Your deposit must legally be placed in a government approved tenancy deposit scheme (TDS). If your landlord didn’t do this (and it sounds like they might not have), then they automatically have to pay you 3x the deposit amount, no matter what. If the deposit was placed in a TDS, then you can still dispute their claim. You will need to submit evidence to the TDS, who will then look at your case and decide how much money (if any) should be awarded to the landlord. They are usually quite fair and unbiased.

The other name for this it DPS, Deposit Protection Scheme, and yeah immediately raise it with them because they should not release the funds until they get your say so, so if they did that it means the letting agency committed identity fraud to complete that DPS transaction, i think you should be able to get Trading Standards on to the DPS and the Letting Agency for this

Get a lawyer and sue that women. Firstly she rented you a unsafe home with a small child. Second they are doing some shady shady stuff. And just taking a young couples money they could have made you completely homeless!!! They obviously dont care. Sue that landlord and whoever else is involved. I'm in the U.S. so idk your process to do that but I had a similar issues with a former landlord when I was younger I had to sue for my security deposit back turns out the judhe was very familiar with him so he was a know shady landlord.

I totally agree as well!!!! AND the best part is, that, you have the declining health (for all 3 of you), so verrrry well documented ;)!! I think they & a judge would find it realllly difficult to dispute that the estate agent/landlord were/have been in the wrong, that you even spent more of your money to try to rectify the situation (the damp/mould) that shouldn't be there in the first place & that tenants shouldn't be responsible for managing or even expected to live in such a toxic environment- especiallywith a baby!!!! I really feel like a judge would agree that they should NOT have touched your deposit at all (and that the invoices are suss) AND that you are owed your whole deposit b/c of all that you did & b/c of how toxic the house was!!!!

It's not really the done thing here in england. There's processes they need to go through before any legal action can be taken. As another commenter has said they need to take tgis up with the tenancy deposit scheme. Private tenancy can be an absolute bitch. I'm being evicted after 9 years, the real reason is the likely want to up the rent. I'm a single, disabled mother of 3. I'm being made homeless as I can afford another private rent with how high rent has gotten. Thankfully the council are helping me and I'll be housed at some point. It's no fun private tenancy. I've Ben private renting for nearly 20 years and this is the first time I'm being evicted.

I'd never private rent again. When me and my partner first moved in together 9 years ago so the prices are much higher now. We saved and put down a deposit, £600, then there's the admin fees of £1100, then first months rent of £515. Then after 6 months they charge £50 admin fee to renew the contract and up the rent to £550. Then after another 3 months, gave us notice that they were selling the house and wouldn't be renewing our contract when it was up in 3 months time. All that money gone to nothing. It was a letting agency aswel, not paying a landlord directly. But even though we never chose to leave, they wanted another £1100 admin fee to move into another one of their houses. Then took £50 out of the deposit for cleaing fees. Even though I'd gutted and cleaned the place top to bottom with my mum and aunt. Just awful. They can make you homeless anytime. Luckily I had parents to go back to at the time, but not everyone has that.

You were scammed by the estate agent. They created false invoices. The proof of this is phone numbers not valid, cannot locate business on invoice etc. Fight it and contact the owner directly and let them know. I would also demand an inspection of what is claimed was “fixed, painted”.

I had something similar from a housing assocation in Gloucestershire I contacted shelter, for help and they went through everything to find multiple fraudulent documents and false allegations of non payment of rent , the housing assocation was called chapter 1 under christian alliance assocation a very well known business so dont be afraid to tackle anyone because the housing association now no longer exists , contact shelter I recommend 🫶

Take it to the housing ombudsman… or the people who look after your deposit (can’t remember the name) we lived in a rental property for 4 years, paint would just wipe off the walls as it was cheap… we left it in a good condition… even wet cleaned the carpets… landlord tried to take us for £4000! We proved wear and tear through the housing ombudsman and the only thing we couldn’t prove which wasn’t our fault was a cracked bathroom sink (it was a new build and it was cracked when we moved in) we ended up paying £300 and that was it! I’ll take that thanks greedy landlord!

Yes! I work in an estate agent and this is so correct. The property ombudsman can look into your claim if you can’t raise it with a valid deposit protection scheme, either the Tenancy Deposit Scheme or the Deposit Protection service. If they haven’t protected your deposit in time or at all, they might be liable for 3 x your deposit amount!

Also, agencies will usually request that a check in/out (inventory) are carried out at the start of the tenancy by a third party company, one done by a tenant or landlord can be deemed biased and not counted towards any legal disputes. Might be worth checking. Regarding cleaning, your tenancy agreement should say you’re liable to provide it back in the same condition provided. If it wasn’t professionally cleaned when you moved in, you shouldn’t be doing it when you move out!

Idk if you can in the UK, but in the US, you can go to your bank and dispute the charges as fraud. They took your money out of your account without your consent or permission. Then put a hold on your account. (Obviously open up a new account that way these people won’t have access to your new account.)

They didn’t charge their bank, here your deposit is paid to the estate agent which then goes into a deposit protection scheme normally. If not the estate agent keeps it, the estate agent refunded the part of the deposit which was left and kept the money for the invoices and sent that to the landlord

I cannot believe the owners of that house charged you for the damage. Our rental laws in Australia protect the person renting and hold a "bond" for any damages the renter may have caused but leaking water into the house seems to be the owners responsibility. They are lucky you did not charge them. What a disgrace.😢

You can change out the mattress. Try one out next time before buying. Try a mattress topper over your mattress first though. Also try sleeping bags, so much more cozy and warm for end of winter vanning. Hope these tips help.😊❤

You can dispute your deposit deductions for free through the scheme that held your deposit (DPS/TDS). The adjudicator will charge you a resonable fee for cleaning based on the condition at check in and decorating minus reasonabale wear & tear. You will have to login in to your deposit account to agree or dispute the deductions. The money that arrived in your account is probably the undisputed amount of your deposit. If they havent protected your deposit you can go to a solicitors who will get you three times your deposit back in compensation from a small claims court. Dont be overwhelmed it is very straightforward, the charity shelter has lots of information on their website as it is a common problem for tenants.

Fair wear and tear is standard when letting and you shouldn't be charged for it. When you moved in, you should have had an inventory done which would have had pictures of the property condition when you accepted it. When you left, you should have had the same done. The letting agents should have arranged all of this and keep records of it. I would 100% dispute this with the lettings agents. And check you tenancy agreement. Your deposit should have been held in a deposit scheme (TDS or similar), and the fee should have been agreed by all parties BEFORE being deducted - so what they've done isn't legitimate. Otherwise, your other option is small claims court. I'm so sorry that has happened to you, and not sure if my comment may help in some small way, but I wish you all the best in sorting this issue out ❤

Hey guys if you have receipts for the paint dehumidifiers etc then keep them and fight it x have you tried to contact the Citizens Advice in the area and see what they can do to help xx mabey a discretional housing payment x hope this helps at all I know the feeling with mould, I thought this for ages with my flat, also they will have wiped all the walls down with bleach to prepare to paint as the mould would come though straight away again if not so I think that was the “marks on the wall” xx feel for you as a family they did wrong hiding the issues with the house”

I would absolutely recommend seeking advice from a lawyer at this point. I don't know the rules in the UK, but in Germany, you would (depending on the circumstances obvs) not have to pay for any of the cleaning connected to the mold, get compensated for your health issues and also for any costs that you may have had because you had to move so quickly. That would absolutely be worth paying a lawyer (whose payments would also have to be paid by the losing party, so hopefully the landlord)

Something I’ve found helpful when renting is to take a full video tour before moving in of everything and take pictures of potential future issues. That way you have evidence of how things were from the beginning. Then do the same right after you moved out. It’s tedious, but helpful in disputes

I’m wondering if this is common in the UK, because here in the US it is rare a landlord keeps some or all of the security deposit unless there is damage. A landlord should Expect to do a deep cleaning and have to paint in between tenants so this should never be a part of what a renter is responsible for. Also, and most importantly, you left due to unhealthy living conditions. They are lucky you don’t sue them and they should not be allowed to rent out the place until all the mold is remediated and repairs are done to prevent this from happening again. I say you have a legal dispute here, if you’re up for it and of course idk what your laws are like. We’re cheering for you ❤❤

You guys need to look up the Tenancy Deposit Proction scheme. If your landlord or letting agent haven't kept your deposit in one of these you can get up to three times the value of your deposit back. I had to go online and agree to the amount my landlord was returning to me in order for the deposit to be released. I don't see how they've returned your deposit withour your agreement. Also I've NEVER heard of a tenant paying a painting and decorating fee?! Unless you painted the walls/wallpapered without returning it to it's orginal state, this sounds like a complete scam.

You don’t have to return it now unless it’s stated in the agreement, if your decorating improves the house it’s deemed an improvement (within reason you can’t have bright colours or dark colours and leave them)

I really wish you all could find other tenants that lived ther. I have a feeling they have done this before and it's painfully obvious they knew about all of these issues before you moved in. It's really disgusting that they would rent this death trap to anyone let alone a family with a baby is just horrible. I'm ao glad you all are in your home and able to heal wnd move on, but please do not feel bad about advocating for yourselves. I agree with the other comments to seek legal advice along with what you're already doing with disputing the charges. They are punishing you all for leaving early and thats not okay. Collect your doctor bills and each time you had an appointment and your receipts for the humidifiers etc. and a list of the property that was damaged. It's a lot to fight back and not fair that you have to even deal with this but I hope you do push back. You all are an amazing family and I wish you all the best. ❤️

In Australia if you want to dispute the money you can take the agent to a small claims court - I don’t think that you should make excuses for them at all. We took our agent to court when they kept the bond because our toddler spilt cordial on the carpet. They wanted us to carpet the whole house. The judge found in our favour as if the carpet is over 5 years old too bad so sad. Definitely question these costs

OMG! Thank you Connor and Liana! I've been very down.. today you made me actually laugh out loud! I simply adore your relationship! If your ever looking for another Grand for little Kozey, please adopt me! I'm not sure how it works over there, but in States a landlords cannot keep deposit for "wear and tear" or painting if tenant was there a year or more, and carpeting if there more than two years. Also, Landlord must provide itemized invoice for all money retained. At least you were able to leave the moldy place. Good luck with the dispute! Fingers crossed for you..
