If he went through with it, MED would’ve determined the wounds weren’t accidental and IA would’ve gotten involved. Voight went too far ordering one of his own officers to use unnecessary excessive force on a suspect, especially one in custody or detainment.

Minor continuity error in the scene, As the suspect leaves the building he turns around and fires a single shot at Anthonio. Seconds later Voight comes out and orders the man picking trash to leave the scene and run, clearly unfazed by the fact a gun was just fired a few yards from him.
