Technically, if you murder people with an illegal weapon, it’s a grey area, and often they’ll still go under a case for murder (in Niko’s case triple murder), and because of his ties to the Yardies (Jacob and Badman’s gang) and gifts from Jacob, he might even be put down for a RICO. And a well known case of a RICO and Murder is Kay Flock, who faced the death sentence, but made it out due to his good lawyers. Since Niko doesn’t have enough money for good lawyers, he may face the death sentence, and even in the best case scenario, he’ll still have to battle 3 murder cases, and even if he beats them, he’ll have the possession of the firearm.

I don't think crimes committed during Francis's missions would count as Francis is a LCPD deputy commissioner so would be considered under LCPD orders. 14:00 Kim was carrying Superdollars into the United States so I would expect Niko will get a conspiracy to defraud the United States charge as well. 21:30 would also be considered under IAA orders as during the opening mission cutscene Jon Gravelii said that they are doing a favor for the U.L Liberty Paper Contact.

I have to disagree with the Self Defense charge in that first mission with Little Jacob. Little Jacob had brought Niko into a criminal dealing as backup, even handing him that firearm of which is criminally possessed. As was suspected by Little Jacob, the deal went south. Is it really self defense if you put yourself in such a position knowing full well you were intent on breaking the law?

I'm not familiar with NYC law, I studied AZ law, but since the criminals fired first, Niko was well within his rights to defend Little Jacob and himself with that weapon. Yes, the circumstances were less than ideal, but Niko was not the instigator so none of those deaths are murders.
