In most jurisdictions they, further, have discretion whether or not to arrest for a nonviolent misdemeanor. A grand jury could indict later if they decide it’s a priority for society and courts to deal with. That way a jury of his peers decided. That’s how our whole criminal justice system works. There was ZERO reason to arrest him or make him a felon. Don’t be a bad cop enabler
