@@kenw.4539 I appreciate that. I enlisted in the army in 2000 when I was 17 to get away from home. That was before the shit hit the fan and the bush administration's agenda went into play. I was against the war in Iraq. I believed it was a violation of US and international law and the UN charter. The military quickly became a different animal and things got pretty bad for service members. There was a mass exodus in the army starting in 2004 and the army initiated a stop loss policy of violating our enlistment contracts. The moment my 6 year active service term was up, I was gone, but they kept me in over a year beyond my contract. Now I spend my time fighting leukemia from toxic chemical exposure. Until Jon Stewart and activists shamed congress into passing the PACT act, I got no compensation. Starting in 2001, I started paying close attention to the actions of my government. Their words mean nothing but their actions speak volumes.

About 30 years ago, I was vacationing in VT and staying at a motel there where I had stayed before. I knew the owner from previous visits to the area. One day I was outside my room sitting in a chair when a cop pulled up and began asking me questions. The motel owner came over and told the cop to leave her guests alone. He threatened her with arrest for interfering with an investigation at which time she went inside and called the PD. About 1 minute later the cop was told to leave by the chief. I later found out it was because I owned 2 motorcycles which were next to my truck. I had trailered them up for both a dirt and street adventure I was planning. Evidentially this annoyed the cop for some reason which I still don't know to this day.

Here in Michigan, you do not have to I.D. yourself unless you are suspected of committing a crime, leaving the scene of a crime or are stopped for a vehicle code violation (traffic stop).

Yup and you usually have the police with you when asking them to leave or trespass. It's only then the cops can go hands on if he refuses to leave. He shouldn't have pled at all.

It's private property, but a public accommodation. When you open for business your property remains private but you invite the public on and they aren't trespassing unless asked to leave and they refuse.

Why is this so hard to understand? But I had cops get mad because they set up a bait car and I “ruined it”. The car door was ajar and the keys were on the ground. I picked up the keys, locked the doors and took the keys into the library, where it was parked. I was standing in line and got a tap on my shoulder, then got taken to a room to ask what I was doing. I figured if the car owner came back they’d go to the library desk to see if someone turned in their keys. But bad peasants!

US cop training = a couple of weeks. European cop training often lasts for years like getting a bachelor's degree (not like an associate degree in the US which often is less time than cop training in Europe).

In all actuality everything after "place your hands behind your back" should be suppressed and inadmissible in court according to case law, example; Marsh v. Alabama "All rights protected under the Constitution extends to private property when that property is used in a public capacity" That was an unlawful detainment and arrest.

*STOP SPEAKING TO COPS!!* None of this horrible encounter would have happened if the guy putting oil in his own vehicle had said "I'm going to invoke my 5th Amendment Right to remain silent and I will not be talking to YOU!" It would make the Cop do his job and investigate the "crime" and speak to the person who called the Cops from the Motel, found out that they wanted him trespassed and gone back to the carpark and found him gone! 🤔😳😳 End of problem! I agree with the original comment. Arguing with the guy is exactly what he wants. He wants to escalate. Escalating starts with talking in circles throwing out accusations. I think if he kept his mouth closed and recorded with his phone, the outcome would have been better.

If he remained silent, the deputy definitely would have arrested him even faster for being uncooperative. Remember, most cops don't know the law. They only know what they've been trained to do like demand people's ID any chance they get to search the NCIC and put your name there even though it's clear as day you were doing nothing wrong. They actually believe asking any person they encounter for any reason for their ID is legal when it's not.
