For this lecture video, we shall discuss Criminal Liability and how is it incurred under Article 4 of the Revised Penal Code. Here we ask the question, how is criminal liability incurred.
So, let us now start our discussion.
In previous lecture, we discussed that felonies are committed by means of dolo or culpa. Now, Article 4 of the RPC provides that criminal liability shall be incurred by any person in two modes: first is when he commits a felony (either by way of dolo or culpa) although the wrongful act be different from that which he intended and second, by performing an act which would be an offense against persons or property, were it not for the inherent impossibility of its accomplishments or on account of the employment of inadequate or ineffectual means.
Complicated as it may sound, we shall dissect them one by one for you to have a better understanding of this provision.
Article 4, paragraph 1 is actually composed of two clauses. The first clause speaks about the commission of a felony (delito) by any person. And we all know that it can be by means of dolo or culpa. The second clause, meanwhile, talks about the wrongful act which may be different from that which intended by any person who commits a felony.
