Coating The Issue

The plaintiff says she attended the defendant’s New Year’s Eve party and checked her designer coat, but it was gone at the end of the night. She’s suing for the cost of the coat and the party tickets. The defendant says things got out of hand at coat check when the night ended, and people were just grabbing things. He claims he bears no responsibility because the coat check was free.

defendant made a good point though , he said his defense was that she never proved she had her jacket in coat check . and why would a person put a one thousand dollar jacket in a coat check when everyone knows that someone would want to steal a jacket of that high cost . i just think that bigger price tags require bigger proof and this plaintiff never showed a photo of her jacket being given over to coat check . if they found her BF jacket then most likely hers would have been there too if she really had it in coat check . sometimes this judge just gets it wrong .

He’s definitely liable. It’s his event, he offered a promise of safety for their coats and failed to provide it. Her story seems reasonable - it makes sense she’d wear her expensive coat to a big NYE event. His coatcheck fell apart, he failed to provide safety, and even got people’s things stolen. He’s liable. She got the full price because it’s a fairly new coat, it’s a unique and rare designer coat, and that rarity & lack of availability makes her able to get near the value of it. He needs to get insurance, to have cameras, and to have coat check in a more secure location.

I work at a luxury event venue and this is why we don’t offer to hold anything or let anyone store any items anywhere. We refuse to be liable for missing items. A lady put her purse in a random cupboard to not carry it around then was going crazy when it was missing at the end of the night. Way to much liability involved

A lot of event centers, hotels and venues have actually gotten away from the coat check / hold area. It's kind of an old school thing that people no longer want to be liable for. So now they basically say to everyone it's your own responsibility to hold on to your own coats, purses, and bags.

For people confused on why she got the amount of money she did...I'm an Adjuster, the way it works is you get the amount of what it would cost to replace the item NOW in present day (not what you paid for it) and then you take that amount and subtract for depreciation. The coat was almost brand new so there was not really much depreciation to take out and she only paid 800 because she got a discount... the coat costs over a grand. We do not take into account what you paid for an item... think of it this way, imagine this was for a TV and the TV was sold to you by your best friend for only $20 because they did you a solid when the TV actually costs $500. We would never only give you $20 because that's what you paid, we would give you the full 500 (then add depreciation) because that is how much you WILL have to pay to replace the TV now. We don't penalize you because you got a good deal, we have to make you whole again and able to re purchase the item.

Preventing theft is literally the reason why you have a coat check. It's a safe place to keep your coat while at an event. If you don't want to be responsible for someone's coat, don't offer a coat check.
