Hey I live in Louisiana, yesterday I had pleaded guilty for first time theft and they gave me a fine which was under 300, I didn’t pay it yet but they give you time paid the fine before June which is my next court date but if I pay for it befo didn’t I don’t have to go, but I’m trying to get a expunged off my record.. how can you get a expunged off your record if pleaded guilty and not yet paid the fine yet?

I'm in court In few days i've already said it was me in integration I sold my washing machine in my flat that I thought it was my goods I moved out and sold the white goods now I'm charged with theft and criminal damage because I took the door bujzer off

how about firewood? i bought a home from a woman who lived there with her husband. he owns and now live at a xmas tree farm behind me. 100 feet of firewood that goes from my lawn into his. i have cancer so i cant burn. i gave it away thinking it was all mine. did not sell one piece. he calls state police and is charginging me with theft. plus he threatened me. i just moved in and already sick of this guy. thoughts?

Can you be charged with theft or property if nothing was taken?.

In some cases yes. In Washington, if a person takes an act inconsistent with the ownership rights of a store for example (like putting unpaid for goods in your purse) then the store can argue that is theft. As you might guess, it is very fact dependent. The intent is the key. Thanks for watching!

I’m being charged with a 1st degree theft other than a firearm. Over $5000 I was un knowingly being used as a money mule during a stressful time of caring for my then 96 year old mother I was looking for at home work online for the first time in my life I’m 60 and didn’t really know who I was working for and was gullible and naïve about online work. I don’t really know how to explain everything here This is the first time in my life I’ve been charged with a criminal felony. I have a attorney but I don’t really know what their plans are for fighting it. I’m trying to get another opinion. I’m in Spokane. Any idea?

We have seen cases somewhat similar to that. We would suggest using Avvo.com to find a local attorney. Hopefully, the truth can be shown that you had no evil intent as Theft charges in WA state require the prosecutor to prove intent to deprive a person of their property.

What if the person lies and says it was over $100+ when it was only $50. And the case report is all wrong about the items and doesn't even have any information about what was taken. Is there a case?

@Ari Alexis: In Washington State the value of the merchandise determines the level of the theft charge. As everything has some value, taking anything in Washington without permission is likely a crime. Thank you for watching!

Hi I’m currently being charged for a first degree felony of missing lottery tickets and taking tips from customers when I had no idea that I wasn’t supposed to be taking tips at the beginning.. when I started so the company had me pay a total of $2,000 to them and had me sign papers while I was there.. and said that he would send a text to the investigator and it would be over but it’s not.. and I recently got a call from the sheriffs department saying that they want to speak to me about the case but I already paid the company and they said that that was it.. so what do I do now? And will everything be ok!! For me!!

What if we found a wallet but never opened it but Felt harassed so left with it but returned it to the security guard the next day?

That is a good question. If you got charged with a crime, you would want to reach out to an attorney. In most theft cases the key is the intent of the person accused of taking the property. Was it taken for safekeeping or to deprive the owner. Laws are different in different states and countries even. Thanks for watching!

I'm a dump truck driver and took bags that were laying on can I liked the bags like the phrase ones man's trash is another man's treasure so I threw the bags up in the front window for everyone to see cuz I thought it was garbage apparently had kids motorcycle gear the owner saw the bag in front window pulled me over slammed my door took his bags and said I went up his drive way 15 to 20 feet to steal the bags but they were lying on cans wouldn't have stole them he called my work and I got fired i went back to talk to them to see if maybe the kids accidentally lied and put them next to cans they guy even though my personal bag was his but they asked for my info and I gave it to them and they called police and now I'm waiting to talk to officer could I use mistaking took another's property as defensive or possibly even return of property as defensive if it goes to Court since I gave him property back and still haven't technically been charged and if I don't get charged can I take my job to court for wrongfully firing me by chance this is so crazy

@Levi - Wow, that is a difficult situation. There are plenty of possible defenses. We do not due employment law, but for the criminal side of things, hopefully nothing comes of it. If it does, try and find a local attorney to help.
