin. I hope and pray I don't have to retain one of these legal firms to get my back money they seem not to recognize they owe me. I have a C&P Exam Monday Dec. 9th 2019 for my Unemployability Claim. Please know your work and video's are not in vain. Thank you all again.

I went to a Board of veterans appeal, the DAV did nothing, I did all the talking, the judge had nothing of all the evidence I had sent to the evidence center, there's a lack of communication between the department, I know veterans almost deaf, and only getting 30 pct. My own brother who fought in Vietnam with the 173rd was denied he has zero pct hearing loss, he carried the M60 machine gun. Sometimes I wonder who are the dummies that grade our papers. And I also know national guards who never been but to boot camp, getting 50 pct hearing loss. Isxa messed up system

Well read this..I had a hearing after waiting 8 long years, service connected eye loss (totally blind in right eye) and TBI and my DAV rep showed up with nothing in hand for my evidence I gave to him earlier on in my case, and did not have anything to say in my case to the judge, he just sat there, i was devastated, I did all the talking and fighting for myself only to be denied my benefits because in the judge's decision later received in the mail he mentioned I had "No visibility" ( as in physical evidence, papers, doctor reports, former law cases etc.) to prove my case. Then covid hit and still waiting to hear from the VA on an appeal..i have no attorney...I pray 🙏 that other vets get better help than what I did not get with D.A.V. Also the VA puts off your case for years, thinking you'll probably die before they give you any benefits, and a lot do die..smh The United States will give countries who even hate us BILLIONS $$$$ of aid all over the world but deny us veterans any benefits at all, or only chicken feed for some that do. Sorry I ever served.
@reggierendon28472 жыл бұрын
@@dazzlerpassage9182 True I have fought for all my benefits on my own, every time the DAV showed up if I ever got anything it was nickels and dimes. I did my own research, took cases they denied to other medical doctors etc etc.

I am 20% compensated for Retro Patella Pain Syndrome but I have been compensating with the other leg that has changed my walking gate and now I am diagnosed by a Pain Management Specialist with herniated disc at the L3/4 and the L5/S1 area with bone spurs and Lumbar Spinal Stenosis, unfortunately the VA is claiming that my back issues are not service connected. I throughly believe that I would not have these back issues if it were not for the compensation of the other leg. I am currently talking to a Law Office for appealing this decision. Also I was diagnosed with Left shoulder Tendinitis and had to have 3 level Cervical fusion in 2018 that one again they say is not service connected

I don't know how it would be classified, inner ear or whatever, but for my vertigo, falling, ear fullness, nausea, etc. my VA doctors diagnosed that I had Ménières Syndrome. For that I am taking "HCTZ" which helps lessen the "attacks." Anyway, the VBA rated Ménières Syndrome 100% P & T. Separately, I had the ubiquitous service-connected 10% tinnitus rating, and service connected hearing loss, rated at "0" percent.

I have been rated 90% since I retired from the Navy in 2007. Since then I acquired Meniere's, which forced me to retire early from my civilian career in Jan 2022. So did your Meniere's Syndrome result in a 100% disability rating permanently?

I thank you for no one ever discussed these issues before. Now they want me to go through pact act. For i am lucky i am still here! I was taken to hospital in cambodia, when i was soaked with agent blue, jp4, diesel. But did not suffer from any cancers. 70% disability rating awarded aprox. 5 yrs ago. Short version - went to a county resources facility to use computer to update my resume. Was asked if I was a veteran, said yes then met with a VA rep who explained all svcs avail to me as part of orientation to facility. In 1990 got a hernia fixed after boot camp. It reinjured over the yrs & got me rejected at a job interview physical. This I had forgotten till I was asked if ever rejected for a job because of the hernia. (carpenter for 23 yrs). VA did another repair surgery which failed. They offered another, I declined. 1 1/2 yrs later I got an award letter. Free healthcare for life including any prescriptions plus a check every month which Im grateful to have. Ive found the VA to be extremely professional & always very respectful. Have had a few unrelated procedures done since & encountered competent professional medical staff (at all levels) at S.F. VA medical center every time.

I am an 81 year old Vietnam Vet. I was a radio operator. Everyone I worked with had hearing issues. Sixty years of tinnitus is a day and night reminder of the ultimate in stupidity. As an eighteen year old kid I was going into the service. My uncles and my father had all gone in the service. I was going in the service. My life long dilemma with tinnitus is certainly not unique. What disappoints me more than anything is the twenty, thirty and forty year old's that I worked with all knew we would leave the service with tinnitus. I'm sure most of them already had tinnitus. I would walk into our work station in Saigon and I could hear code people were copying twenty feet away. You can't put a sound device on your ears and turn up the volume and let it scream in your ears for eight hours and not damage your earing. My opinion. Do it for three years and you spend the rest of your life with tinnitus. Not one person mentioned hearing issues. Something is wrong here. There is a culprit. How is that culprit held responsible? You tell me!

I enlisted in the Air Force in 1964 and trained as a an AGE Technician. By the way, the flight line ear protection back then must’ve been patented in 1920, 98% not effective( aged, hardened insulators. My biggest physical problem was that I caught the Polio virus at age 5. But I made a 95% recovery. I was left walking with my knees bent backwards when I walked. And because the polio chooses at random which muscles to paralyze makes things like in my case, my legs would completely fatigue while trying to run in basic training to a point of colapse.

So i had my left knee replace 06/2022, and when i go my new rating, they dropped the % on the right knee to keep me under 100%! There was no procedure done on the right knee. They also denied my back, and hip conditions that should of been connected as secondary to the knee problems from the major limp i had and messed all that up. Plus denied my PTSD when i had a traumatic fall in boot camp, which ended my career and life- long dream. i am now at 90%, but i also have paperwork in from a increase, and unemployability, plus SSi claim. A little time past ,but my condition started to fliar up severely. I had problems trying to hold down jobs. I also had severe stomach problems along with server depression. I filed again and was awarded nonservice connect because i had to stop work. I recueive benefits while in Martinsburg VA hospital for homelessness and back problems in around 2005 -6 . While there I had to recieve shots in my back. Later when back here in Baltimore some years later i was diagnosed with syatic lower left back pain. Since then I've been experiencing serious problems all through out my left hip,leg,nee and anchor. Three are times I've not been able get out of bed. Depression,tress,and anxiety had set in which caused me to go Social Security that I am steal presently on. I work at to VA here in Baltimore now where I am steal being treated for all the above. I was discharged back in 1973 April and steal today I'm walking with a lamp which I get worse as I walk. For years I treated myself with alcohol and drugs just to keep working from the time I got out of the military. But received treatment at theVA many times,and now been totally clean and sober since December 1992. Still taking lots of meds and working through VA. But need help filling for disability again. All records are in the VA system.

If the VA gave a rating for hearing loss, then tell you to get a particular test that is not know to audiologist in the VA system or civilian sector. Then the VA has you get another C&P for hearing and determine that your hearing improved and reduces your rating. During the C&P the audiologist gives you the list of words to repeat because you can't hear the words said to you. How can a person's hearing get better?

Every person I know (ex-Navy) gets some kind of disability and we are talking hundreds of people. Many BRAG about how much they get, some over $2,000 monthly and nothing is actually wrong. Neck, back or knee as I hear it (something easy to get away with) or sleep apnea, which alone pays 80% WTF, how did the Navy cause that ????? I have it and was never in the Navy, along with many others. I am PRO military and very much want any veteran who was injured while serving to get their just disability. It's the ones bragging about getting paid for a disability and playing sports, weight lifting and other activities they would not be able to do if actually disabled. The system is being used as a welfare program by many.

That’s why a lot of veterans nowadays are being denied of their disabilities because of veterans that get away with it, and now the va realize that and they making adjustments and making sure that veterans has truly a legitimate illness to get compensation. Sleep apnea, tinnitus, ptsd, ed, depression are some of the disabilities that usually hard to figure out if certain veterans have it or just faking. Some get away with it and they’re laughing all the way to the banks.

I'm a 90% SC Disabled Veteran & I just went through my 2nd C&P Exam for tinnitus, and once again requesting bilateral hearing lost from years ago, along the way I refiled and asked for a increase for my 10% "Tinnitus" & any kind of + rating for my Zero % "Bilateral Hearing Lost" among other disabilities. My Tinnitus is constant high pitch ringing in both ears (my left ear ringing is worse, and the right side is just a tad behind the pitch of the left side) regardless, its like a whistle being blown continuously "high pitch" in both ears at the same time, it never stops, its 24 hours a day, 7 days a week. I agree with Mr Ronald Mead regarding the sound proof room hearing test set up, its a 6 X 6 ft "sound proof hard wired room". I mean no offense to the fine Dr's who perform this test on us, but the test is rigged, it no way indicates the Veterans "hearing lost" or does it show how our hearing lost effects our memory, temperament, and other health related issues such as balance. I submit I am sometimes angry as I cannot have a normal conversation with anyone unless its one on one and within 4 to 6 ft of conversation range. And there can definitely "cannot be" any other background noise. So my question is this, just "how is it, the VA" can justify 10% lost for tinnitus "but" nothing for Bilateral Hearing Lost? I see you went to lot of trouble to make this video and I salute you and thank you for putting this video together. You are right, we Veterans cannot ever give up, keep calling and submitting claims and working those appeals. I cannot believe all the years of testing and hardships I have personally seen and heard of, regarding all the suffering of what our people go through. However I do believe sometimes it does get better no matter how long we have to wait or the hardships we must endure. God Bless our Military, our family's, our Veterans and all of those at the VAMC and its support agencies.

I was cut off in my comments. I have 10% disability rating for hearing loss and 10% for Tinnitus but only for the last 2 years. These disability occurred between 1964 to 1967 when I was in the Navy on a diesel powered Destroyer Escort. Now the VA only wants to compensate for the last 2 years , not from 1964 to 1967 ?

What if you have a letter from your VA medical provider stating you’re disability is service connect , would this be helpful and how much weight would this give the decision makers
@remoevans78472 жыл бұрын
If you have a letter from a VA provider stating your issue is service connected, you should frame and insure that document.

I have been denied two times for my lower back and have been fighting for a long time. I finally had to hire a lawyer. This is bull crap due to the fact the VA hospital took an x-ray a week after I returned from annual traning with the reserves. It showed an issue and I was given PT. But the VA still says it’s not enough. The VA radiologist put down that I had narrowing of S1-L5 with a possible abnormality or variant. Many years later I finally had a private doctor do a MRI and it showed bulging disks. I filed again for my back and the VA denied me again saying it’s not service connected. I’m upset. I had 3 lay statements but that still didn’t work.

I've been fighting virtually the same thing for almost 50 years now well since 1974 I have had pain in my lower back and my neck between my shoulder blades all that time yeah everytime I file a claim it's automatically denied. However I did find out many years later the VA rated me for PTSD and put me in a special category where they rate nothing else oh, since that time my tinnitus my hearing loss my lower back injury and everything else has been denied

My BVA-remanded appeal was mishandled by the VARO. They were directed to roll my new MH SC - which they failed to adjudicate at all - & my open TDIU appeal together, or return to BVA if denied. They only readjudicated the SC issues (70%) and apparently ignored the TDIU appeal. I'm still awaiting the packet, but does it seem likely they're working on it & I should just be patient, or is another appeal going to be needed? Probably worth noting that the TDIU claim alleges 40-year CUE, which the C&P doc acknowledged. I'm represented by DAV.

My husband served in Vietnam from 1966-68. VA paid him for prostate cancer 100% rate for about 3 years and downrated to 20% due to improvement and had 10% for hearing loss. He died in Jan 2020 but as his serving wife, I filed for his colon cancer, bladder cancer, and denied before the PACT act. I later went back in 2022 to file on colon cancer and bladder cancer. Do you think I will get the 5 months of his existence with the illness paid? I later find out that HBP is covered. He was always treated by the VA for HBP. Can I file under the pact act for HBP?

I was denied hearing loss because the entry physical showed some hearing loss in one ear and disability for hearing loss must be for both ears. So all the Jet engine noise damage to both ears isn't allowed due entry hearing test when I joined in 1973. So if you only have hearing loss in one ear. You're out of luck!, They will give you hearing aids. Just not compensation.

I am 40% service connected disabled vet from injuries suffered during the Vietnam Conflict...several years ago my lower back severely spasmed which is part of my disability...I fell and fractured my back from t-8 to t-11...I also ruptured an existing umbilical hernia which required emergency surgery along with months if rehab for my fractured back....since this happened I have not been able to take care of myself for my daily care like cooking, grocery shopping etc...Because of this I had to move in with my sister and brother to take care of me...can I ask the va to help me..

I am unable to help myself, I am overwhelmed! I have tried to file claims on my own with a little help from lackluster VSO from the american legion . At best I am at the low end of average intelligence. I have had multiple head injuries and I am 64 years old. I am experiencing cognitive decline and PTSD!!! I do not know what to do. VA insider (may) be some help at a cost. Hill and Ponton seems to be a safer bet. I really need this VA increase as I can not work for much longer as my mental and physical health has gone. I can not take this much longer! I need help and guidance ASAP! PLEASE.

Hear test is kind of a riged test. You are put in a sound proof booth and have to listen to low tones. It is not a real test as I do not listen to people talking in a sound proof booth. A lot of time at home I can not hear the wife talking to me across the room. All I hear is the ringing in my ear but yet the VA says I have some loss but not enough. I worked on aircraft and was exposide to jet fuel which causes a person to get words mixed up. I hear the wife says she wants to do something with the hat and when I ask her she says she was talking about the cat. The VA does not reconized this either. It is hard to get anything for hearing loss.

True, I'm a 90% SC disabled Veteran & I just went through my 2nd C&P Exam of 8 to 9 years where I asked for a increase for my 10% "Tinnitus" & any kind of rating for my Zero % "Bilateral Hearing Lost". My Tinnitus is constant high pitch ringing in both ears (my left ear ringing is worse, and the right side is just a tad behind the pitch of the left side) regardless, its like a whistle being blown continuously "high pitch" in both my ears at the same time, it never stops, its 24 hours a day, 7 days a week. I agree with Mr Ronald Mead regarding the sound proof room hearing test set up, its a 6 X 6 ft "sound proof hard wired room". I mean no offense to the fine Dr's who perform this test on us, but the test is rigged, it no way indicates the Veterans hearing "capacity lost" or how our hearing lost effects our memory, temperament and or balance. I submit I am sometimes angry as I cannot have a normal conversation with anyone unless its one on one and within 4 to 6 ft of conversation range. And there can definitely "cannot be" any other background noise. So my question is this, just "how is it the VA" can justify 10% lost for tinnitus "but" nothing for Bilateral Hearing Lost? I see you went to lot of trouble to make this video and I salute you and thank you for putting this video together. You are right, we Veterans cannot ever give up, keep calling and submitting claims and working those appeals. I cannot believe all the years of testing and hardships I have personally seen and heard of, regarding all the suffering of what our people go through. However I do believe sometimes it does get better no matter how long we have to wait or the hardships we must endure. God Bless our Military, our family's, our Veterans and all of those at the VAMC and its support agencies.

I had to go to the hospital for a problem with alcohol after I was discharged from the Army. Can this be rated.
@CCK_Law2 жыл бұрын
Hi Mr. Harring, Veterans cannot be directly service-connected for alcoholism; however, they can be service-connected on a secondary basis for conditions that arise from alcoholism, if the alcoholism is due to a service-connected condition. There is more about this on our blog here: cck-law.com/blog/va-disability-and-alcoholism/

I was denied for thyroid cancer. I was taking thyroid pills before going into the service,.the VA judge told me the intake doctor should have done testing on the issue to verify the diagnosis. I've had 2 surgeries.1st surgery found the papillary carcinoma. The second surgery took out the other half and VA doctor said I no longer have that type of cancer. The denial of my claim reason is that I cancer before I went into the service. I don't udererstand that. I told the military doctor about took my telling them about the thyroid medicine I was taking. The military doctor found the nodule on my thyroid. Years later the thyroid cancer was found. I didn't have the money to go to outside doctor to help me fight it. I was wondering if this is something your lawyers could look at this. I'm also a McClellan 1973 bootcamp veteran.
@TS-iv9ml2 жыл бұрын
Thyroid cancer has nothing to do with taking thyroid pills. Plenty of ppl are hypothyroid or have Hashimoto's disease and require thyroid hormone medication. That does not automatically create thyroid cancer! You need to a diff evaluator cuz that's BS they told you. I'm sorry to hear this!
