He isn’t saying that any other person (besides Hilary) would face charges - he’s saying there usually would be “other consequences” (other than recommending prosecution - ie administrative sanctions, etc.) but he wasn’t concerned with what the other consequences should be - he was just concerned with whether or not the facts of the case merited recommending prosecution - they clearly did not for all the reasons he gives. That is why the FBI chose not to bring charges. Also, if you “listen closely”, you’ll also understand why the Trump case is a no-brainer.

U.S. Code, Title 18, Part 1, Chapter 37, Section 793, Paragraph F: "Whoever, being entrusted with or having lawful possession or control of any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, note, or information, relating to the national defense, (1) through gross negligence permits the same to be removed from its proper place of custody or delivered to anyone in violation of his trust, or to be lost, stolen, abstracted, or destroyed, or (2) having knowledge that the same has been illegally removed from its proper place of custody or delivered to anyone in violation of its trust, or lost, or stolen, abstracted, or destroyed, and fails to make prompt report of such loss, theft, abstraction, or destruction to his superior officer- Shall be fined under this title or imprisoned not more than ten years, or both." Today, FBI Director James Corney confirmed and listen in minute detail instances in which Hillary Rodham Clinton mishandled classified information and left it to be lost, stolen, abstracted, or destroyed. In his statement, he said this: "Although we did not find clear evidence that Secretary Clinton intended to violate laws governing the handling of classified information, there is evidence that they were extremely careless of very sensitive of highly classified information." He then went on to give examples such as this: "Seven email chains concerned matters that were were Top Secret Special Access programs at the time they were sent and received. Those chains involve Secretary Clinton sending emails about those matters and receiving emails about those same matters. There is evidence to support a conclusion that any reasonable person in Secretary Clinton's position or in the position of those with whom she was corresponding about those matters should have known that an unclassified system was no place for that conversation." He even went on to say this: "None of these emails should have been on any classified system, but their presence is especially concerning, because all of these emails were housed on unclassified personal servers not even supported by full-time security staff like those found at agencies and departments of the United States government or even with a commercial email service like G-Mail." A basic legal dictionary defines gross negligence as "a conscious and voluntary disregard of the need to use reasonable care, which is likely to cause foreseeable grave injury or harm to persons, property, or both." FBI Director James Corney has confirmed that all of this has happened. Since any reasonable person in Hillary Clinton's position should know how to handle this information, she has consciously and voluntarily disregarded the need to use reasonable care. And since this is classified and even top secret information, it is most certainly likely to cause grave injury or harm to persons, property, or both. Even by the FBI's own statement, which recommended no charges against Hillary Clinton, she still broke the law.

This has to make people cry. American Citizens have went to jail for writing the wrong information on a medical card application. Families ruined forever for stupid mistakes. My cousin was murdered in a detention center by jailers. No justice for him. The poor people always pay. Always pay.

Pay close attention from point at 4:30 to 5:17, yet criminal charges are not recommended? 8 email chains contained TS info, if even one chain was mishandled unintentionally by a service member, it would be enough at the least to have their clearance revoked, and more likely to have them charged criminally for espionage. And to say possible intercept by hostile governments? How about highly probable!

So extremely careless isn't gross negligence? 18 USC §793. This statute explicitly states that whoever, “entrusted with or having lawful possession or control of any document…through gross negligence permits the same to removed from its proper place of custody…or having knowledge that the same has been illegally removed from its proper place of custody….shall be fined under this title or imprisoned not more than ten years, or both.” Looks like its open season for being completely stupid with classified data and national security information.

any "reasonable" person fully understands, acknowledges, knows we the people would be criminally charged and prosecuted for these criminal acts. any "reasonable " person with out a shadow of doubt knows our government officials are above the laws that they want enforced on us, the American citizens. how many American citizens are in prison currently that had no intent during their action they were found guilty and convicted for? People are charged with manslaughter and not murder when there was no intent but still go to prison. manslaughter because their actions were unreasonable, negligent, careless, reckless, etc... but without criminal intent. they're charged, convicted, sentenced and serve time in prison. if we the people would not be charged with a crime because at the time there was no criminal intent, the prisons would not be overpopulated.

@artis19699 ай бұрын
It shouldn't remotely matter because it's next to impossible to prove. Comey knew this and used it to squirm out of his duty. His circus of back and forth during the months leading to Nov 2016 set us on this course. The more this stuff trickles out bit by bit over years will most likely show that nearly everything they've hung on Trump, they did themselves.

I was absolutely appalled at what I heard here! I worked around classified material for a brief time and if we had ever treated classified data with the same cavalier attitude Clinton did, we'd be fired on the spot! And she was Secretary of State! She is just so sure she knows what's best for everyone - she just does whatever the hell she pleases. I don't care for Trump, but it's stuff like this that makes me nervous whenever Democrats are in charge of national security. Unacceptable. I guess I'm voting for Gary Johnson....

@johnmcdonald1306 Жыл бұрын
Comey said it was "carelessness" rather than "gross negligence" which is a felony and unlawful. Then wording it is a misdimenor to knowingly remove classified information that should be honestly "destruction of evidence" which is knowingly an intentional "Obstruction of Justice" of a High government officer who knew it was illegal. She did this to find ways to destroy her mistakesin Bengazi . IF THIS WAS ANY MILITARY OFFICER (OR TRUMP) THEY WOULD HAVE BEEN IN PRISON. We the people see this politicalization of the FBI and Dept. of Justice injustice!! I voted probably 50/50 Democractic and Republican. At 63 I know our forefathers who THOUGHT AND DELIBERATED ABOUT AND WORKED HARD TO WRITE OUR US CONSTITUTION AND BILL OF RIGHTS, would be ashamed . People should serve the people and Country AND NOT ABUSE POWER FOR GREED NEGLECTING YOUR PLEDGE. i REMEMBER SAYING THE PLEDGE OF ALLEGIANCE AND HEARD OBAMA'S WIFE NOT KNOWING ON MIC SAY ALL THIS FOR A FLAG?. She obviuosly has not tryed to feel the soildiers pain, patriotism and courage being bombed to make sure our flag still stood but many died doing so..

"No reasonable prosecutor would go through with this" -James Comey The double speak is incredible.... After all any 'reasonable' prosecutor would protect the clintons too.

This is not gross negligence? I swear I heard him say "there is evidence to support a conclusion that anyone reasonable person in secretary Clinton's position, or in the position of whom she was corresponding about those matters, should have known that an unclassified system was no place for that conversation" Followed by "we cannot find a case that would support bringing criminal charges on these facts." Followed by "To be clear, this is not to suggest that in similar circumstances, a person who engaged in this activity would face no consequences. To the contrary: those individuals are often subject to security or administrative sanctions." ... I don't understand ... The position of president is not an administrative position? Based on this conclusion, i'd think that she should be restricted from the presidential position to say the LEAST

I understand that, but there are better ways to show your disapproval, this is technologies version of "Don't shoot the messenger" because shooting the person that helped to keep you informed does not hurt the person giving you the bad message in any way. There are many ways to effectively show your frustration, I suppose this is the safest most convenient and anonymous method, but it's also the least effective.
