Comment on As is Where is. This simply means that the vehicle is being sold in its present condition. However, this kind of agreement WILL NOT EXEMPT DECEPTIVE SELLERS FROM LIABILITY FOR DAMAGES. We have this so-called "Implied Warranty" under Article 1561 of the Civil Code of the Philippines which provides that "The vendor shall be responsible for warranty against the hidden defects which the thing sold may have, should they render it unfit for the use for which it is intended, or should they diminish its fitness for such use to such an extent that, had the vendee been aware thereof, he would not have acquired it or would have given a lower price for it; but said vendor shall not be answerable for patent defects or those which may be visible, or for those which are not visible if the vendee is an expert who, by reason of his trade or profession, should have known them." Therefore, you can sue the seller as long as you can prove that the seller fraudulently or intentionally concealed a defect of such kind that would have affected your decision on whether or not to buy that thing. Also, under Article 1566, the vendor is responsible to the vendee for any hidden faults or defects in the thing sold, even though he was not aware thereof. But, please be guided that court action must be filed within a reasonable period. Under Article 1571, actions arising from implied warranties must be brought within 6 months, otherwise, it is barred by prescription. You can also read cases regarding implied warranties in the Supreme Court website.

I don't think this is complete. After ng Step 4 ay nabili na yung sasakyan Nasaan na yung in between. Yung mga papers na need hanapin, saan dapat pumunta? Yun pa naman yung pinaka-important dahil wala ka na magagawa kapag na sayo na yung kotse. Pag ba nag-close na deal nyo bigay mo na lang pera at bigay na lang niya yung mga papers at susi? Tapos na yun, iuwi mo na yung sasakyan? Sana yun yung nabigyan ng details - it is important for ignorant people like me. Thanks for the info anyways.

Bring a scanner if you can, bring a mechanic who has a scanner or dumaan kayo sa shop kung saan pwede ipa-scan during the test drive. Hindi sapat ang mata at tenga ng mekaniko para malaman kung may mga faults yung sasakyan.

im good at buying cars in australia. but i live in fils now. ppl tell me here i need to learn how to avoid the fils scams here, which dont exist in my country. but they wont tell me wat the scams r or how to avoid. i wish there was a scam avoidance guide to buying 2nd hand cars here in english.

Thats true. With so many schemes going on, I would suggest getting your 2nd hand car from a car dealership (safest). Bec most prob they have done the due diligence part. Actually this topic is on the list but i still havent started researching on. 😅
