They have little to 0 accountability, I watched a half hour video on cops responding to people asking for a report form to lodge a complaint against an officer(which is supposed to be provided and allowed to be done anonymously) in the majority of the scenario's it was treated with interrogation, accusations, bullying, threatening, and all the way up to literal violence inside a police station. only a minority provided a complaint form which varied heavily by State, and even with all that unlikely the cops would experience any real consequences. The cops are a perfect example of the infamous prison study, they are like the guards uncontrolled power, without consequences.

“Going to call CPS and have your kids taken.” THAT threat. Actionable. Since the officers were already aware of the illegality of the reason for the stop, the threat to take children, to coerce compliance, is direct retaliation, and was meant to chill freedom of speech. No reasonable person would feel safe to speak freely, at that point. This really needs to be followed up properly, at the federal level.

You must have some direct knowledge of him in the community, to say that. My first thought also was how ridiculous and absurd it is to establish speed limits on a road to make people slow down and drive safer and then to argue that a guy holding up any sign with whatever message on it would disrupt traffic by making people slow down to read his sign. What needs to happen is after a cop has been found at fault and the city has to pay, the cop gets a 10% cut in pay until fully reimbursed. If it's a bad enough incident, the cop is fired and pension is pulled. This is one of the few ways that work and would hopefully deter some of these tyrants.

Southern Draw Law channel (He's an attorney) explained the reason for these low payouts. Basically, if you don't take the settlement and want to take it to a trial, the monetary award is then in the hands of the jurors and could literally be $1.00. So, people take the settlement so they at least get something.

true story they did that to my brother. took his daughter from him and put him in jail they sent his child to protective services and never gave her back. all because of a bogus charge of resisting arrest when he wasn't resisting nor under arrest. the prosecutor said the next morning the charges were dismissed because you can't resist arrest if you are not under arrest. he was notified a few years later after fighting to get his kid back that he will never get her back because he didn't prove that she would be better off with him than with the state. i know it is probably hard to believe this but it is 100% true and i'm a fairly well educated and literate person.

I held a sign that said COPS WITH RADAR on a busy road where drivers commonly speed. I was given a hero's welcome. Drivers were yelling Thank You!, honking their horns, etc. One of the motorcycle cops eventually came up to me asking why I was doing this. I told him that in California it's extortion to charge drivers $600 for a speeding ticket. He was very respectful and both of them left.

That is not the logical conclusion. His sign stops speeding only very locally and temporarily, while the "chance to get caught" is a more effective deterrent. If every speed trap was marked with a sign, do you think there would be more or less speeding in areas without marked speed trap? I'm not on the guys side when it comes to warning people of speed traps. Speeding is a deadly offense. But the cops are utter.. well, they deserved the gesture.

@@Thiefnuker Revealing the location of police officers is not a crime. Period. And I guarantee you that 29 days and 16 hours per month, traffic in that area always travels at a speed above the limit. They just choose to use that single 8 hour period for revenue creation. I would be willing to bet that each of these officers joins right in and runs with the speed of traffic when in their car. If I get on the interstate while leaving work and do the speed limit, I would be getting passed by 99% of the other drivers. Heck, I get passed by most folks when I am doing 10 over--including police officers.

I'd also point out that they do have an insetive to get rid of him. They have a ticket qouata that get them bonuses. Since the prison system is a for profit private buisness. So yeah. The police are paid to ticket people in entirely unnecessary circumstances to meet quotas. Which may also lead to them finding whatever they need to arrest that person so the prison stays full. American policing has long since stopped being about public safety and keeping the peace. It's all about corporate goons abusing their power to make fat cats more money. The whole system is fubar and should be abolished and rebuilt from the ground up. Starting with focusing on rehabilitation over punishment for non violent crimes.

Yep. Here they hide the cameras in garbage cans, and all sorts of other stuff. But it’s not a cash grab, especially at the bottom of a steep hill where most people pick up speed so they can make it to the top. Or right behind a speed change where they can nail you for doing 35 at the sign when you came around the corner at 50. Just two regular traps I deal with. They love that speed zone. If you don’t know the area there’s no way to hit 30 by the sign without slamming the brakes. You come around the corner and bang! So yeah a lot of people get nailed for 5 over.

I don't think you know what tyranny actually means. The fact that Johnny received a 50k settlement is proof enough that law enforcement is not tyrannical. The fact that body cameras exist is proof. The existence of the IA department is proof. The majority of the United States Constitution is proof that we do not live in tyranny. so if a traffic sign...like...a speed limit sign...is signage that is posted on the side of the road that notifies drivers of the maximum speed one can be going on a road/section of a road....is considered informative and not impeding traffic....how does a man holding up a sign that says "radar ahead" on the side of the road all of a sudden that is impeding traffic. Or how about any other traffic sign that informs drivers of potential issues like "watch for falling rock" or "bump ahead" or the warning signs of speed reduction? Something tells me the troopers were mad that someone was preventing them from collecting traffic ticket money. And they took that very personal as well.

I went to college for Criminal Justice, and we learned about Cohen v. California where a guy got in trouble for wearing a jacket in a courthouse that said, "F*** The Draft". Make police get privates liability insurance, just like doctors. If they keep costing the insurance company money, their premiums will become unaffordable. In this way, they can't just hop to another police department to clear their record. Personally not a big fan of the insurance industry... but I see some benefits in this situation

In this case, qualified immunity should have been lost when it became apparent that the troopers knew they were issuing a bogus citation and they should have been further cited for vexatious litigation. Frankly, $50,000 wasn't enough in my opinion. The trooper that stole the sign should have had charges for theft and destruction of property while the trooper that smirked afterward saying he didn't take anything should have faced punishment for failing to enforce the law.

I genuinely have no idea how qualified immunity is at all in the state it’s in. The point of it is that “If there’s a situation that hasn’t been brought up before, And the police was found to be technically wrong in doing what they did, Then they cannot be held accountable”, And that makes perfect sense. That SHOULD exist - They can’t know if what they’re doing is wrong, If it’s never been ruled upon before. ...But there have been cases of middle fingers. There have been cases of people holding signs on the road. It’s just bizarre that it’s being abused in such a way. You can’t invoke “Qualified Immunity” If you don’t qualify for the immunity!

I'm originally from Delaware and these pigs are the worst I've been pulled over a couple times because they lied and said I was speeding when I always use my cruise control, the last time they gave me a ticket my cruise control was set to 59 on a 4 lane highway and the pig lied and said I was doing 65 in a 55 mph which is still bs but this stretch of highway has always been known for cops pulling people over left and right and I've been an auto tech for over 30 years and had a friend that's a master tech follow me to make sure my cruise control is working properly and he went to court with me and the cop didn't show up and the judge didn't care what evidence I had and still gave me the ticket. FTP. Because of this I lost all confidence in police.

When I used to protest DUI checkpoints the police would pull the “people are telling me you’re running around in traffic” line on me all the time. There needs to be a federal law put into place that any lawsuits that bear a settlement at the cost of taxpayers makes those in public office or other government employees responsible for causing such a lawsuit to pay it back through reductions in their paycheck until such an amount is paid. If they get a new job not in the private sector, have their wages garnished until it is paid back. File for bankruptcy? Too bad, its like student loan debt, your paying it anyways. Bet these tyrants would think twice next time, less they get a monthly reminder taken from their pay checks.

Terrible idea. I know you want accountability but there's no quick easy fix for that. Qualified immunity exists for a reason and holding people personally responsible for actions performed while on the job is a bit of a stretch. Maybe you could entertain the idea of malpractice insurance for all officers, but then you run into the issue of whether or not they are going to even bother to stop and help you if they know something going wrong means their ass.

No. If I screw up at work, I get fired and sued, it should not be any different with the police, if anything they should be held to a higher standard, not no standard at all.

Officers who failed to speak up against the abusive officers were abetting a crime and need to be held accountable The officers who chased down the man for a protected hand gesture need to be held accountable. Threats of involving the man children in family services were intimidating actions. Officers making threats should be held accountable

Internal affairs found them to be “acting in good faith” yet the evidence ( video at the end) proved they were not. Anyone associated with that supposed system of accountability should be ashamed of themselves. Reform needed from the lawmakers on that one.

As someone who has a relation to this guy, through my grandmother or something, I am very proud to have a family member like him who can stand up for his rights like this. I think the whole family was proud, and I know it definitely inspired my father to exercise his rights more as well. Sadly I don’t think I’ve ever, or will ever, get to meet him.

When a cop is protected because "s/he believes they have a right to" even when they are legally in the wrong, how is that any different than any citizen being taken into custody because "ignorance is no excuse" when they broke the law. End qualified immunity, create a nation database for track these law breaking tyrants and make sure they pay to carry their own insurance to pay any suit coming from their criminal actions, so that taxpayers are protected.

Colorado ended qualified immunity, and now, surprise, they can't find enough people who want to be cops. The end result is that the public is less safe, police morale is low, overtime is costing the state much more $, which will raise taxes, etc.

Southern Draw Law channel (He's an attorney) explained the reason for these low payouts. Basically, if you don't take the settlement and want to take it to a trial, the monetary award is then in the hands of the jurors and could literally be $1.00. So, people take the settlement so they at least get something.

There was a case in New York (upstate) where a cop arrested somebody for giving him the finger, and he not only got sued, but he was stripped of qualified immunity because giving someone the finger was so clearly a settled First Amendment issue up there.

Both the ranks and the hierarchies are there for a good reason, they cannot be given to people who do not deserve it or do not have the necessary knowledge to perform it, or do you think that if you give the rank of general to a private soldier he can command or lead an army??? Or that a simple nurse can be the director of a hospital??? See what I'm saying? There should be evidence that some citizen complained and provided details about the danger to traffic claim. If that is the case, then the cops have a duty to investigate. They would not be serving the public if they did not take the complaint seriously. The sign is a first amendment right and the property of the citizen. I did not see the officers making physical contact with the citizen. If the cops really wanted to protect the traffic, they should have set there to witness the citizens actions and they could have used their radar on the same sight the citizen was holding up the sign. Per the code it does appear the finger gesture could be interpreted as fighting words and disrupting while driving on a highway, that can be debated. The case examples are NOT while driving down a highway. Evidence has shown that the middle finger has caused fights in traffic, this could be different than giving a finger face to face during an argument. A court would have to determine the final interpretations
