Because There you can fill particles in two different ways For 4e, 2 p in 2e and 1p in 0e , 1p in 2e and 2 p in 1e Simila....y for 3e, 1 p in 2e and 1p in 1e and 1p in 0e , 3 p in 1e

No. For the first excites state one fermion from E0 will be transferred to E1 making the system energy to 9E0. If one fermion is transferred from E1 to E2 the system energy will be 11E0 and it's higher than 9E0 so not the first excited state
