Kindly may provide the name of the last Supreme Court Judgement where you have said SC laid down :- Affidavit filed under O18,R4 CPC is not evidence with in Sec 3 of IEA unless deponent is subjected to cross examination.

You have stated that exam in chief in section 4 of order 18 is not evidence if not cross examined per section 3 of ind evidence act. Section 3 of evidence act doesn't say so. Clarify.
