Capital gain tax is very very high in India now.. That tax pulls down sale and thus decreases Central tax income + livelihood of deed writers, clerks etc ( who depend upon deed servicing for livelihood) and decreases State Registration income. So it is a Total Mess taxation. This Tax helps no body, neither the seller nor Central or State Govts. Short term gains should be taxed at maximum 8% and long term at 5%>>. Then more sales will occur and thus more gains for Central and State Govts. And more smiles on the face of Deed writers etc.

under which section tds will get deposited for token money and for final settlement? if there are two seller for 85L then they are going to counted for less than 50L. correct ?

I have understood the video if I bought the property for 50 lakhs in 2009 and selling it for 75 lakhs in 2023, If I apply for LTDS. How much money I will receive from buyer. I have to take 15 lakhs as first part. After submitting LTDs buyer bank will deposit 55 lakhs. 5 lakhs buyer will deposit in income tax, I can file ITR and then claim the amount of 5 lakh. Is it correct ? Generally how much is LTDS tax percentage.

I have one question, My current flat price is lower than 50lac so I was not deducting TDS from instalment payment to builder, I requested for ownership transfer to another buyer before flat registrars so new buyer paying me flat cost higher than 50lac but since its ownership transfer so actual cost of flat is still below 50lac, can help to confirm do we need to pay TDS in this case ?

I don't understand how TDS of 30% on STCG is profitable to the NRI doing real estate. For example as an NRI, a) I bought a plot for 10 lakh b) In 4 months, I constructed a house on that plot for 15 lakh. My total expenditure is 25 lakh c) Now my selling price is 35 lakh. According to the above scenario it is a short term capital gain. And a TDS of 30% on 35 lakh would be 10 lakh and 50 thousand. I spend 25 lakh and I get 24.5 lakh. How is this profitable to me? Or am I missing something?

With An Aadhar card and Pan card with local address, Sell the property as a RNOR status. RNOR is a transient between NRI and Resident status. FEMA has no set timeline to convert NRO/NRE accounts to resident accounts for RNOR status Only 1 % TDS. Key is to pay the Capital gains immediately, after sale. That satisfies the Tax authorities, whose main concern is Tax evasion and tax collection. Otherwise the lengthy LTDS process of Form 13 (45 days) is tedious. Getting money back from I Tax (2 years)is even more cumbersome, may involve practices which India is famous for.

Shiva Prasad, Will not a NRI selling property as a resident Indian be a violation of FEMA? I do not think it is legal for a NRI to represent themselves as a resident Indian. Further sale procceds should be deposited in a NRO account to enable repatriation and having an NRO account implies you are a non resident.

@@mananthakrishnan Aadhar card verifies identity, not nationality. PAN card can have a local address. To acquire resident status 182 non contiguous days stay is required. During that time you can continue having a RNOR status.

@@shivaprasad7111 Thanks! Agree with you Aadhaar is proof of identity not of nationality. PAN card can have either local or foreign address. You see the whole idea of obtaining LTDS certificate is to either avoid or minimise the 23% tax deduction at source on sale of property by NRIs and the hassle of reclaiming the tax deducted at source later via filing an income tax return. Long term capital gains indexation benefit will go to reduce the amount of 20% capital gains payable. There is no question of reclaiming through return the tax on capital gains and hence paying it is not an issue. I am of the view it is illegal for a NRI to sell property as though he were a resident with the express intention of avoiding the 23% TDS applicable for NRIs on sale value of the property. Much better legal way is to obtain a LTDS certificate and sell the property.

@@shivaprasad7111 Think about the harassment by the Enforcement Directorate(ED) to the hapless NRI if caught doing something that is not legal. Much better to follow even a long winded route and abandon TDS on sale of property considering it as a discount to the Govt of India, than fall into the clutches of babus from ED,Income Tax etc to come out of which one may end up shelling out more money. For those bold souls, willing to take a risk, there is always the hawala route for quick and effective transfer to wherever one wants completely bypassing the traditional hurdles of bureacratic delay, incompetence and endless demand for bribes.

We have to pay 5% stamp duty the pay TDS while buying then pay 24% TDS and capital gain 30%and stamp duty 5% while selling the property. Gov t is ripping you off. Too much.

Sir, On approved lower TDS rate, do we need to add surcharge and cess ? For example approved lower TDS is 4%, and sales value of more than 1Cr, then do we need to add 15% surcharge and 4% health & education cess, so total tds rate will be 4.784% ?

I have inherited my mother's property (flat) in 2016/17 which was purchased in 1960. I cannot remember the price she paid for it as I was an infant then. I am in negotiation with the current tenants living there since 50 years to buy over the property. The Property is in Mumbai. They have offered me half of the market price as they refuse to move out. The price offered is about 2 Crore. How would I handle this TDS issue and do you handle the TAX issues for NRI property in Mumbai ?

What about TCS? Will it be deducted where buyer’s Indian bank will transfer to my Canadian bank, will there be 20% TCS (considering bank is sending the money = loan amount of buyer).

In the case of a bank transferring money from an Indian bank to a Canadian bank for a loan repayment, TCS may not apply, as it's not a typical transaction subject to TCS. Hi sir, I have a small question I bought flat 3 years before for 33.5 lakhs, now the price of that flat is 34 lakhs, I bought that flat through house loan bank gave me 32.75 lakhs, now outstanding loan amount is 30.50 lakhs, so now if I want to sell I need to pay 20% TDS which is around 6.3 lakhs, but now even I sell that property I won’t even get that much money to my hand. Can you please give me any suggestion about. I don’t have much time to apply for lower TDS because it is taking around 45 days. Any suggestions please

Respected sir has bought land and the person selling this land has come from abroad. And this ID proof is from Punjab and while preparing the registry papers, the address outside that has also been written and this file has been given to the Naib Tehsildar after preparing all the registry papers. There will be no problem of NRI address in this, as it is said that NRI's TDS is cut. Please clarify sir.

If an NRI buys a property for 1cr and for some emergency reason sells it within two years for say 90 lakhs. He will get only 63 lakhs after deduction of 27 lakhs as TDS @30% and will get the rest after almost one year when filling his return are filed as capital loss. For Residence it is 1% TDS. Is my understanding correct?

Lower TDS request can be filed online as form13 after obtaining TAN of buyers and signing of agreement to sale. Within one month one can get exemption or lower TDS certificate under section 197(1) based upon which buyer gets loans sanctioned and disbursed.

23% of sale price to collected by purchaser from NRI seller and remitted directly to Tax authorities. Correct amount is 22.8 %

Yes,tDS need to be deducted there is no threshold limit for TDS on NRI.

Very informative. If I sell the property for 1.90 cr tax 3828074 as indexed cost is 595800/-on purchase cost was 180000 in the year 1983 which is 20.14% of total sale price. In this case form no. 13 is useful? If I invest in bonds up 50 lacs based on which amount ie after the TDS deduction or before? Thanks

Its not NRI but Buyer need to take TAN, If buyer is NRI than yes he has to take a TAN and Its not mandatory to link aadhar for NRIs

My father and brother are co-owner of the property and buyer will pay to both of them equally but while paying to my brother he will deduct approx 23% as TDS. Total property sale value is 70 Lacs and will be paid to both equally. My father is resident and my brother in NRI. Please guide and suggest

My sale deed registration process will go in next FY, Is it true that if I pay TDS in this FY then seller does not have to apply for low TDS again in next FY. PS : I am taking home loan and do the payment to seller in next FY.

It is not a good idea to buy property in India for NRI. Because when he has to sell the property the buyer has to pay ,20% yds. And if it is shorter m gain then he has to pay 30 per cent TDS. With this taxation no NRI will buy any property. Pure nonsense of taxation by RBI. God save N RI coming to India

There is reason for that , NRI Means even foreign national, the TDS deducted is equal to Capital gain tax, however they have given option to file lower TDS, What happen if NRI sell property and never come back to pay taxes, Such as provision is everywhere in the world.

@@Mark2Market no NRI means Indian passport holders who have lived abroad. Not foreigners. Plus buyer has to pay TDS at twenty percent when he buys from NRI .now nobody will buy house from NRI . So it's too much tax on NRI property.

@@vidyarao7930 that’s wrong assumption.. buyer pay the tds from purchase price only .. whereas seller has to file rerun later to get the refund

How will the buyer know I am an NRI. Many NRI's Don't know this TDS deduction of 23%. Also when an NRI buys from a resident should NRI deduct 23%. and file the return. What if the buyer and seller is an NRI

Do you have team in Gurgaon ? What is tie fee that you charge for I) this part of the work and I) for complete selling process till registration . Secondly if I want to remit the amount from NRI to my UK bank account , do I need to pay tax ? Can you please share your contact number so that I can call and discuss this with your team ?
