A state court has no authority to enforce the 14 amendment. Section 5 of the 14 amendment states that only Congress can effect the provisions of the 14 amendment by a 2/3 vote by both houses of Congress. Moreover, a person can only be convicted of insurrection by due process of law which requires a trial, evidentiary hearings, a right to challenge witnesses against him. No one was ever charged with insurrection because the elements of that crime are not present. To further complicate the matter, a sitting President is the Executive Branch of the Federal government and as such cannot commit insurrection against himself as a matter of fact.
