Leakage need not be shared between two at times three or more flats. It is matter of understanding between the parties. Leakage flat normally under takes repairs at its own cost or jointly with effected flats depending on understanding. Incase of dispute AGM has to decide and pass resolution for all flat members.

I am Shahid Ayyubi member of cooperative housing society, office bearer and members of CHS uses passages of building for parking of two wheelers and four wheelers since last 15 years. Many members of society demanded to charge parking charges but managing body avoid to enforce parking charges till September, 2022.Now they passed a resolution to enforce parking charges. What about past parking charges? Can society collect parking charges of last 14 years or not.

I have a query, The builder has formed a service society and the managing committee by selecting some flat owners. But there is some Rera Rules that builder has to maintain society for 2 years. So in these two years, can this formed society work as a regular society? Do it has all such powers like ordinary elected society? Pls reply Sir

In our society there r two wings, the new wing has a lift , the old wing does not have a lift. The old wing members also have to bear the repair n maintenance charges of the lift.pl advice

Our society is been registered since 2020 Oct ,though OC was obtained in 2014 ,we have leakage issues in external wall since than but inspite the builder working on it it hasn't stopped.few members have 5 yrs guarantee letter from builder towards leakage issue in 2017,but now society is formed with leakage issues sq so now is it still responsibility of builder or society now if one has the letter

Can society deny the parking allotment of the car provided by the company of member which is registered in company name but will be transferred in member name after lease period? This is the first car of the member. Please suggest.

Supreme court has given guidelines for parking.. Builder cannot sell parking space in common area of the society including stilts, if sold even in agreement of flat it is not binding on the society. Please rectify .

Dear sir I have started giving monthly maintenance from nov.18 onwards which means i took possession in Oct.18 and NOC of my flat to old owner was given until Oct.18 by RWA, the resolution for the whitewash was passed by RWA on 25t Dec. 18. Is i am liable to pay whitewash charges as i am only three month old in this society and not used this service. Old owner lived in that flat for 8 years.

I own a flat and have 1 parking space and 4 cars, my society asks to park only one specific car. I always park any one car in the premises. if I fail to do so they will charge me a penalty on daily basis. is it right or do we have any law for the same?

Sir, my nephew stays in my flat. As there r less no of parking space he has been asked to park outside the society.There is a member whi has four flats , but he is running a full fledged connmercial establishment, n parks two of his car permanently. He does not live there in the society. Managenent is allowing him to run his commercial business n park his two cars.

Few members of a particular community renovate the whole bathroom and change the sitting position of the WC Commode in order to face and sit in a particular direction, some also replace the Commode with Indian style in a particular direction, thus causing unnecessary damage to the whole pipeline fitting structure and cause leakage due to poor material/construction and waterproofing etc and also due to the changes made to the original fittings. This is a willful act committed by such arrogant members by violating all the acts,rules and bye-laws ,and don't care for the hardship and harassment caused due to (stinking) leakage seeping into to the members flat below . There should be strict rules all over Maharashtra and India and such arrogant members should be fined and made to correct the leakage by respective Municipal Corporation authorities and/or the Deputy Registrar of that area.

Guys all these laws are meaningless. The Managing committee behaves worst then MVA and the registerar will drag your complaint for 3 years after which new registrar will come and whole process will start again. all corrupt

ABSOLUTELY True, I've been fighting for Justice at the Deputy Registrar AND the Deputy District Registrar at Kokan Bhavan, Belapur for a flat in the Everard Towers CHS. Sion. Mumbai, for which I have a 1) Nomination, 2) Power of Attorney, and 3) Duly Probated Will All in my favour. I've been fighting for my 'Constitutional Rights' since 2009.

Good Evening Sirji, Jay Prakash here, I have a flat in ghodbunder road thane, and fm the time I purchased I have given it on rent, the society managing committee has always been in boisterous behaviour with me, to cut short on the recent problem they plan to introduce moving or shifting in and out charges for tenents inspite of NOC charges paid by me, Sir that is a 2bhk flat but it has never fetched me a rent above 15000/- rupees but the society is charging noc fixed charges of rs 400/- and now they are planning to introduce for tenants only 1200/- rupees for moving in charges and 1200/- rupees moving out charges which is absurd and nowhere mentioned in bye laws of Maharashtra CHS act. Sir please guide me how can I takle such a problem
