To the hotel manager: you've already got plenty of bad press as a result of this and it's a guarantee that those people will not only never come back to your hotel but might just give Nashville a very wide berth.

Ultimately, the responsibility lies with the hotel for not protecting guest's interests. He's been warned about cars parking in a private lot not affiliated with the hotels, he should have chained it off and put signage. The other building was in the right for towing, and towing companies are notorious for gouging victims. Guests should sue the hotel for negligence.

There was no bait and switch here. It was total negligence on the part of the hotel to do their due diligence and make sure the customers were parking where they were supposed to be parking. The hotel knew or should have known that it would be a problem with their customers parking on another businesses property.

@@mikeslater6246 - The hotel had a sign pointing to the area where the customers who got their cars towed parked. The sign pointed to somebody else's property who had not consented for the hotel customers to park there. - Clearly the "park and fly" was intended as a way to entice customers to use the hotel. - The hotel had been warned MULTIPLE TIMES that cars would be towed and still they did not remove the misleading sign nor did they block passage. So... it was willful negligence to entice customers for something they had no intention on delivering. Hence... bait and switch. Worse even... since the customers did not know they got switched until AFTER the cars got towed. I am quite certain that most courts would agree that the hotel is liable, not only for the towing fees but also for any legal expenses of the court case.

​@@nospamallowed4890all an accurate description of what occurred, except for calling it bait and switch. Bait and switch is when you offer something that you had no intent of giving and changed the rules after the fact. They did not change the rules. Other customers parked and had no problem. They are responsible for not properly marking the area and making sure that the customers parked in the correct place and I actually hold the other business partially at fault because they knew there was a problem and they didn't properly mark their area as not being hotel parking. The hotel put up the barriers after the news report but in truth the other business was responsible for protecting their own parking area. It does not in any way, shape or form, fit the definition of "bait and switch." I do agree, though, that the lawsuit is in order, maybe against both businesses.

I’m guessing you’re talking about Everyhing Autos. I subscribe to that channel. This situation seems a lot like the numbered stalls that the church owns. Those stalls are part of the same pavement as the neighboring hotel. People constantly parked there because they either didn’t read the signs or thought that they didn’t apply to them because they had passes from the hotel. This news story doesn’t mention a lot of things. They don’t say that there was no signage warning people where the neighboring hotel’s property starts. They just show a stall that they were parked in then start explaining that the parking lot is connected to the other hotel’s lot and that hotel said they’ve warned this hotel that they were going to start towing their customers if they kept parking on their side. It’s hard for me to really understand who’s at fault from this news story. We all know that most news stories are biased. Did the hotel they stayed at not warn them about the property line and to stay on their side? Was there signage that the customers either missed or didn’t think applied to them? Was the neighboring hotel allowing them to park there before this, but started towing without enough warning that people had already parked there before the warning and hadn’t yet returned? If you are talking about Everything Autos, you know that they always show the signs saying not to park there. People either miss them, ignore them, or don’t think they apply because they have a pass from a neighboring property and think they’re in a lot that they paid to be in. The hotel that the story is blaming is even putting up a barrier to keep people from going into the next lot. That shows me that they are at least trying to keep this from happening to their customers.

You should get informed. The Towing channel you refer to is called Everything Autos ....and they're in Gatlinburg, which is nearly 4 hours to Nashville. Nashville is where this elderly couple experienced this situation. Everything Autos services the Gatlinburg area, not ANYwhere near Nashville.

That’s one hell of a coincidence, now isn’t it? Or perhaps it’s your position that they’re all collectively blind and stupid? You lost all credibility when you started yapping about the news being biased and started shilling for the hotel that was completely happy with leaving elderly people to stay in their lobby for 2.5 days like the classless assholes they truly are. The manager comes across as an A1 asshat commenting about a 24 hour tow lot with that smug expression. I hope the bad press crushes their stay and park scheme and sees the manager unemployed. His customer service skills are nonexistent. You need to listen more closely, grasp content more clearly and figure out more adeptly where the line is drawn between right and wrong. This is hardly a complicated issue. I’m a judge; I see complicated matters every day. This isn’t even in the ballpark.

It's not his problem. The sign says for them to park at the designated area. The couple assumed they could park there. The other building called the tow truck on them. The manager went out of his way to compensate them reasonably.

How about a taxi to another hotel that has vacancies? That manager was sleazy. Passing the blame. Clearly, it was an ongoing issue of which he was already aware, which means the hotel needed to be hyper diligent in telling guests where to park and the risks of parking elsewhere. Every parking spot that may be used for park and fly should have had a sign or been painted with a different color. They did those folks dirty

I once had this happen to me. The hotel at first refused to make it right. They finally repaid me the tow fees when they were done served with a $100,000 lawsuit and a notice from the state attorneys office threatening to revoke their business liscence. They were also fined by the $10,000 by the state for bad business practices.

when I was in grad school, I worked hotel jobs. I can tell, from the way he's answering questions to the reporter, that hes a bully and treats his staff and customers like peons. He's got a massive ego, is sensitive to any challenge to his tyrannical authority, and likes exercising what little power he has. It is standard practice in the hotel industry to find accommodations for guests at other hotels if you are responsible for them being stranded or without a room. That hotel was 100% responsible for what happened. And the fact that they did this to an elderly couple and made them sleep in a lobby all night?! It's criminal. The manager needs to be brought up on elderly abuse charges; seriously.

As soon as the police found out that it was towed due to a parking issue they would inform you that it's a civil issue and walk away. But suing the hotel I believe is the correct move because they knew or should have known that this would be problematic. They did not do their due diligence to protect their customers.

All of those people who were towed should get together and file a class action lawsuit against the hotel, the tow company, and the business next door. People will say, "But the tow company and the neighboring business are not responsible." True, but legally, they were involved.(was told this by an attorney friend)

Probably because they are potentially partially responsible too. Parties can always be dismissed from a lawsuit, but it is much harder to add them later when the full story comes out.

From a former hotel manager, I am willing to bet money that the hotel is not owned by the chain, but is actually a franchise. That is why the hotel manager is powerless to do anything. The reporter and camera crew need to go to the offices of the ownership group. I managed a hotel that was a franchise. Among the things that they did wrong was forget to put money in the payroll account one Friday. The CFO was the CEO's nephew and he was beyond angry (furious, livid) that I made him leave the golf course so that my employees could get paid. When they finally ran me off, the entire security division quit (I had found them other jobs). They begged me to come back and recruit, hire and train security officers, but I told them "I seem to recall that you fired me this morning" and I hung up the phone.

@@filmbuff000 There is a HUGE difference between "the way things should be" and "the way things really are." For this couple, they got screwed and will never see this money again. They could pursue a case in small claims court, but with gas money, time, wear and tear on vehicles, it's pointless to sue because we're talking about two people in their mid 70's. If you can't understand, take about 600 milligrams of thorazine, IV, and attempt a difficult task, like assembling a model airplane kit.

I did an internship in a District Attorney's office while working my way to a Masters degree in Constitutional Law. After doing so, I worked five years as a cop, filing my own legal paperwork, like affidavits, subpoenas and warrants. I then made the jump to manager of a high end hotel, followed by managing an entire high rise complex. I speak from experience, a lot of experience. You should go to what is colloquially called an old folks home and talk to the residents and then listen, really listen, and be educated.

Obviously, you have never been management, because after being a manager a little while you find that there is compromise in the real world. You want this hotel manager to pay out of his pocket for a mistake that his company made. Won't happen. As far as "the company getting bad publicity", in a few months this whole thing will blow over and be forgotten. At worst, there will be a temporary dip in hotel reservations, but the hotel serves a need. So, go read up on Don Quixote (educate yourself) and the impossible dream.

The hotel manager sounded really stupid when he said that they were welcome to get their car and go somewhere else. How were they going to get their car when it was towed away. They are an elderly couple and I think that she has a wheelchair, so I’m sure that the car is very important for them to get around in. I’m glad that they brought this situation to the attention of the media. This hotel needs to be put on blast because they aren’t treating their customers well.

They were parked in the neighboring hotel’s lot and that hotel had them towed. This news story immediately goes into the neighboring hotel after they show where they parked, but not once do they say that they parked in their hotels side or that there were no signs saying not to park there. Something just doesn’t feel right to me about how this was reported.

Yep very misleading and irresponsible of management not already having a properly labeled lot. Also the business next door in order to prevent people from parking in a shared lot they have divided should have some indication such as signs and barriers. These people all deserve just compensation!

Cheaper than their tow bill. I used the economy lot recently at BNA and it was $20/day ($100 for my 5 day trip), so would have been $200 for them. Not cheap but at 1/3 the tow bill and they wouldn't have to be without transportation.

I just communicated with Choice Hotels International via Facebook private messaging. I provided the link to this video. They did respond to me asking for more information. I told them to contact that location as well as the TV news station. 😉

Hotel was warned and did nothing. They knew it was an issue and ignored it. I mean that many people parking there shows it was a known issue. They didn't care. They were making money using the neighbor's parking lot.

It was not clear from the reporting whether the neighboring business had no parking signs posted at the time the incident occurred. If they did, then it is the responsibility of the of the car owner. If the area was not posted as no parking, then there is no distinguishing one parking lot from the other. It sounds like it has been an ongoing dispute prior to the incident. It sounds like signage could have solved the problem but both businesses failed to post signs. If there were no signs, I would place judgment against both businesses, 50/50. If there were signs, no matter how confusing, I would place judgement against the car owner.

$641 tow fee is exorbitant besides the fraud of being towed in the first place.

Hope to hear an update to see if they do make it right and pay at least for the tow. I live in Memphis, and we go to Nashville, and I will never use them if they don't. I Will also tell everyone I know to stay clear!

It’s very telling that the hotel manager thinks "the worst thing" that could happen is bad press, as opposed to the worst thing being all the stress and financial hardship caused by his apathy and negligence…which ironically have led to bad press.

If that lot is not part of the park and fly situation, there should be clear signs telling people not to park in that area. I hope they sue.

"I'm sorry, the manager is out of town, and there's nothing I can do about it." If the manager isn't available, that makes YOU the acting manager. It's your responsibility to handle these things. If you haven't been trained up on it, that's one thing; but not being able to do anything about it at all until that ONE person comes back is unacceptable. And it's almost guaranteed that it's illegal for the hotel to say you can stay in the lobby rather than giving you a room, especially if it's going to be for multiple days. You want a couple of senior citizens to be roughing it on a public bench, no privacy except when they use the bathroom, no ability to turn off the light to go to sleep, waiting all of Saturday night, Sunday day, and Sunday night? This has lawsuit written all over it, and I wouldn't be surprised if it passes the million mark.

I hope all those guests write bad reviews on yelp and every hotel review website. If the hotel won't reimburse those tow fees then they deserve all the bad publicity they get.

The manager has earned him and his hotel a really bad reputation. I left a bad review on their website and will never stay there. Too many options for staying somewhere overnight to bother with this crappy place.

ANY company of any value would have multiple managers all equally capable of taking care of problems. Every grocery store and restaurant I've been to does this. NO EXCUSE for a manager to not be present. Small Claims court.

They were told by the folks next door they were going to start towing, so they knew! I think a lawsuit needs to happen! He's worried about bad press? To heck with that. I'm in Nova Scotia reading this. I'll be letting my friends know about this place. He doesn't begin to know about bad press. The right thing for him to do is pay for the towing and someone should have found a hotel room for these folks. How dang hard is that!

They're all in on this... Attorneys asked us, "Do You Have Any Signs Posted". When we answered no, he said, "Pay it. " You may win, or not, but it will cost you more than its worth... What's more curious is you media fail to ask the right questions of the right people: 1. If it's a franchise... Bingo!. 2. Ask the City attorney what he's aware of... & the AG... 3. When Local police decided to tow away all the "deemed illegally parked cars" at the weekend festivals...*(Several cars belonged to attorneys... Instead of paying, many obtained court orders to release the vehicles to the owners, told the tow company to collect the fees from whoever ordered the towing. Some Judge will void tickets upon request--failure to post or notify. Some cities may post signs where parking isn't allowed but few & far away... so they still maintain a cash cow. Many greedy or nasty managers of small businesses & cities are in cahoots with the neighbors or "Brother-in-law" or other buddy supported tow service & cities to collect fees from towing & tickets. Media needs FOIA to determine whether city receives remuneration... from these shams...

Why is no one going after the neighbors? I mean they have a connecting lot with no signage that its a private lot! Isn’t it their responsibility to put up a fence to inform people that it’s a private lot? Isn’t it illegal to tow without proper signage? I am really curious what the outcome would be if this went to court.

if it's so easy to cross and park on the wrong property, someone should put up a (clear) sign 'leaving property, DO NOT PARK beyond this point' and the desk clerk should warn about how easy it's to mix up and risk a ticket as long as the is no barrier preventing this mishap... Hotel is at fault for not acting sooner as this isn't the first time it happend

Dispute what charges. If you make a charge on your credit card and then intentionally report it as fraudulent you have committed a crime in most states.
