Thanks for watching! I appreciate the comment. You’re absolutely right. It can take hours to go through the information with a fine toothed comb to expose the lies and inconsistencies which can then sometimes lead to a dismissal. Having a dedicated and experienced defense firm on your side, truly makes a difference in this regard, especially if they truly care.

I appreciate the information. I have a few questions: Where do I find the Georgia Statute for discovery in a DUI case? And what can I do if the opposing party doesn’t submit the information within the 30 days? Can I request a dismissal?

Sorry, I don’t practice in GA, so I’m not familiar with their discovery rules. But there’s probably not going to be a separate set of discovery rules for DUI, they would just be the general criminal rules regarding discovery. Typically discovery must be provided at least 30 days before trial. If the discovery is not timely provided, that doesn’t mean the case will be dismissed. Dismissal would only be warranted in the most egregious of circumstances, where there’s intentional or serious misconduct.

Does the DA pit forward bodycam footage of when a victim was first making their dv report? The defense and criminally charged gets to see the entire thing?

Yes, they do. Yes, the bodywork camera footage of the interview of the complaining witness (and any other wit for that matter) are turned over to the defense as part of the discovery process.

Thank you! I’m glad you got something out of it. As for Notice of Discovery, it depends on the jurisdiction, but it can be a document filed by the state and the defense indicating what type of evidence they may present and what witnesses may be called at trial.

I appreciate the compliment, sir. Our firm only handles cases where people are facing charges or under investigation. Once a person is convicted, if they’re seeking appeals or post trial motions, usually an appellate attorney would be involved.

Thanks for watching! Ask 100 attorneys, and you’d probably get 100 different combinations of answers. I think one should be an effective communicator, a great listener, open minded, be able to think on one’s feet, have highly developed emotional intelligence, and be able to think outside of the box, to name a few. I’ve never taken an IQ test, but I’d say lawyers on a whole are smarter than the average person. Great questions! 😉

Can I sue for being falsely arrested for shoplifting at a store I never been inside, the person who stole from them was an Uber passenger who paid me for the trip, we don’t look the same and they took old photos from my fb to tie me to a string of his thefts, case was dismissed but I was still arrested and fired bc of this, I just wanna know can I sue the store

What happens if the officer turns off their body cam during a search of your home with no permission or granted warrant

The issue of having the camera on during a search is more a departmental policy issue versus a legal issue. There’s no legal requirement that an officer have the BWC activated during a search. But if an officer turns off their camera during a search that could call into question whether they were doing something illegal or shady. In order to search a home, generally, the police need a warrant supported by probable cause. There are exceptions to the warrant requirement, including consent, exigent circumstances, amongst others. So if there’s not a warrant, the officer needs to provide proof that there was an applicable exception to the warrant requirement. You’ve already mentioned there was no permission/consent, so there’d have to be another exception. Absent such a showing, if any evidence was seized during the search, the defense attorney can file a motion to have a judge throw out that evidence.
