Absolutely one of the best audits I’ve ever seen. It’s shameful that you can find that many law enforcement individuals in one department who do not know the law. Who refuse to educate themselves. Yet they will take tax dollars (paycheck) each payday. I tell you it’s fraud! Each one of them took an oath to defend the constitution and to serve and protect. Yet they either don’t know the law or refuse to uphold it. Both are unacceptable and should be cause for immediate termination. There are no excuses they can offer.

As A SO trainer, I install in the people I train that Constitutional Rights are supreme to Policies. When a SO secures a public domain, that SO then is under Federal laws. That means that they must abide by Federal rulings and jurisdictions. Since the Constitution is the supreme Federal Jurisdiction (Article VI - supremacy clause), that doc trumps all policies. If said person were obnoxious and then began to create a scene where he was disturbing the business, I would have him removed. The actions of others do not make him disorderly. The female officer wanted to arrest him for disorderly. She even did not know what it entailed. He had to inform a LEO (of the law). That is sad. Cops do not care about the Constitution (until they are in Federal Court for violation of it). Even then, the monetary amount is not taken from them or their pension fund (as it should be) - but from the taxpayers. Usually "retraining" happens and they continue to violate rights.

Trespassing can occur on both private and public property, and you do not have to receive a verbal warning that the property is off-limits. According to Criminal Defense Lawyer, some of the most common ways you could be accused of a trespass violation

Oh my gosh this is indiana and Beech Grove is an awful department !!!! I use to live in this town and so did my man and they fucked with him for years. He avoids it at all cost but one day i insisted we go to friends and sure enough we crossed paths with them. He always told me they would know him and cause issues... it was 6 years later and surely he was over reacting ... right ??? Ummmm NO when he told them his name the officer ... IMMEDIATLY said “ITS BEEN AWHILE MR. ---“. At that point i got really nervous. We werent breaking any laws or causing any disturbance so with that and my excellent people & communications skills we didnt have any issues. We left the place and got the hell out of Beech Grove!!!

@@HJKampe - Mainly, the Fourth Amendment. Police are generally restricted from forcing people to do anything unless they have violated a law. Of course there are exceptions (e.g. traffic, emergency situations, etc.) to this based on reason. Trespassing laws read differently in different jurisdictions, but generally involve an unlawful intrusion on a premises based on a lawful authority. On private property, the owner is the lawful authority, and can restrict access as they see fit. The DMV is under the lawful authority of the state government. The state government opens the DMV to the public. People may come and go as they please and seek the public services they offer. Taking a video in public is lawful. The only thing that would justify a trespass charge in a public agency would be a violation of a law, and then a subsequent refusal to leave. The "limited public forum" is in regards to speech classes. It has nothing to do with taking video in a public place. This is not a freedom of speech or protest issue. One can take video in traditional public forums, limited public forums, and nonpublic forums (i.e. speech forum designations). There are, however, some laws regarding video in government buildings.

I am all for the 1st amendment audits. This auditor seems like he's more interested in being an antagonist and not showing respect to the people. I am not sure what the LAW says about video recording inside a place like the DMV where ID information is everywhere and ID theft is a major problem, I know it happened to me. The act inside the DMV simply doesn't seem cool to me on common sense. Then there's your sideways baseball cap... A wanna be thug with a camera doing 1st amendment audits ...nah

Salem, Danvers, Beverly, and Peabody. Maybe even Revere. And the South Shore too is pretty interesting. Quincy, Weymouth, Cohasset and Plymouth, Braintree and Dorchester in no particular order...But..... Hingham police LOVE violating peoples rights, pull people over for no reason, and the sheeple are so compliant im sure the cops would crash under pressure. Fun fact; They have a police Maclaren and their police station is in their town hall! . I love your work specifically, you choose your battles wisely. If there was an easy way to donate I'd love to do that so you guys could be a little more risky, potentially fight and win some cases. Although the system is so arduous I wouldn't blame you if that's what you guys want to do all the time or at all, and these videos have revitalized my respect for what these United States was supposed to be ❤

It's up to the employees to keep documentation private. There is probably a reasonable expectation of privacy behind the counter and in offices but not in the waiting area. Anyone with eyes can look at documentation not secured by the employees.

A public accommodation CAN NOT discriminate based on disabilities.. or religion... we aren't talking about homes or private companies that aren't open to the public. Once a company has a business license it is an entity that is working under state approval and must follow all federal and state laws. Mandates aren't laws. Go read a book.
