"Not gonna end well" is a pretty clear threat. Imagine telling the police if they don't leave you alone "it's not gonna end well" for them. What do you want to bet that they consider it to be a threat then?

When an individual is asked to leave a library for whatever reason! He has to leave. He can file a complaint later but arguing with either the manager or the police is idiotic! It's called disturbing the peace and it's an offense. The officer's job is not to debate who is wrong or right! they are keepers of peace! They have to right to arrest anyone who refuses to leave.

​@@jacquespoirier216 No, public servants in America don't have the power to withhold publicly funded services or remove members of the public from publicly owned property "for whatever reason." Arguing with the citizenry and attempting to prevent legal behavior is idiotic. Law enforcement officers are paid to enforce laws, not the feelings of librarians who don't know the bounds of their meager authority. If I'm doing something legal, and a public servant starts shouting about it, the public servant is the one disturbing the peace.

@@biffodio Breach of the peace is a generic phrase to describe a criminal offense that violates the public peace or order. Next time a person annoys you or harass you at your job! don't call the police.

@@jacquespoirier216 Walking through a public library with a camera isn't harassment and can't be considered a criminal act on its own, according to the U.S. Constitution and applicable precedents. If a public servant were to throw a fit, disrupt library service, and demand that a citizen leave after refusing to turn his socks inside out, the trespass would have the same legal force as the one in your scenario. In today's America, they can't just make you leave. They can do that in Burger King, but public property doesn't work that way anymore. (It never worked that way on paper, but the bureaucrats were able to get away with assuming extra power because there weren't cameras everywhere.)

The cop does actually have no idea. Most of them know very little about the law because we don't require that someone has any kind of degree to be a cop. We should require a Bachelor's level degree in Criminal Justice to be a cop.

In NY you have to have a degree in criminal justice. My brother just retired after 33 years being a cop. He's sick of cops like this so a good cop leaves & the bad ones stay. Good cops hate bad cops more than anybody. My uncle & grandfather were also cops. Better screening & training to weed out the bad ones before they are hired. Something has to change. 🙏🙏

Just to clarify, the second thing the cop said was - 20 years ago he would have been dead with his teeth missing. This is from the 1st amendment auditor called Long Island Audits. Check his stuff out on KZbin.

He's easily my favorite auditor even though he is relatively new to it. I've been fan of cop watchers and auditors for over a decade at least. The Battussai is also a Jedi master of Auditing. There are also a handful of active auditors and cop watchers that do fantastic jobs with their own unique styles. Some are abrasive, (though the cops are always worse). Many don't interact with the police until the police say something first. It's all incredibly fascinating, infuriating at times, and uplifting when a thug cop gets his ass handed to him verbally.

Exactly. They are the same guys we all knew were awful tyrants in high school who were counting down the days until they could be on the cop side of the equation. I covered small-town cops as a reporter and I was terrified of them most of the time. They kept telling me that they liked me because I wrote good stories about them. And I did. We had a test policy in place that we had a good cop reporter and bad cop reporter to see if that helped us cover the bad stories better while giving credit where it was due by making sure we did cover the good stories. I don't think it was effective. We never got to finish the trial policy because our paper was bought and all the reporters were let go. I left a couple months earlier to go back to get a master's so I could learn more about doing that kind of trial on a larger scale in controlled research studies. I did get to be closer to the cops than they ever were with any other reporter. They told me that all the time. They actively requested me to cover positive stories, so that part of the strategy worked. They definitely appreciated that there was a person who was available to cover their accomplishments as much as their failures. But, I also know that the "bad news" guy was pretty miserable every time I gave him a tip for covering police problems. (that was part of the strategy, I was to cover good stories but pay attention for signs of abuse of power or other shenanigans. And then I passed them along. It also meant that some people not on the force recognized my name from the regular police articles I wrote. Like the time someone approached me after I finished writing about this small town pulling together to replace their K-9 unit after the dog was killed. The town raised enough to have 5 K-9 units. The capital city had 6 dogs and this was a town of 10,000. Their unit brought in quite a bit of money by traveling to other crime scenes where the dogs could help on drug or cadaver situations. They billed those communities for their help and it brought in a good part of the force's budget. Meanwhile, back at the "police are thugs" ranch... I was told regularly that one of the cops used his k-9 partner to terrorize his wife and kids, so... There weren't ever any good stories that didn't end up broken by the kinds of guys on a small-town police force.

Until qualified immunity is rewritten to include some sort of consequence for violation of constitutional rights this will continue to happen.

I am so glad I relocated outside the United States a few years ago. Looking at the U.S. from afar gives me a better understanding that it is a police state, no doubt about it!

most "western" countries have the same issue, its just not as televised or propagated because there tends to be fewer shooting deaths. Type in most European countries and systemic racism in policing and odds are they have a large report stating there are issues... I know there are in Canada between PoC, Indiginous (especially) and other ethnic minorities. Difference being that Canada does not have many enclaves outside of major cities so it tends to stay on a local level unless someone gets killed... which, not being America tends to be rarer.

I watch this auditor quite often. He always keeps his cool. Libraries and post offices are the worst for first amendment auditors right now.

He's a fraud who apologized to police in Harford, MD for recording them, made a propaganda video saying all other 1A auditors are just grifters picking fights to start lawsuits, and thanked the DA for allowing him to pick up trash for 10 hours along a Maryland highway in order to avoid jail time. Did you watch this auditor do that, or were you not paying attention?

@@GreyKnight7777 This stemmed from an unlawful arrest in which he was filming a routine traffic stop from a public sidewalk. His back-peddling had absolutely nothing to do with having his Civil Rights infringed upon. The only conclusion is that he may have tired of spending time in jail unnecessarily, and decided to cut his losses.

@Diana Rockwell - The first amendment of the constitution was not written to hold government employees accountable to some arbitrary standard set by self appointed, unemployed, uneducated, arrogant, disrespectful, uncouth auditors with no credentials. Nor was it meant to be exercised at the expense of disregarding others feelings to remain safe & anonymous. Along with “rights” comes “responsibilities” & “common sense”. Until these Fruaditors learn to respect others, they will continue to be arrested & scorned by society

So this cop is saying that in 2001, *he would have killed someone for operating a video camera inside the local library and refusing to show ID?* I was a high school senior in 2001 and I don't recall ANY law prohibiting citizens from recording a video inside their local library!!! We used to record ourselves goofing around in/at the library all the time! We never had any cops even SUGGEST they would've killed us for recording inside the town library!!!!

Pretty sure he never said kill and didn't even allude to that. He's talking about how they treat these frauditors with kid gloves instead of verifying that they were trespassed and arresting them when they make it clear they're not going to leave based on their ignorance of the law

She makes a really great point about “how can you change attitude?” If they don’t want to fire cops, the only thing I could potentially think of is specialized therapy. The same goes for aggressive driving.

Problems arise when some people are given authority that goes to their head - put a uniform with that as well and you have what those officers were doing and worse. They definitely shouldn't have their jobs after that display 🤬

Thank you for bringing attention to this auditor and shining a light on these bullying police officers and their lack of training, lack of education pertaining to the law and tyrannical attitudes. They seem to have forgotten that they work for the public. Qualified immunity needs to come to an end.

That guy is doing society a favor and showing law enforcement boundaries, to help stop the abuse and rights infringement of the people. There should be more good people like him out there so that police can get a little dose of education and be reminded of our constitutional rights.

A library is not like a courtroom. What a ridiculous thing to say. Judges have a duty to protect jurors and witnesses. What is the government interest in denying recording in a library?

While there does exist Limited Public Forum in Libraries, it does not apply to Freedom of Press. It only applies to speech. You cannot create a disturbance by screaming at the top of your lungs, or engage in political discourse inside of a library. Otherwise, every citizen has the right to film inside of a public library as long as they are not impeding business.

Isn't that the whole reason why kids pretend and dream of being cops one day...so they get to shoot at people and punish them by putting them in cages? They develop that hero complex at first, and then it devolves into something sinister. They train violence everyday; become experts at it even. And then they foam at the mouth because they have no outlet for their self imposed violent tendencies. The bottome line is people who practice violence become violent people.

Yes, in that it is a public building where certain areas may be restricted from public access. Public access to public buildings is not a blanket right. And when I mean Public Access I also mean right to film.

@@barbiedahl it sounds like you are taking one of example that hasn’t occurred. Nobody is talking about accessing an area unopen to the public. Entering a public library and filming is clearly different than being invited into a back office or behind the counter and then insisting I can film.

@@hidoconnor303 some public buildings, such as post offices (and maybe even libraries!), have rules that state that you cannot film in them without express permission, even in areas that are normally accessible to the public. You should do a little bit more research on this before making assumptions about others knowledge. Audit the Audit is a great KZbin channel that educated me on a lot of these issues. 👍

Retrained...? That just told those officers can still be jerks & break the law. The retraining was just public appeasement. This officer's should have been dismissed when they clear state intentions that if they could've they would have beat his ass. How can you retrain such a mind bent on using their position to physically hurt someone. USA, United We Stand? Examples like this, wonder why we're falling in eyes of the 🌍, including here. As a black woman & former military, I regret ever serving this country. To think I could have been blown up 2x, swore to defend, the very country I need to be defended from. Oh the heart breaking disgust & shame.

Sean is an Auditor, not a Reporter. Long Island Audit is one of the nicer Auditors who always remains calm, cool & collected despite many LEOs being ignorant to the U.S. Constitution.

@@eltorocal News journalists from major broadcast stations are engaging in formal interviews, not observing. Which is why many officials say to auditors, "our employees are not allowed to conduct interviews without prior notice or approval." They often respond, "we're not here to interview people." Lester Holt, et al is not going to visit City Hall on a whim to keep them in-check. Also when have I ever asked or questioned Auditors rights under The Free Press? Are you the facter maker upper now? LOL!

@@darrint3573 City Hall and Post Office are Public Forums... Libraries are "Limited Public Forums", but the "By Laws" remain nearly the same, especially with Recording In Public. Look it up, as all of the information IS a "Matter of Public Record".

I am the one who educated others telling them that Sean had every right to do so when he visited City Hall in Danbury, CT. Please learn how to read. A library is NOT a courtroom. This aspect of the big hair woman in the red dress's input to this matter is bologna. She seems to entirely miss the point and should be disregarded. The police need to take responsibility for this incident and many others. If they were not routinely denying people the right to record in public spaces, a.k.a. freedom of the press, as stated in the constitution of the United States of America, then there would be no need for 1st amendment audits. If they were not routinely infringing upon the rights and brutalizing minority communities there would be no need for BLM or to begin to routinely record the words and actions of police in their activities. Our right to do so has been clearly and emphatically stated by the Supreme Court. The overstepping of authority by police and their blatant disregard and disrespect of citizen's rights under the constitution is at the root of this matter. It has been common for police to unlawfully search, arrest and detain citizens without reasonable articulable suspicion of a crime, with fabrications, mis-interpretations and ignorance of the law on the part of police, and using false premises as the justification for the arrests, incarceration, excessive force and outright vindictive beating of civilians. The 1st amendment auditors are doing important work in bringing to light the words and actions of tyrannical egotistical, low IQ, ignorant and under-educated, often racist ( though not as overt as they once were there is still that underlying racism in the USA) police who are a literal menace to society. It also shows how so called 'good cops' stand by and allow their violent and tyrannical colleagues to get away with murder, literally in some cases. Legal precedents in the US supreme court protect the rights of citizens to record police in the course of their duties. The police do not like this, some are just camera shy, others are corrupt but clearly they view it as a nuisance. Police break the law far more often than the average citizen and are usually NOT held accountable. They have gotten used to getting away with it. It appears that many police view the US constitution and supreme court decisions as a nuisance and an inconvenience also. Power corrupts, unfortunately, and those who gravitate to a career in law enforcement are often bully types, not the intelligencia either, not be a long shot. Police AND a corrupt and imbalanced legal system have been ruining good people's lives for decades now with the prohibition against cannabis also. That needs to change now, as it already has in many other countries, and in many states. It's insane immoral and non-sensical to take away someone's freedom for the crime of having cannabis, which has now been proven to be a medicinal and beneficial herb. Keep in mind also that it was not too long ago that police would take queers down to the docklands or some back field somewhere and beat the shit out of them just for being gay. Some of them still probably wish they could get away with it and some probably still do, terror, intimidation, and violence are still directed at many minorities in the USA and elsewhere around the world. It's a sad fact. Slowly, incrementally we are seeking and finding some modicum of justice but it's been an uphill battle all the way. I, for one am thankful that documents such as the US Constitution, The Bill of Rights, The Canadian Charter of Rights and Freedoms and their equivalents exist. Now if we could routinely stand up for and practice and attain our legal civil rights we will be getting somewhere. There are sadistic, ego tripping, and/or moronic thuggish cops out there still; we need to get them off the street and behind bars. Compounding matters; we need to dismantle the religious right wing oligarchy that holds too much power currently in the USA. That is a real present danger to democracy as we know it. Also reverse 'citizens united' which allows too much corporate dollars to influence US politics. This is at the heart of corruption also and at the root of many environmental crimes which have gone un-punished thus far.
