I have a query on "Guarantee without Knowledge of Principal Debtor" and the case study "Periamaran vs Banians & co - Seems this case is similar to selling defaulted loans to third Party and this process is legal as such many financial institues follow the same. Ma’am, you have said that the contract of guarantee is only express and not implied, but in some books and my professors told me that these contracts are both express and implied. Also, you have said that the contract between the principal debtor and the surety is implied. So please solve my doubt.
