This really is the law simplified. Reading many pages of a textbook sometimes causes me to lose focus and lose the point because of excessive information. This video really helped in summing everything up. Wish I discovered this channel earlier though...

The Constitutional law, is a state characterized by respect for human rights, even more than it should be added that the main issue is not the State but the law, as the law meets the needs of citizens, and in addition to legal persons, as law can contribute to improve human relations, without the law can not be advanced, individual law is extremely important, some time human beings dream of building a house, a home, a skyscraper, a megaconstruction. Y., this then has nothing to do with the subject about Alice in the movies, but rather of all human beings follow ends and objectives, but one should not forget the human being or individual by itself, because in itself must have objectives if the people continue to become mass soon there will only be distinguished human beings in some societies.

Thank you Shaveen for making it clear that the legal principle known as the “Rule of Law” (in reality) is nothing more than a paradox. There seems to be a fourth pillar (or limb from one of the existing three pillars) of the “Rule of Law” that is missing in your video - and that missing pillar or limb is that the Law should rely essentially (and always) on the correct and accurate definition of the words that constitute all the individual laws of the language in which the said individual laws are written. Although the “Rule of Law” is meant to be NON contradictory (as you say) a possible repeal of the Human Rights Act by the UK Government would contradict the notion that everyone is EQUAL before the Law and everyone is subject to the Law. A possible repeal of the Human Rights Act by the UK Government, would in fact not only denounce the notion that EVERYONE is EQUAL before the Law to be a fallacy, but also that NO ONE is above the Law and EVERYONE is subject to the Law to be also fallacies. This is because judges and ministers are immune from prosecution. It needs to be remembered that the word ‘independent’ in the context of the separation of powers - which states that the Judiciary is “independent” from the Legislative and Executive - does not mean that the Judiciary can and has the right to act in a manner that is dictatorial in nature (instead of acting in a manner that is independent from the two other branches of Parliament) OR could enjoy immunity from the scrutiny of the Legislative and the Executive. In fact, it is the responsibility, function and duty of Parliament to make sure that the State has an efficient Justice system which operates with 100% integrity and is unconditionally free from any form of corruption whatsoever. Since the rights of the people are better protected under Common Law (as Dicey says) it is not difficult to conclude that the so called “Rule of Law” must be set aside and that Justice - INSTEAD - should be administered in accordance with the interest of Justice in mind - i.e. in accordance with the set of virtues that each and every single person in the entire world is born with. One does not need to be a lawyer or a judge to know the difference between right and wrong. Another evident contradiction which exists in relation to the two limbs of Natural Law : i.e. “Theological Law” and “Secular Law” can be seen in Jomo Kenyatta’s statement made before the independence of Kenya, which very firmly affirms this contradiction : “Before the missionaries came they had the bible and we had the land. When they came the missionaries told us to close our eyes and pray. When we opened our eyes, we had the bible and they had the land”. So, it can be easily concluded that the so called “Rule of Law” is nothing more than some kind of highly contrived legal tool that is used as a dishonest ploy by some unscrupulous people/lawyers to take possession of other (credulous) people’s God given gifts?

Great video. I've been researching how to challenge a State law under sections 76 & 109 of the Federal Constitution. I've found s 40 of Judiciary Act but can't find any examples of the application to the court. How about making a video on the "procedure" of "how to" challenge State law under Federal Constitution in Australia?

Can anyone answer this for me? I asked on another show and it wasn't answered. Thanks: "Why isn't anyone talking about an organized communication campaign to several specific officials and news media? This is exemplified by the US Constitution as Step #1. I find it odd no one is orchestrating something like paper letters and public decrees to show the genuine will of The People. Thank you." This is clarification that I added after the original question: What I'm saying is, if we're a nation of laws and have protocols to abide in that law, why isn't anyone promoting documentation of our legal management from "We the People" to the elected/appointed officials so same officials must then comply, argue for a compromise, or be openly defiant to the lawful will of the People they represent and serve? If Conservatives would have organized a letter-campaign and petitions instead of that Jan 6 march/protest which was used against us, in the end, we would have Legal Grounds to replace and force the defiant swampers/useless career politicians out of office and replaced with moral/effective servants. It seems everyone is looking right past the trees to the forest and not doing step one of a Constitutional legal battle, that being, service of complaint and decree of desired remedy from the "We the People" party in this complaint. Hi Chandra. Dicey's third limb essentially says that, only caselaw (common law) can provide safeguards for human rights. However, what needs to be understood is that, during Dicey's time, there were no significant pieces of legislation to safeguard rights, hence his exposition. Today however, you have a number of Acts such as HRA 1998, Gender Act, Race Relations Act etc., that actually provide such fundamental rights.

Constitutional law: is the body of law which defines the relationship of different entities within a state, namely, the executive, the legislature, and the judiciary. ... Funny thing is, people are not entities and cannot live within a state. According to the definition constitutional law applies only to government and Govt. entities. Constitutional law deals with the fundamental principles by which the government exercises its authority. So, a constitution is to place restrictions upon Govt and not the people. Makes sense.
