Officers report: On Sunday April 28, 2024, at approximately 1315 hours, I, New Mexico State Police Officer J. Guerrero was working in the County of Hidalgo, New Mexico, in full New Mexico State Police (NMSP) uniform displaying my badge of office, patrolling in a marked NMSP patrol unit when I was dispatched to the Lordsburg Port of Entry (POE) to assist Transportation Inspector Ramirez on a safety inspection with a Commercial Motor Vehicle that he has safety concerns with. When I arrived at the POE Inspector Ramirez informed me, that while performing a Level 2 safety inspection, he asked the driver, identified by his Georgia commercial driver’s license, as Zelalem T. Aseres if he had a seal or a lock on the trailer. Mr. Aseres stated it was a lock. Inspector Ramarez asked if he had a key and Mr. Aseres stated no. Inspector Ramirez asked Mr. Aseres to step out of his tractor. Inspector Ramirez explained to Mr. Aseres that he was going to cut the lock off the trailer to conduct a cargo inspection and that he would replace the lock with an issued lock. It is not uncommon for a CMV driver to place his own personal lock on the trailer doors to secure it. It is uncommon though for the CMV driver to not have a key for a personal lock. Prior to attempting to cut the trailer lock, Inspector Ramirez asked Mr. Aseres multiple times to verify that he did not have the key. Mr. Aseres kept responding with the answer “NO”. While Inspector Ramirez was attempting to cut the lock, I was standing behind Mr. Aseres and noticed he was showing signs of nervousness. His body was shaking/shivering. I walked around to face Mr. Aseres and noticed Mr. Aseres was sweating profusely from his forehead, he kept swallowing with a struggle as if his mouth was dry and had both his arms wrapped around his lower back and was fidgeting with his wedding ring. The weather today was cool with a slight breeze. West inspection bay door was open, and the west door was cracked for air flow. After several attempts Inspector Ramirez successfully cut the lock off. Mr. Aseres was asked to open the two back doors as it revealed several brown cardboard boxes approximately 5 feet long 2 feet tall at the rear of the trailer. There was a large wooden framed object at the rear of the trailer that was secured down with straps to the right trailer wall and other cargo items that had plastic wrap to protect the cargo. None of the cardboard boxes were secured down or wrapped in plastic wrap for protection. The boxes were stacked along the left side of the trailer wall and stacked at the center rear of the trailer. Inspector Ramirez asked Mr. Aseres if he knew what was in the boxes and he stated no. Inspector Ramirez got into the trailer to conduct the cargo check. Inspector Ramirez lifted one of the boxes from along the side of the trailer and placed it on the stack of boxes in the center of the trailer. Inspector Ramirez opened the box and viewed the contents. Inspector Ramirez proceeded down the ladder and informed me that I need to confirm the contents. I went into the trailer and cut a strip of tape of the opened end of the box. As I cut the tape several vacuumed sealed bundles fell out of the box. I grabbed one of the bundles and noticed a large amount of a green leafy substance. With my training and experience I identified the green leafy substance to be marijuana. I could smell a faint odor of marijuana coming from the box. I exited the trailer and placed Mr. Aseres under investigative detention. Mr. Aseres was searched and placed in the holding cell at the Lordsburg Port of Entry. At this point the Level 2 inspection was stopped, and everyone was advised to stay out of the CMV trailer. I typed up an affidavit for search warrant, to search the remaining boxes and other contents for 2013 white Wabash 53’ trailer with chrome trim with 2 axels. On this date, April 28, 2024, at 1725 hours 6th Judicial District Judge Jim Foy telephonically approved my Affidavit and issued a search warrant. At 1730 hours the search warrant was executed. A total of 19 boxes were taken out of the CMV trailer. While searching each box and to verify all the contents was marijuana one box contained 6 different types of shrink-wrapped bundles. Within those there was several smaller individual wrapped bundles. One of the bundles was opened by New Mexico State Police Narcotics Agent Maese to verify the content. A white powder content was located. Agent Maese contacted Homeland Security Investigation (HSI) and informed them of the findings. HSI agent Dizeo arrived at our location to field test the white powder substance. The powder tested positive for cocaine. The completion of the search resulted in 18 boxes of marijuana containing total weight 803 pounds and 1 box containing cocaine total weight 73.5 pounds. All boxes were secured with red evidence tape, numbered and showing the weight of each box. All boxed were placed and secured in a cargo trailer that was used to transport the evidence. This was the end of my involvement with this case.

Doesn't really matter, CMV's can be inspected any time for any reason without probable cause. Saw a few of these semi truck busts where the cop even said you haven't done anything wrong, I'm just pulling you over for an inspection. Just comes with being a CDL driver (which I am).

A lot of drivers aren't allowed in the dock areas of certain warehouses. Someone could easily stash drugs on these trailers for another person at the delivery warehouse, and the driver wouldn't know. They past you the BOL, and you trust that everything on the paperwork is exactly what's in the trailer. Some loads are sealed up before you get arrive to get the load.

20 years OTR and ive had suspicions about loads ive picked up that crossed the border. Its why we insisted the loads be sealed and noted on the trailers from the shippers not the intermediary we picked up from. Not being independently dispatched can have Its advantages. Running the border all the way across from cali, to florida, you can hear the on the cb radio calling out ridiculously high pay for no questions asked blind loads. And you know the contents are illicit or human. You gotta cover your butts drivers. Youre the patsy in the scheme of things to the traffickers.

what most smugglers don't understand is, 99% of cargo is labeled, you can figure out what is in the box by the tag and printing on the box. Boxes without tags is the immediate red flag.

Smugglers completely understand how freight works. They’ve been doing it for years. They just become lazy or to comfortable and familiar with the route that they think they will never get busted. No DOT Insp. will ever go into the cargo area of a trailer! The driver doesn't have to know what's in the trailer, if the company puts their own lock on the trailer. He has a BILL of lading that's all he needs to go down the road! I've picked up many trailers which were sealed with cargo locks! I was given a B.O.L. and took the trailer to the receiver who would cut the lock off and I would back into a dock and drop the trailer and grab an empty trailer and head down the road to a shipper to get reloaded. At no point did I even know what exactly what was in the trailer. The Driver will beat the charges, if he had a B.O.L.! It's not the driver's job to inspect the cargo when it's sealed by someone else! Also, the Driver didn't look nervous to me at all. And besides he did not have a key for the lock, which speaks for itself.

I drove O.T.R for years, I've been loaded countless times, and never saw what I was hauling. Sometimes the shipper straps the loads for me, sometimes I have to strap them myself. But, if someone at the shipper threw a few boxes of illegal drugs in my trailer, and I went thru this, ide be shocked as hell and super confused. This driver had to have known about the weed, he was way to calm P.s. I doubt these drugs will be destroyed, they'll find their way back on the black market..."Reality is stranger than fiction"

He did not ask to search the vehicle. He did not provide a search warrant. He did not have a K9 do a free air search of the vehicle. He did not have probable cause to search the vehicle. He did not have the right to cut the lock off the vehicle with a search warrant, k9 sniff or probable cause. The weigh station inspector does not have the authority to do a cargo search without permission, search warrant, k9 sniff, or probable cause. The state Trooper, just watched him do that. It is on video. I do not believe in drugs, and I do support law enforcement. But this dude can get off and out of trouble just by subpoena of the video alone. I was stopped in 2004 during a 3 day blitz in Arizona. I was told by a Rookie F.B.I. Agent that I was required to open my Dry Van Doors because I was hauling Hazmat. I Said only if he signs for the seal, and reveals the door with another seal the He replaced it with. That was my only condition. He said I was required to because of my Hazmat Load. I said NO. I had a Arizona Highway Trooper there also. He did not interfere with me saying No. The Agent said he would arrest me. I gave him another option. I told him I would contact my Security Chief, and if he said yes I would. Agent told me to call him. I explained my situation, and my security chief told me to give the agent the phone. What the Agent did not know, was my security chief at the time was a RETIRED S.A.C. of the Atlanta Field Office. He tore the Agent a New 1. The Agent handed me my phone back, and walked away. The State Trooper Sgt. Shook my Hand and thanked me for teaching him a lesson. He said the rookie had only been out of the Academy for 3 Months. And that he probably was not going to make it out of Probation. Needless to say, Know your Rights. But also Be respectful and you will win. As a stated I fully experienced the Same thing this guy did. But I knew my Rights, and Respectfully Forced my Hand. I won. Remember Respect GOES BOTH WAYS. SHOW SOME AND YOU WILL RECEIVE SOME BACK. NOT ALWAYS, BUT MOST OF THE TIME!

Been driving for 4 years. I had my cargo inspected twice and it was in the florida argricultural check station and california. In florida, the shipper brings product from many sources and ships it in one go. So i had bills from like 10 different places. They thought it was something sketchy and broke my seal and climbed in. The cali one they stopped me while bringing roses. They checked a box im guessing for contaminants? It is truly rare to get the seal broken, but it is a possibility.

Here’s one for you guys. There are many shippers that put locks on trailers and don’t allow driver inspection. The USPS is one that does this. The driver gets a manifest and that’s it. SO ….unless you know the shipper and the freight refuse the load.

This guy had no manifest nor bol, if he did and especially if it was from usps.. it wouldn't of probably came to this, but you're right about the border inspection with the dogs, however if he had a manifest from usps and they had the lock keys, and they would of warranted a proper search on the usps cargo(hypothetically of course) then the drivers fate may of turned out differently. But all in all, yes, if no bol and no key to lock nor being allowed to inspect and secure cargo, then refuse load. This may of been a newer driver and naive to shady hauls and not knowing but what a lesson for him to learn and price to pay ...
