In this NY case Trump could easily have made a deal with the prosecution, only receiving a relatively small (in comparison to the latest lawsuits he has lost) fine. But neither he himself nor any other POTUS can pardon him from a NY verdict if he would come up with the idea of after the verdict asking for forgiveness for the crimes he committed.

The notion that the defense had a strategy of declining to object to testimony so they can later claim on appeal that the testimony was prejudicial or otherwise inadmissible is wrong. There is a doctrine in appellate practice called “forfeiture” or “issue preservation.” Basically, if a party fails to make a timely and specific objection during the trial, then any appellate claim about that evidence is forfeited. In order to preserve a claim for appeal concerning the admissibility of evidence, the party must register a timely and specific objection when that evidence is introduced at trial. Bingo! Props to John Dean. I wrote about this in a previous online comment. Dean made the point, and I wholeheartedly agree, that Trump 's defense team elected not to object to objectionable parts of Stormy Daniels' testimony (ex., that he did not wear a condom) because they are deliberately trying to create issues that they can use on appeal. I have not seen many other so-called legal experts identify this reason to explain why the defense did not object.

@@peaceloveharmony7213 We think alike, but I don't think Trump will argue ineffective assistance of counsel on appeal so much as the prosecution elicited testimony that went beyond Judge Merchan's ruling and that that testimony was prejudicial to Trump. Trump's team will argue that it didn't matter that they didn't object because the testimony could not be unheard even if they objected and their objection was sustained. Basically Trump's team will argue that once the testimony was stated it will have an effect on the jury, and that bell cannot be unrung.

@@blairhoughton7918 I agree with you that that is normally the case. But, this is not the normal case because of who the defendant is. How can you explain the N.Y. Appellate Court substantially reducing the amount that Trump had to post to appeal after the $450 million judgment from Judge Engoron's court? There was no legitimate rationale for the appellate court to do that . There are several other examples I could cite, but you understand my point. So, as I see it, an appellate court could well overlook the lack of specific objection at the moment it occurred and instead focus on the pre-testimony ruling by Judge Merchan that such testimony was not to be elicited. I agree that such a ruling would not be correct under established trial law, but it is not out of the question that an appellate court could so rule. The fact of the matter is that in nearly all cases involving Trump, he has definitely not been treated as a typical criminal defendant. Instead, Trump has garnered significantly more favorable treatment in every case compared to how the typical criminal defendant would fare. So, I would say that you cannot evaluate this case under normal trial standards. It sucks, but the courts are giving Trump significantly favorable treatment that would not be afforded any regular criminal defendant.

As far as I have been able to tell through my research and limited information, John Dean has not practicedlaw since his disbarment after Watergate in the 70s. If that is true, he has not tried a case to a jury in approximately 50 years and is not qualified to opine about this trial.
