Oh, you're right. Legally MUFC might be fine. But both Berrada and Ashworth are maybe in breach of their respective contracts and thus breaching at least civil law. And maybe, possibly - and absolutely against the common sense of MUFC supporters - a court might decide that, actually, MUFC is not above the law. And sentence both to pay fines and place a - say - five year ban on them to seek/ accept employment in English football. Pogba them. And yes, I seriously doubt that Newcastle or City will press such charges. But it should be done. Just like Stramer should have replied to Ratcliffe (about tax payer money for a new Old Trafford): "Where again do you produce those INEOS cars? In France? Up yours!"

Newcastle paid 72% of the remaining of Dan’s Brighton contract which was the lower figure, Brighton requested 135% of the contract. Manchester United are suggesting to pay just 14% of the remaining of the contract. Manchester United do not like doing business with Newcastle and just acting like a bully because historically they have been a bigger and more successful club. I don’t see Manchester United finishing above Newcastle for a long time the way they are being run. Hopefully Newcastle get around £5m to £10m which would be fair for both clubs.

Ashworth will know all the transfer targets for Newcastle for this summer. There will be positions that both clubs need to recruit for and it’s bad for Newcastle if ManU knows Newcastles hit list. I am a Director in a company and if I move to a competitor I can have a lot of competitive knowledge. In my contract I am not allowed to be hired by a competitor within 12 months of leaving my current job. This is all very normal.

That does not give the right of indenture. Employees are free to work where they please. The contract only adds protections not absolutes. If Newcastle has not made full payment up front they will not have a strong position. Transfer targets will have no bearing on the outcome.

Wouldn't the email just prove of Berrada offering Ashworth a job? If one were to get a job offer, would it not be leverage to present that offer as concrete? He could still argue he was muling the offer, perhaps seeing if Newcastle would counter with an improved compensation package. He could then say that being put on leave made continuing at Newcastle untenable

How can he be "sacked" when he is still an employee and is being paid in full? If company secrets are at risk, they can remove him from his privileged position until the matter is resolved. hence gardening leave. also he will be in breach of contract and NDA's.

Newcastle continued to pay his wages so he wasn't sacked. He was placed on garden leave because he was occupying a role that allowed him to identify and meet with potential targets for Newcastle United whilst also being aware of our long-term plans, at the same time he declared his interest in doing the exact same role for Manchester United. Hard to accept I know but the two clubs are competing on a similar level ATM, finishing one place above each other in the last two seasons. So no Newcastle didn't want him in and around the club

Wilcox is the technical director. It is a different role to the sporting director. Wilcox will be more focused on how all the teams play and how the coaches teach them to play. Sporting director oversees everything to do with football, including recruitment.

Not a great start to life under Ineos. Hopefully Ashworth has some dirt on Newcastle and we can use it to get him out of there. But it worries me how murky it all is. I'm really not sure about this Berrada character, why the hell did we take him from a club whose facing 115 chatges of financial breaches? Surely he is involved in that and could face a ban in the future.

It's a massive reach from Ashworth. Regardless of the gardening leave. He has a contract with Newcastle and is being paid by them. Sacking someone would stop paying them. Also looks like Newcastle were right to be suspicious as they found the evidence that was there prior to him being placed on gardening leave as he must have had access to BCC himself in. Schoolboy errors. The more I hear about Ashworth the more I want us to keep well clear of him.

Have Newcastle paid the contract up front? If not they will have to follow employment rules like everybody.

@@Art-is-craft He is still being paid as per his contract I believe and will continue to be paid until his contract ends. I guess if they sack him they can stop paying him but then he could maybe have a case for unfair dismissal and be able recoup his lost income and maybe more. Newcastle will be holding to the contract knowing that Man Utd want him and they can use any compensation to pay for whoever they choose to replace Ashworth. If they paid £4m approx to Brighton to leave his contract with them 6 months early then They might need a minimum of £4m for replacement. I believe they've hired a recruitment company to find that replacement so that'll add to their costs. Also I suppose if Ashworth has a 20 month exit date and if he is on more than he was at Brighton which I suspect he would be they'd want at least £10m-£15m with negotiations

Players contracts I understand BUT employees, managers and executives are a whole different thing. Excuse my naivety if I’m way off base on this but it all seems pretty sophomoric

Ashworth is under contract to Newcastle until 2025 and shouldn't have been talking to any other potential employers. Simple as that .He agreed to such when he signed and accepted higher wages as compensation. Man Utd should have approached Newcastle before they did Ashworth. That is the rule. Ordinary folks like us have short contracts where we give an agreed notice period.
