The magistrate has no power to release an accused under section 169 Cr P C on an application made by police, once the accused is remanded into police custody. When the accused is in police custody remand and the investigation officer comes to know that the accused is not involved in crime, the police officer should make an application under section 167 read with section 59 of the Cr P C to the court and the court has to pass special order to release the accused.
