The TCAS worked properly, but other factors were the reason there were problems. Without TCAS there would've been thousands of more lives lost to date.

The private Jets transponder was somehow turned off which lead to tocas also being disable, the Boeing 737s y as did work but since the others didn’t it didn’t warn them

I don't see why transponders should be able to be turned off at all. What reason would you have to turn it off at all? Just leave them on any time the plane is running. The Brazilian court was very petty and looking for someone to blame, preferably nonbrazilians, so they went after the legacy crew. The Brazilian ATC was so neglected that it was the ultimate problem here.
