Namaste Sir, Suppose, I am CJM and I have recorded statement of a victim/witness or Confessional statement under section 164 of Cr.PC. Now, 1. am I eligible to try this case ? 2. Or commit the case to other court equivalent to CJM? 3. Or keep the case in abeyance till next CJM joins? Please make a detail video with examples of Supreme court judgements or reference.

the JM before whom confessional statement is made will become the prosecution witness, meaning thereby, that magistrate would be included in police report U/S 173 as prosecution withess, so he can't try the accused, and trial shall be conducted by else JM.
