@The Emperor because dumb people do dumb things, there’s no cure for stupid as they say. Unfortunately I had to deal with these kind of morons all the time as a landlord. One example, a woman rented a 2 bedroom house from me and then tried to blame me for over populating it when she moved her boyfriend and 3 kids into it 🤣🤪 that’s how retarded some people are!

@@brent2974 It's not a criminal trial. The fact that they are still on the rims, and the damage can be matched up should be sufficient with testimony from me that they are in fact the same tires that were removed and stored to date.

They way I see it, if you are renting a super car you are either going to be 1) super careful b/c you know how much it's worth and consider this a big life reward 2) a complete jackass who thinks they are immune to consequences.

I think the current situation in America along with this proves that there seems to be a culture of "this thing isn't going my way" or "i messed up and it's going to cost me money" so they then go to "i'm going to sue xyz" a lot of people these days seem incapable of just holding their hands up and saying "yep, i was wrong" and just taking the consequences, they always have to try and squirm out of it.

@@augustinf it Doesnt matter.... Balance of probabilities in civil case. You make a claim, you have to show that evidence greater than the defendant....if he has more evidence to counter (even if it’s only anecdotal/ circumstantial) , then you’re screwed.... It isn’t criminal case where the prosecution has to provide evidence proving “beyond reasonable doubt” that the charge is absolutely true. The guy is clutching at straws (or tyres in this case) and is sunk imo lol

Not on a Ferrari. The manetino controls the stability and traction control. I leave mine in race, it does not switch back to any “mode” when I start the car. I would never turn off stability or traction control on a ferrari, the next position(s) on the manetino after race, it’s too easy to have the car kick out in 2nd gear and go sideways. In race mode, the car will allow a little stepping out but then the computer puts it right back.

There is insurance all around and most businesses are like that. This just look more dramatic because they are pretty cars and it is easy and emotional for us who like the cars. Rob seems to keep emotions out of the way of the business and just handles it like a business transaction where all that matters is the numbers.

1. If he was injured, you’re probably going to lose 2. The judge can easily suspect that you changed the bald tires for newer used tires 3. If he has a police statement with the tow truck driver on record describing the tire wear, you might lose

@@tt-ln4mc 45% for a maniac is a little steep, I would say 20-25% or even lower. There are people who want a test drive without having a bish from a dealer sitting in the passenger seat. I did it with a M2, not a mega expensive car, but my point still stands.

Sounds like your former client has a family attorney that's taking you for a spin. They'll try to wear you down and hope you give up or settle. Be sure to include your legal fees as well as all compensatory damages in the suit. Requesting a jury trial usually stops the nonsense. Many cases have been settled in a side/back room of the court house just prior to jury selection.

There should be something you can program into the ECU to lock traction control on for this reason so even when they turn it off, it doesn't actually go off.

"I have an expert in tires who will testify the tires on the car were in fact NOT bald!" What other claims do you wish to make for us to disprove?"

Honestly the argument against it would be "you can't prove those tires you've brought to court are the tires that were on it when it was wrecked." Which would probably be countered by Rob having pictures of the serial numbers for each set of tires timestamped with when they were put on and placement. It'll be mostly moot by the GPS readings though along with Robs extensive checklist of things you've got to sign off on I'd imagine

@@jonsmith1259 That's a incredibly strong possibility. This isn't the first nor will it be the last that a bad customer tries to use the courts to get out of one of Robs bills. Frankly what is more surprising is that with all these horror stories you'd think anyone else would cash out and go into a more stable line of work. Either the profits are crazy good for Rob or he's just so in love with the rental business he'd not be happy doing anything else as a base business.

I'm amazed at the tire life you get. I had an e39 m5 for 14 years. Almost never drifted and never any burnouts, but the back tires only lasted 6000 miles. Eventually I learnt be very gentle with the right foot and got it up to 20 000

He obviously knows people will push the cars limits but he doesn’t care because he has the right measures in place to protect his own ass and that’s why he’ll win this case. In the end, the guy was driving way too fast in the rain in a rwd super car with traction control deliberately turned off.

I worked for a guy that had an orange Ferrari 458, he had it parked in his condo's garage, his neighbor in a Mercedes GL550 back into the back end of the Ferrari. The lady wanted to call the police and get her insurance company involved. My boss said don't worry about it. I will take a bigger hit if this car is reported as being in an accident. So he took it to a body shop, and was around $12,000 to fix (out of his own pocket). A bad carfax or vehicle history report on a Ferrari will cost you big money.

Being a tire expert (me) there is another tire wear factor - you missed something. Tire wear does not happen mile after mile equally. Tire wear slows as it happens. As the tread gets worn, it wears more slowly. It is thinner and will run cooler are wear more slowly. Therefore when a tire measures half gone it is less than half worn out mileage wise. This fact has nothing to do with the fact that guy is wrong about the tires but I just wanted to point it out to make myself seem smart is all! 🤪

I would never rent from this guy. You fart on the seat and he'll have his trained German Shepard detect it and charge you for a new interior, loss of rent, devaluation and punitive damages; psychological trauma, pain and suffering. It's just one story after another.

I turned traction control off while pulling a legal u turn at a stop light in my sl55 amg. The tires barely got lose but I overcompensated and snap oversteer/ the car equivalent of a highside happened. I spun 180° and barely kissed the curb (must have only been moving a handful of MPH, 3-4?, at impact) with my driver's side rear wheel. The wheel was a couple degrees out of optimal position and the side airbag deployed. Insurance deemed it a total Lois and It makes me sad every time I think about it (including now). I now drive a jetta, Rob is correct in saying DO NOT TURN OFF TCS (especially if you're not super acclimated to the car)

Judge is gonna see GPS records, 96mph on no traction mode and throw this case out. It's ridiculous if this guy thinks he has a fighting chance. He's ultimately spend more money on litigation than if he were to pay up. He should be responsible for his actions. Play stupid games you win stupid prizes, don't abuse a rental Ferarri because if you crash it, you immediately get destroyed financially. That's common sense.

Case is going to be dismissed on the face of it. He can't offer any evidence or testimony that could possibly win this case. It's his duty to prove the tires were bald, not yours to prove they weren't. There's also no precedent that a rental company has to walk a renter through every page of the owners manual. If the owner's manual wasn't provided in the glove box then he maybe would have something (which is also why every rental I've ever driven has it there).

I work roadside, I literally had a customer say they were going to sue a company for a rental trailer getting a blown tire, even though, they didn't have to pay for anything. The company covers the tires, they know it's a cheap tire and they s!it happens.

You shouldn't sue a customer because you're not happy with an insurance corporation. If insurance isn't covering diminished value you're just going to have to eat that as the cost of doing business. When you sue an individual this way that's just bullying, and in the end the lawyers are going to get all that diminished value in cash, and you'll be left with the same car -- one that you can certainly still rent and profit off for years.
