Let me lay it out for you, this is just an educated guess, but id be willing to wager serious money that its very close to the truth. There is a law enforcement agency that stops some poor bastard for some minor traffic infraction, the cops intimidate or violate or bluff him into a search of his vehicle and they dont find drugs after the K-9 unit comes and gives a false hit on the walk around, but they do find a significant amount of cash, so they manufacture some charges, arrest him, tow the vehicle, and confiscate the cash as evidence of a criminal enterprise.Then fast forward to they have not been able to prove the guy is involved in any way in any criminal activity now or ever, abd the judge has ordered tbe law enforcement to give him his money back. Fast forward a little more, the head of that law enforcement agency, the DA, and the judge get together and discuss how they could turn thst into a way to keep the money in the future. So the DA or the judge or both start talking to their congressman or a senator and they draft a bill that gives them broader powers to make it much harder to get your cash back but much easier to take and keep it for them. It goes before tbe house and passes, then the senate and passes, and they all negotiate their cut. And the next thing you know, BOOM, ITS RAINING IN THE CAPITOL. SO DOES THAT GIVE YOU A LITTLE MORE INSIGHT AS TO THE ORIGIN OF THAT PARTICULAR LAW?

Yes Congress could easily legislate CF out of existence. Yet cases like the above and there are many of them are still happening. It does appear to be a violation of ones civil liberties - people going about their lawful business. Considering, as Steve said, the courts have deemed CF *not* to be unconstitutional, this I would suggest, congress is happy for this to continue... Seize the profits from criminal activity by all means. Not steal from people going about their law abiding business.

I was super worried this would happen to me when flying on two different flights several years ago. I was carrying $15,000 cash on me to buy a truck. Both times I processed through the airports, I told them I had cash in an envelope, showed it to them and promptly shoved it back in my pocket. They let me through with no problem both times. Had it been taken from me, I'd go postal later on down the road. Someone would have paid for the theft of my cash. I'm a simple blue collar worker so $15,000 cash is a small fortune for me.

@@twoeightythreez Because I can, and I should be able to in America without worry. Plus the price wasn't agreed upon yet, so I took the full amount with me just in case. Having cash money was also a huge bargaining chip. I was able to talk him down in price to almost half his asking price, and even though he was on the fence about taking that low of an amount, once I started pulling out $100 bills, in the amount I would pay, he accepted very quickly.

@D RooR There is no declaration law, rule, or policy for domestic travel. It would clearly violate the Fourth Amendment. The only response one should give when asked by a government agent of any stripe if one is in possession of cash is, “I do NOT answer questions.”

Civil Asset Forfeiture can also take non-cash items like cars, jewelry, or anything else you might have. To get them back, you have to post a bond and take it to court. It made some small town speed traps a lot of money from people passing through.

This happened in a town in north east Texas. A woman and her husband were travelling to Texarkana,Tx to buy a car. They were pulled over for a basic traffic violation. The officer searching them and the vehicle found a large amount of cash. I think around $3,000.00 . She was threatened to have her taken by CHILDREN PROTECTIVE SERVICES unless she relinquished trying to get there cash back. So a state representative has taken the law to the capital to change the law.

For folks with credit union accounts, there are shared service centers that serve as national branches for local credit unions. “CU Service Centers” is one such that I’ve used for decades. This may help with Steve’s first tip.

That is why the average amount taken is only something like $1000, absolutely not worth fighting to get it back, it will cost you way more and take serious time just to even get them in court much less win. I remember reading somewhere that about half the asset forfeitures in MI one year was under $500, again they know you wont in general fight for that little bit of money because it will cost more to fight for it than it is worth, you also tend to not hear about hte little ones because who cares about the cops knicking someone for $300? And when it does make the news it is usually framed poorly, they will mention the money, and drugs or whatever reason the cops used, but leave out that there are no charges filed or anything like that.

In these situations, you simply refuse to sign the paperwork and tell them to arrest you. If they suspect you of a crime, of which there's obviously no evidence of you committing. Then it will be a false arrest and any property they seize will be detailed in the arrest paperwork. The reason they get away with this, is because of the paperwork that you sign. You NEVER sign anything, besides the item list when they book you in. You signing that paperwork gives them almost full immunity to do anything with that money. In this way you put the burden of proof on them to prove a crime was committed without evidence. The paperwork you sign is created just so they can legally take the money, without your signature that have no permission to seize It. That will matter in court

I know 2 auto dealers/wholesalers who refuse to carry cash to purchase vehicles, because of civil asset forfeiture laws about carrying large sums of cash. God only knows how many deals they have lost because the seller didn’t trust a check.

My father in law is building his dream Ford chop top. I went with him to pickup the rolling chassis. I asked him how he was paying? He told me cash. I began to explain civil forfeiture and how the cops can just take his money. He said he was never arrested for anything and that they would never take his money. I told him the police believe anyone who possessed $18k in cash is suspect and that they can and will take it with no proof of a crime. I’m pretty sure he still thinks I’m full of it.

If you have to travel with large amounts of cash, make a back withdrawal and have the bank put it in a sealed bank bag. That way it is tracked back to your bank and not loose cash from wherever.

About a decade ago, I got caught with a little bit of something that was currently illegal in my state, and is now legal. I had cashed my paycheck and had that cash on my person as well. They seized it as drug money, little over a thousand dollars (over a couple grams of marijuana and a small pipe) I had to take my pay stubs to court to prove that it wasnt profits of crime... it was whack. Luckily it was a plain and simple thing to prove, for me, over a thousand bucks, not thousands like it was here.

This happened to my Grandfather..it took him 8 months to get his money back. They even took him to jail. However, he could show where every single penny came from. They accused him of trafficking profits from illicit trade(drugs)..

This kind of thing is really annoying. My local PD took someone's Dodge Challenger because he was arrested for "suspicious activities concerning drugs"... He has been in jail for a few years and has yet to officially charged with anything. The local PD has since turned his vehicle into an "attraction" of sorts by making it a police vehicle that they hope will attract younger people to talk and engage with police.

This does happen. There was a guy out west that was traveling to a casino with 40000 on him in a suitcase. Cop took the money and held it for 6 months to a year ( dont remember exactly how long). In the end he had to forfiet 10000 of that money to get the rest back. Insane

About two months ago, I drove my Father in law to go buy a truck out of state. He was buying from an individual. After looking the truck over and talking price, he bought it. He then over to my truck, and pulled out a bag with $42.000 cash in it. I had no idea he had it in the truck. I almost had a heart attack when I saw all of that cash. We had driven more than 200 miles down I -35. And I was keeping it a bit over the speed limit. This could have happened to us. He thinks I'm crazy thinking this could happen.

Turn your life around and the cops never forget. For years I was pulled over weekly going and coming to work. If I didn’t let them search the car, they would make sure I would be late for work. I still needed to be to work at least an hour early just in case I would be pulled over. I had to move.

Had a coworker who had the same problem due to speeding tickets, of all things. He had a BMW and I had a Honda, so we traded cars for a month. He NEVER ONCE got pulled over driving my Honda, and I enjoyed his BMW very much for that month. But when I drove up to his house to trade cars back, I GOT PULLED OVER BY THE SAME COPS THAT WERE HARASSING HIM!

I can't believe (I guess I can believe it actually) that The Supreme Court ruled that it was not unconstitutional. It seems like mafia style shakedowns. So, if someone is out enjoying their expensive super car, let's say a Bugatti, and they're obeying the traffic laws, a couple of police officers see it and think "I'll be having that now" and pull the driver over for no reason they can say something like "we are seizing this car because we believe it is suspicious that you have such a car" and just take it from said driver? That is absurd.

Is it possible to "register" with TSA or DEA prior to travelling that you will be carrying a sum of money, in order to prevent this? When travelling internationally I used to register my expensive camera equipment with Customs before leaving so that it wouldn't be an issue coming back into the country.

Sounds like we're gonna need to take funds with us in the form of a cashiers check. Something that can be converted back to cash at the destination. That will leave only a single piece of paper in your wallet, that's indistinguishable from other notes in your wallet.

I'm a airport police officer and get called to the TSA Check Point at least twice every six months for bulk cash over 10K. We just take a report and call Homeland security to see if the person is on any watch list and let them go with the cash. However if the person is currently on probation for any drug trafficking charge we will seize it. My best advice if you need to travel to purchase a expensive item vehicle whatever get a cashiers check. But I'm just as angry with this video as anyone else taking someone' s money without arresting them is BS.

11 years ago I purchased a truck with $12k in cash. I was driving a long distance to look at it and I knew I would be haggling with the seller over price. I didn't want to do a separate trip and my bank didn't have a local branch to do a cashiers check or such. I am not so sure that I would do that again.

I sold a club house in 1 state for $35,000. Cashed the check at it's bank. Got lucky and they had the cash to do it. Drove to my home state, which was a few states away. we drove through a county that had this stupid daylights on in your car while driving ordnance/law???? . cop searched the car found the money. He asked alot about it. But I had a copy of bill of sale with a notary, and the withdrawal slip from the bank. I kept my money but I got the ticket. When you travel with lots of money. Keep proof of where you got it and you should be ok.

Hey I'm in automotive & light duty diesel technician in California and I have a driving infraction that happened in 2008 and was taken off of my record 5 years ago but they're still sending me s*** in the mail from the court for it randomly and new years eve I got stopped at a D.U.I. checkpoint and the officer told me I have a misdemeanor warrant regarding the issue. The fine was paid( with receipts to prove it) did the traffic court B.S. and dealt with the extortion similar tactics of DMV and my insurance company comparing notes before calling me for more fee's allegedly due even though a judge already signed off on the "all clear" paperwork including sealing the case. don't put any dumb ideas in my head LOL cuz that's totally something I could do 🔥😅😶

A similar thing happened to my friend. He served in the Army for 26 years and saved every penny he could when he retired he bought a new house for himself and a house for his parents and paid cash, the realtor had no issue with this. When he went to buy a new car he told the dealer "I'm not financing, I'm paying cash", the dealer said "I need to see ID and the cash", so my friend grabs the money from his car and shows him his military ID, so the dealer says " I need to get manager approval for this". So, my friend is waiting and suddenly a bunch of cops pull up with lights and sirens and the dealer points at my friend, they put him cuffs, take his money and take him to jail, they never read him his rights, they saw his military ID, put him in jail for 3 weeks without letting make a call, he finally tells the guy in the cell next to him who's about to be released to call a lawyer for him. The lawyer shows up furious, demands his release, he tries to get his money back and they don't have it, he demands reimbursement and they refuse, turns out after an investigation the money was given as a department bonus. He sues the PD for $150,000 and the judge decides it isn't enough and gives him $300,000, and the chief got fired along with the arresting officers. Oh, and their excuse for arresting him was "he must be a drug dealer" even though they saw and ran his military ID.

As a cop, civil asset forfeiture is one thing that really pisses me off. Yes, sometimes people are up to no good and items should be seized but if someone hasn't been charged with a crime they should be able to keep their money. It is nothing but theft that the Supreme Court has said is legal. It is ridiculous.

When I was back in high school in the late 1970s, one of our assignments in US history class was to write a hypothetical letter to a colleague in the Soviet Union explaining how the US Constitution protected us from being deprived of life, liberty, or property by the government without due process. It’s extremely disappointing and frustrating to now realize that what I wrote was a lie. It’s even more frustrating that the US Supreme Court has sanctioned this lie.

It’s been over 20 years now but I had my car stolen and it turned up in another city and was taken to the police impound. The police impound charged me over $400 for towing and impound fees. I felt more ripped off by the police department than the thief who stole my car! 😡
