I think you're confused between the proviso of sec88 and rule 3 of order 35.. Rule 3 deals with a situation where defendant sues after an interpleader suit has already been filed

Rule 3 is explained incorrectly. The rule actually states that court in which IP suit is filed instructs the court where suit is filed by def, that the suit shall be stayed. Additionally, the court may instruct that the costs incurred by plaintiff in that other suit may be paid by the def. in that suit itself, and if such order is not given then the amt. of such costs shall be added to the costs to which plaintiff is entitled in IP suit.
