Sec 124 & 125 of Indian Contract Act, 1872 deal with Contract of Indemnity. Sec 124 defines the contract of indemnity & Sec 125 deals with rights of Indemnity holder.

As you say when insurance company has indemnify the indemnity holder then he can sue the third party for the money which he had given to the indemnity holder but acc. to sec.124 when one party promises to save from the loss caused to him by the conduct of promiser himself or by the conduct of other party here my question is that how he can sue the third party because the third party does not promises to the insurance company.plz clear my doubt

Normally agar accident 3rd party ki vajah se hua hai toh indemnified has right to sue 3rd party. But agar indemnified sue na kre or insurance co. Se apna loss mange toh Aisa hota hai. Aisa isliye kyuki indemnifier jab pay kr deta hai indemnified ko toh indemnified ke sare rights indemnifier ke ho jate hai. I hope it helps ☺️

Contract of Indemnity is talks about loss caused by human agency which is coverd under section -124 & its a narrow concept but a contingent contract is talks about loss caused by Human agency and Non-Human agency both which is coverd by insurance industries ...its a wider concept ..thats why it falls under the category of contingent contract (section -31)
